315 ...Regular meeting of the City Council : Austin, Texas , July 22, 1915. The Council was called to order by Councilman Bartholomow, Mayor Pro-tem: Roll called: Present Councilman Anthony, Bartholomow, Haynes & Powell 4 Absent, excused, Mayor Wooldrddige 1 The minutes were read and adopted: DR Gregory Building permit Petition of T C Gregory, for permission to erect building within the Fire Limits,was presented, read and on motion referred to the Board of Fire Comisioners: Petition of Cunningham & Voss, for permission to put in a Tank & Pump,at 214 East 6th street was read and on motion petition granted by the following vote : Yeas Councilmen Anthony, Bartholomow, Haynes & Powell 4 Nays none. The Chair laid before the Council the following resolution : Resolved by the City Council of the City of Austin,Texas: That the sum of one hundred ($100.00))dollars be and the same is Hereby appropriE. U. Marshall overflowed Land -ated out of the Earnings fune of the Water, Light & Power Dept ,of the City of Austin, Texas, and made payable to Herman Pressler, Guardian of Elizabeth Marshall,by reason of damages Sustained to overflowed lands, The resolution was adopted by the following vote : Yeas Councilmen Anthony, Bartholomow, Haynes & Powell 4 Nays none. The Mayor laid before the Council the reports of the Supt of Streets for the ,month of June 1915, which were read and ordered filed. Claim G.W. Patterson Damages Councilman Powell presented claim of G W Patterson for damages to horse caused by falling into an open ditch, which was allowed by the following vote : Yeas Councilmen Anthony, Bartholomow, Haynes & Powell 4 Nays none. Ordinance for License of Drivers The Chair laid before the Council An ordinance providing for the licening of Drivers of Autimobiles for hire; prohibiting persons from acting as drivers of autimobiles for here without licenses; and prescribing penalties for the violation thereof: The ordinance was read the first time and passed under suspension of the rules by the following vote : Yeas Councilmen Anthony, Bartholomow, Haynes & Powell 4 Nays none. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin, Texas : That Mrs S M Robertsonbe and she is hereby granted permission to construct a sidewalk three and one-[illegible] feet in width adjacent to her [illegible] along the west side of [illegible] street, in front of the north half of outlot 15, in division "O". The north feet ending at the south side of 10th street. [illegible] --- Page break --- 316 Δ E Crena Fine remitted . Councilman Anthony offered the following Resolution: Whereas, it appearing to the City Council of the City of Austin, that S E Crow, who was fined in the Corporation Court of the City of Austin, Texas, in cause No. 2505, State of Texas vs S E Crow, has sustained injuries to his eye which will result in the loss of sight, if he should be further confined in the City Jail . Now ,therefore, Resolved by the City Council of the City of Austin,Texas: That the fine and costs, amounting to $ 10.00, imposed against the said S E Crow,in the above entitled and numbered cause,be and the same is hereby remitted ,and the said S E Crowbe released from custody. The resolution was adopted by the following vote : Yeas Councilmen Anthony, Bartholomew, Haynes & Powell 4 Nays none. . The chairman laid before the Council the following resolution : Resolution authorizing payment of the Patterson claim . Patterson Claim Whereas, heretofore Geo W Patterson has filed his claim with the City Council paid of Austin, asking damages for the alleged negligence of the City of Austin in leaving opened and unlighted certain excavations in the street off North Congre -ress Avenue on or about the 28th day of April ,1913, on account of the injury to a certain transfer wagon and the death of one horse caused by reason of falling into said open and unlighted ditch; and Whereas the said Geo W Patterson has agreed to accept in full settlement of said claim the sum of one hundred($100.00) dollars ,now therefore, Be it resolved by the City Council of the City of Austin: That the sum of one hundred ($100.00) dollars be and the same is hereby appropriated out of any monies in the general contingent fund of the City of Austin ,not otherwise appropriated, for payment of one hundred ($100.00) dollars to Geo W Patterson in full settlement of said claim, and that a warrant be issued ,payable to the order of said Geo W Patterson and the the same be delivered to said Patterson upon his executing a receipt and relea of the City of Austin showing full payment and satisfaction of all and any claim by reason of said alleged negligence. Re: Scarbrough & Sons To block sidewalk The Chair laid before the Council the following resolution : Resolved by the City Council of the City of Austin, Texas : That a permit be and is hereby granted the Firm of Scarbrough & Sons to block the sidewalk in front of their store on Congress Avenue in this City during the period of time required to erect a new front to said building; and Be it further resolved by the City Council of the City of Austin : That this permit is temporary and revocable at any time in the pleasure of the City Council . The resolution was adopted by the following vote : Yeas Councilmen Anthony, Bartholomew, Haynes & Powell 4 Nays none. Approved, E C Bartholomew, Mayor Pro tem The Chair laid before the Council the following resolution : Resolved by the City Council of the City of Austin, Texas : That permission be and is hereby granted the firm of E M Scarbrough & Sons to place area-ways in the rear of their store building on Congress Avenue in this City ,said area-ways to extend not farther than three feet into the alley and to be protected by iron or steel grill levelor not higher than two inches above alley ; to be substantially faced ,sufficient to hold the earth in proper place; and Be it further resolved : That the City of Austin shall not be held responsible for ant damage ,caused by or from these area-ways. The resolution was adopted by the following vote : Yeas Councilmen Anthony, Bartholomew, Haynes & Powell 4 Nays none, Approved, E E Bartholomew, Mayor Pro tem . The Council then adjourned. Frao. J.
