  • Tax Assessments Corrected:

143 .Regular meeting of the City Council : Austin, Texas, October 22, 1914. The Council was called to order by the Mayor: Roll called : Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Absent none. The minutes of the last regular and subsequent recessed meeting were approved: Reports of City Officers: The Mayor laid before the Council the reportof the Asst City Clerk, the Sanitary Inspector which were read and ordered filed : Henry Oertli Jr Tax Councilman Haynes presented a petition from Henry Oertli Jr ,asking that an assessment made against him for the year 1913, for Credits ,be corrected ,as he did not have the credits charged to him . On motion the petition was granted and the allowance made, by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. C Cemetery Annex Contract fence Cemetery Councilman Bartholomew to whom was referred the bids for Fence around the Cemetery Annex, stated that he had examined the bids presented, and that the bid of Mr E C Stanton, at 17 cents per foot, being the lowest bid offered, he recommended that he be awarded the contract. The recommendation was adopted ,and the Bid awarded as recommended ,by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Mayor Wooldridge presented the following communication : Austin, Texas, October 21st 1914. The Honorable City Council , Of the City of Austin, Texas. Gentlemen : I here beg leave to amend my budget for the Fire Department for the year 1914, and to appropriated directly to the miscellaneous fund in the Fire Dept the sum of One hundred dollars ($ 100.00) received from the sale of a horse turned over to the City by North Austin Fire Company No 6. Budget amended This appropriation direct to the miscellaneous fund of the Fire Dept is intended to cover some unexpoted expenditures charged against that fund, which, but for this credit , would otherwise be overdrawn. Mayor Wooldridge offered the following resolution : Resolved by the City Council of the City of Austin : That the one hundred dollars ($ 100.00) paid to the City of Austin by Rescue Hose Co No 9, in purchase of a horse for use of the Company ,be and the same is hereby directly approRescue Hose Co 9 -priated to the miscellaneous fund of the Fire Department for the year 1914. Councilman Anthony offered the following resolution : Resolved by the City Council of the City of Austin : That the sum of sixty ($ 60.00) dollars be and the same is hereby transferred from the account for Head Nurse in the appropriation for City Hosp-ital and appropriated to the account for Laundress in the appropriation for City Hospital : The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin : That the sum of $ 110.25 ,be and the same is hereby ordered to be trans-ferred from the General Street fund to the Permanent Street fund, for the purpose of refunding to the Permanent Street fund ,this amount drawn out of the Permanent fund, and which should have been drawn out of the General Street fund, See warrant No 3870, Permanent fund. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. .Councilman Hynes offered the following resolution : Whereas, it appears from the attached affidavit of Henry Oertli Jr , that he had no credits whatsoever on the 1st day of January 1913, subject to taxation or otherwise. Now, therefore, Resolved by the City Council of the City of Austin : That the assessment of credits against the said Henry Oertli ,Jr for the year 1913, in the amount of $ 960.00, which is 80% of $ 1,200.00, the alleged credits owned by the said Henry Oertli, Jr , su bject to taxation, be and the same is hereby cancelled and annulled and the Assessor & Collector of this City declared entitled to take credit upon his rolls accordingly. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. The Mayor laid before the Council the following resolution : Whereas, W P Allen in the attached affidavit swears that he had no credits subject to taxation on the 1st day of January, 1913, and that the notes of E J Cavilier assessed against him ,the said W P Allen, on the 1st day of January 1913, in fact did not exist at that date in that he, the said W P Allen, had taken the property at 1803 East Avenue , out of the lien upon which said notes arose ,from E J Cavilier, the maker of same, in satisfaction of saidnotes. Now, therefore, Resolved by the City Council of the City of Austin : That the credits assessed against the said W P Allen for the year 1913. in the amount of $ 3,500.00, and listed upon the rolls of the Assessor & Collecto --- Page break --- 145 .office at $ 2,500.00 ,said $ 2,800.00 being 80% of $ 3,500.00, be and the same are hereby cancelled and annulled and ordered stricken from the assessment rolls of this City for the year 1913, and the Assessor & Collector hereby entitled to take credit accordingly. The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin : That the sum of $ 113.50, be and the same is hereby appropriated out of the General Contingent fund of the City of Austin,Texas, to reimburse Herman Pressler in that amount for moneys paid by him to the Texas Biulithic Company for the City of Austin for paving in front of a strip of land 36-45 feet long on East 6th street near its inter-section with Chalmers Avenue . The above appropriation is made to carry out a contract made on the part of the City of Austin with Herman Pressler to put in the concrete sidewalk and curbing in front of Lot No 12 in the subdivision of Outlot No 5 Div "A" of the City of Austin,Texas, and to pay for the street paving in front of a part of Lot N o 12,in the subdivision of the North one half of Outlot 5 Div "A" of the City of Austin,Texas, as is more fully set out in the deed of Herman Pressler to the City of Austin,Texas,for street purposes of the strip of land in front of which said paving paid for by this appropriation is laid. Councilman Anthony presented the following resolution : Whereas, Judge R T Fulmore , Judge of the Corporation Court of the City of Austin, Texas, has stated to the City Council that the fine imposed by him against one Woodie Daviain cause No 8962, in the Corporation Court of the City of Austin,Texas, was in his judgement excessive and imposed in error as to the man committing the offense charged against against him , that of abusive language, and recommends that the fine in this cause be reduced from $ 25.00 to $ 5.00 . Now, therefore, Resolved by the City Council of the City of Austin : That the fine imposed in the Corporation Court of the City of Austin,Texas, in cause No 8962, State of Texas vs Woodie Davis, be reduced from $ 25.00 to $ 5.00 and the costs in the case accruing, said judgement and sentance be declared satisfied in full. Approved, A P Wooldridge ,Mayor. --- Page break --- 146 - Councilman Anthony offered the following resolution: Resolved by the City Council of the City of Austin: That the sum of forty ($ 40.00) dollars , the proceeds of the sale to W R Canion by the City of Austin, Texas, of the Patrol wagon and harness used by the Police department , be and the same is hereby appropriated to the miscellaneous account of the Police Department. Sale Patrol Wagon + Harness The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin : That a permit be and is hereby granted to the Stires advertising Company of San Antonio, Texas, and Austin, Texas, to erect and maintain a steel corrugated Bulletin Sign , ten feet high and thirty feet long , on top of the Brick Wall in front of the property located at the Northeast Corner of the intersection of 5th street with Congress Avenue . The sign hereby authorized to be erected and maintained at the place hereinabove designated shall be entirely of steel, of the specifications set out in the application for this permit, which application is filed in the office of the City Clerk of the City of Austin, Texas, and made the basis of this permit. Be it further resolved : That the work under these specifications must be done under the supervision of the City Engineer and the City Electrician , W L Eyres, and Be it further and finally resolved : That the permit hereby granted is to be deemed temporary and subject at any any time to revocation at the pleasure of this or any subsequent, City Council The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Sign - Councilman Haynes presented bid of Wm Ulit for House on Cemetery Annex, for $ 400.00, which bid was accepted and the house sold him at that price, by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell Nays none. House Cemetery Annex --- Page break --- 147 October 27th 1914. The Council was called to order with all members present. The Mayor laid before the Council the following resolution : Whereas, it appears from the statement of Val Giles of this City and of Henry Ziller, Assistant City Assessor & Collector of this City, that on October 2nd 1877, a deed was made made to Val Giles to the northeast quarter of Cemetery Lot No 249, in Oakwood Cemetery, which deed ,according to the statement of Mr Val Giles ,has been either permanently lost or permanently mislaid, Now, therefore, Resolved by the City Council of the City of Austin : That A P Wooldridge, Mayor be and is hereby authorized to execute a duplicate deed to Val Giles to the said northeast quarter of Cemetery Lot No 249, in Oakwood Cemetery in the City of Austin, Texas. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin : That a permit be and is hereby granted to The American Publishing Company of this City to erect and maintain in rear of their place of business at 813 Congress Avenue a shed room, the walls of which are to be entirely of galvanized iron, or steel, the walls of which are to be entirely of galvanized iron and the supports of which are to be of steel or iron ,no part of which structure is to be wood ,save and except the beams and the supports of the galvanized iron roof . Resolved further: That this permit is revocable at any time in the pleasure of the City Council. Mayor Wooldridge offered the following resolution : Whereas, in paying for the automobile Patrol wagon for use by the Police Dept of this City , an overdraft was made in the budget for 1914 for care of the Patrol Horse and wagon "in the amount of $ 52.00. Now, therefore, Resolved by the City Council of the City of Austin : That the sum of $ 52.00 out of the proceeds of the sale of the horse heretofore used to draw the Patrol wagon ,and amounting to $ 137.50be and the same is hereby for the the purpose of covering said overdraft and balancing said account ,appropriated to the the account for care of patrol wagon and horse in the budget of this City for the year 1914, and Be it further resolved : That the balance of the proceeds of the sale of said horse , amounting to $ 85.50,be and the same is hereby appropriated to the credit of the Miscellaneous fund of the Police Dept of this City. Co building Permit Transfer funds --- Page break --- 148 Sewen Trespaction fee remitted The Mayor laid before the Council the following resolution: Resolved by the City Council of the City of Austin: That seventy five cents, or the inspection fee for installing the sanitary sewer at the Tom Smith place at the corner of 8th & Guadalupe streets in this City be and the same is hereby remitted and directed not to be made a charge against said premises. The resolution was adopted by the following vote: Yeas Mayor Woolridge, Councilmen Anthony, Bartholomew & Haynes 4 Nays Councilman Powell 1 Approved, A P Woolridge, Mayor. @L Woodward sign The Mayor laid before the Council the following resolution: That, Whereas, the petition of G Flury, agent for C L Woodward, to install install and maintain at 1011, Congress Avenue in this City an electric sign of about the following description, as is set out in said petition, be and the same is hereby granted. Said sign is to be two feet high by four feet long. It is to have the word "Bar" in letters made with opalescent glass, and the words" C L Woodward, Prop," made with punchings, of 25 watts each or making power and Said sign is to be lighted inside with three globes, and to be in all other respects in conformity with the ordinances and regulations of the City Council governing such matters - Resolved further: That this permit is revocable at the pleasure of the City Council. October 27th 1914 The Mayor laid before the Council the following resolution: Resolved by the City Council of the City of Austin: Stires Advertising Co. Sign That the application of the Stires Outdoor Advertising Company to establish and maintain an exclusively and entirely steel constructed illuminating sign on the roof at the corner on the wall over the building at the southeast intersec-tion of East 5th street and Brazos street in this City, be and the same is hereby granted. Be it further resolved: That the petition heretofore on the 22nd day of October ,1914, Granted to the said Stires Outdoor Advertising Company to erect and maintain a steel sign ,10X 30feet over the roof of the building at the east intersec-tion of 5th street with Congress Avenue in this City be and the same is hereby repealed. The sign hereby authorized to be placed over the building at the southeast intersection of East 6th street and Brazos street may be as large as 10 feet high by 30 feet long. It is to face 6th street and it must be installed under the direct supervision of the City Engineer and the installation must be --- Page break --- / 19 . subject to his approval . Resolved further: That this permit is revocable at any time in the pleasure of the City Council. Permit Stires Advertising Co revoked October 28th 1914. The Mayor laid before the Council the following resolution : Whereas, it has been made known to the City Council by Mr Elbert M Jones, whose Mother owns the premises at the southeast corner of the intersection of East 6th street with Brazos street in this City , that his Mother has not heretofore consented ,nor does she now consent ,and is extremely opposed to the placing of a large size electric light sign by the Stires Outdoor Advertising Co upon the wall over her building at the corner of 6th street and Brazos street in this City; and Whereas, the City Council issued a permit on October 27th 1914, to the Stires Outdoor Advertising Company to place a large size electric light sign over the building at the southeast corner of east 6th street at its intersection with Brazos street in this City under the impression that the owners and occupants of the building over which the sign was to be erected had consented thereto,but as it now appears to be otherwise. Now, therefore, Resolved by the City Council of the City of Austin : That, in consideration of the premises hereof and the strong protest made by Mr Elbert M Jones, agent for his Mother, the owner of said building ,upon the top of which said steel sign 10 X 30 feet was to have been erected by the Stires Outdoor Advertising Co, against the erection of said sign ,the permit heretofore issued by the City Council, to-wit, on the 27th day of October 1914, to erect and maintain said sign, is hereby cancelled and revoked .
