The Council was called to order by the Mayor; Roll called: Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Absent none. The minutes of the last regular and subsequent recessed meetings were read and approved:

By Councilman Haynes: An ordinance levying municipal taxes for the City of Austin, Texas, for the year 1914: The ordinance was read the first time and passed under suspension of the rules by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. The Mayor laid before the Council the following resolution: Whereas, the City of Austin and the Public Free Schools of this City are the joint owners of a tract of land of about five acres in the West part of this City, known as House Park; and Whereas, in the judgement of the City Council, the Board of Trustees of the Austin Public Free Schools, through its Officers and Agents, is better qualified at the pre sent time to improve and conduct this park for recreation purposes than id the City Council; and Whereas, the Board of Trustees of the Austin Public Free Schools promises, engages, contracts and agrees that it will improve and maintain said premises for recreation purposes.by fencing same and placing in position sufficient and suitable modern apparatus for athletic exercises and will lay off in said five acre tract one or more baseball diamonds and establish a football field and place tracks for running and other athletic sports, and will erect a grand stand and do all other necessary and proper things suit-able for the enjoyment of said five acre tract for recreation purposes; and under such proper regulations as it may establish, will open said premises to the use and enjoyment of the white children of the City of Austin, and will maintain said premises and the apparatus therein placed at a high standard of efficiency, and particularly will keep a professional instructor in charge of said grounds and the athletic sports conducted thereon,
Transferential Control House Park to Bd of School Trustees
Now, therefore, Resolved by the City Council of the City of Austin: That the possession and control of said House Park for the purposes herein above stated be and the same is hereby turned over to the Board of Trustees of the Austin Public Free Schools, without, however, the title of the City's part thereof being hereby trans-ferred out of the City of Austin in its general municipal capacity as distinguished from the Public Free Schools of this City. The Mayor offered the following ordinance:
An ordinance authorizing and confirming the sale by and its Board of School Trustees of one hundred and sixty nine & thirty eight eight one hundredths ( 169-38/100) acres of land ,being abstract No 431, located by virtue of certificate No 165, D M Wiseman original grantee, situated adjoining in the County of Bastrop and State of Texas. The ordinance was read the 1st time and passed under suspension of the rules by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none.
Councilman Haynes offered the following resolution :
Whereas, the deed executed by Geo S Matthews ,Sheriff of Travis County, Texas, on the 17th day of April 1909 , to Lot No 4 in Block No 157, of the City of Austin, Texas, recites the consideration for said deed to be the sum of twenty two dollars and forty cents ( $ 22.40 ) as taxes owing upon said prop-erty by Chat E McLaughlin for the year 1905; and Whereas, said statement is an error in that the taxes on said Lot 4 , in Block No 157, in the City of Austin, Texas, for the year 1905 had been paid long prior to said 17th day of April 1909,on , to-wit , January 7th 1907, and the real consideration moving to said deed was the costs owing by said Chat E McLaugh-lin in cause No 24295, most of which had accrued long after the payment of taxes on said Lot No 4, in Block No 157, and which costs at the time of the payment of said taxes ,to-wit , on January 7th 1907, amounted to the sum of only $ 5.35; and Whereas, the City Attorney advises that by reason of the erroneous statement of the consideration in said deed set out, the same is void. Now, therefore, Resolved by the City Council of the City of Austin, Texas: That in consideration of the payment of the costs accrued up to January 7th 1907, in said cause No 24295 , the City of Austin vs Chat E McLaughlin for taxes , amounting to $ 5.35, the receipt of which is hereby acknowledged by the City of Austin , the Mayor of this City ,A P Wooldridge, be and he is hereby authorized to execute a quit claim and release to the said Chat E McLaughlin to the said Lot No 4 ,in Block No 157, Be it Further resolved : That the City Assessor & Collector be and he is hereby authorized to cancel as a claim against the said Lot No 4, in Block 157, the balance of $ 17.05,the remaining costs due and owing in said cause and to take credit upon his books accordingly. Pm Deats Count Contingent Fund The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin : That the sum of $ 650.55 be and the same is hereby appropriated out of the General Contingent Fund of the City of Austin, Texas, to pay the itemized attach bill owing by the City of Austin to Paul M Deats County Clerk of Travis County Texas. The Mayor laid before the Council the following resolution : Whereas, it appears to the City Council equitable and sensible to adjust ,without further delay, the question of the value of the property belonging to A T Allison above the the dam and about to be submerged by the back water from the dam. Now, therefore, Resolved by the City Council of the City of Austin : That the proposition of E R Pedigo ,attorney for the said A T Allison, to adjust the matter of the value of the property belonging to the said A T Allison about to be sub-merged by the back water from the dam now finishing, be adjusted by arbitration at a reasonably early date; each party to this controversy ,to-wit, the City of Austin and A T Allison, to appoint an arbitrator ,and in the event of disagreement , these two to select a third party.
