326 .Austin, Texas, Sept 16th 1915. .Regular meeting of the City Council. The Council was called to order by the Mayor: Roll called: Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Absent none. The minutes of the last regular and subsequent recessed meetings were read and adopted: Councilman Haynes presented the report of the Sanitary Inspector for the month of August 1915, which was read and ordered filed: Councilman Anthony offered the following resolution: Resolved by the City Council of the City of Austin, Texas: That the sum of $ 265.54, the unexpended balance of purchase of Auto Truck for the fire department in the budget of the City of Austin, Texas, for the year 1915 1915, be and the same is hereby transferred to Miscellaneous appropriation for To transfer funds Fire & Police Dept the Police department in said budget. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none, Approved, A P Wooldridge, Mayor. By Councilman Powell Resolution approving City Engineers reportconcerning improvements on the alley between Congress Avenue and Brazos street ,from the north property line of seventh street to the south property line of eighth street, in the City of Austin, and directing a hearing to property owners con-cerning the assessment for the cost of such improvements against them and Notice hearing Paving alley - Cong & Brazos - 7th to 8th Sts their property, fixing a time for said hearingand directing that a notice be given to said property owners concerning the said hearing: Whereas, the City Council. MEXXXXXX of the City of Austin has hereto-fore determined to improve the alley between Congress Avenue and Brazos street, ,from the north property line of seventh street to the south property line of eighth street ,by paving the same with concrete pavement and necessary excava-tion ,and has adopted specifications for said work, and has entered into a con- -tract for the same with Wallace R Miller, an individual; and Whereas , the City Engineer of the City of Austin has this day filed his report in writing with the City Council, showing the total cost of the said improvements upon the said alley, the amount per front foot of abutting propery to be paid by the therefrom thereof and also the names of persons ,estates or cor-porations owning property and a statement of the total amount payable by each of said owners for said improvements; and Whereas, the City Council has examined the said reportand finds the same correct; and Whereas, the necessity exists that the cost of said improvements should be assessed against said property owners and their property, subject to the terms of the Charter of the City and the ordinance in such cases made and provided, and after the notice and hearing provided by said Charter and ordinance, Now Therefore; Be it resolved by the City Council of the City of Austin : 1. That said report of the City Engineerbe and the same is hereby appro-ved and adopted. 2. That the entire cost of making the said improvementsshall be

.assessed against said owners of property abutting on the alley between Congress Avenue and Brazos street,from the north property line of seventh street to the south property line of eighth street ,in the City of Austin, and against the said property;that the said assessment shall be made at the rate of $ 1.70 per Front Foot in accordance with the " Front Foot " rule or plan ,in proportion to the frontage in that block to be improved provided that if said rule of apportionment shall appear to the Council to be unjustor unequal ,in any particular case ,or to result in an assessment in excess of the benefits received through said improvement by any owner or his property,the City Council shall adopt such rule of apportionment as shall effect substantial equality and justice between said property owners ,considering benefits received by and burdens imposed upon said owners ,and that in no event shall any assessment be made in excess of the actual benefits received by the owners of said property through the enhanced value thereof by means of said improvement. 3.That a hearing shall be given before the Council to said property owners on Thursday Sept 30, A D 1915 at 10 O'clock A M ,in the Mayors Office in the City Hall in the City of Austin ,Texas, at which hearing said property owners their agents or attorneys shall be fully and fairly heard as to all matters concerning the said improvementor as to any irregularity or invalidity in the proceedings with reference thereto,or as to the benefits thereof if any, to their property,and as to the assessment proposed to be made against them and their property,and as to any other matter or thing connected therewith, at which hearing the said owners shall have the right to. produce witnesses and testimony, and which hearing shall be adjourned from time to time and from day to day until all are heard, and all matters in connection with the said improvement and assessment be fully ascertained; that after the said hearing shall be closed ,said City Council will proceed to assess against owners of property upon the said assessments ,such sums as may be so agreed upon and determined as provided by the Charter of the City and the said ordinance; that as to any such property owners who may not so agree ,the City Council will, after said hearing, appoint a commission to determine said assessments ,and will take such further steps in ascertainment thereof as are provided by the Charter and ordinance. 4. That the Superintendent of Streets and Public Improvements of the City of Austin is hereby directed to give notice thereof to the said property owners ,their agents and attorneys ,by publication of a copy of this resolution in the Austin Statesman and Tribune a daily paper of general circulation in the City of Austin,the first publication to be not less than five days prior to the date of said hearing. 5. That this resolution shall take effect from and after its passage. Councilman Anthony offered the following resolution : Resolved by the City Council of the City of Austin, Texas: That the sum of twenty dollars be and the same is hereby appropriated out of the general contingent fund of the City of Austin,Texas, for the year 1915,to pay the balance owing to Ed Roaengren for the burial of Thos Quinn, a professional firemanwho lost his life trying to rescue others in the great flood of April 22nd 1915. 358 Silvenburg garage ....The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin,Texas : That a permit be and is hereby granted to S Greenberg to install and maintain a Garage of the dimensions of about 18 X 22 feet at the rear of 709 Congress Avenue .This garage is to be entirely of steel and iron ,save and except the part of the frame-work in which the doors of the garage on the east sideslide. EmScarbrough Cornice The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin, Texas : That the petition of E M Scarbrough to install and maintain an extended cornice in front of a certain part of his store building ,to-wit: in front of lots 4 & 5and the north 16 feet of lot 3 in block 55 of the City of Austin ,Texas, be and the same is hereby granted ;said cornice is to be approximately 4 ½ feet in front of the building and over the sidewalk; said cornice is to be so constru-cted as to conveniently carry off the waterfrom the building to the gutter in front of said building. Merchants Lights To install lights The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin : That permission be and is hereby granted to certain merchants who desire so to do to install five lines of colored lights ,to be strung at various inter-vals on East sixth street in this City between Congress Avenue and East Avenu said lights are to be installed under the supervision of the Assistant Supt of the Water, light and Power department of XMMXXXXXX the City of Austin ,Texas and used for the Jubilee occasion of Monday September 20th 1915. 319 September 18th 1915. The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin,Texas : W T Wroe & Sons Tank. That a permit be and is hereby granted to W T Wroe & Sons to install and maintain a five barrel Bowser Red Sentry gasoline tank ,to be approved by the Supt of Police & Public Safety ,under the sidewalk at 417 _419Congress Avenue Austin, Texas. Resolved further: That in connection with this gasoline tank hereby authorized to be installed,the said W T Wroe & Sonsare likewise authorized to install and maintain a gasoline pump to be located at the curb linein front of 417_419 Congress Avenue ,at a position to be designated by the Supt of Streets and Public Improvements;said gasoline pump to be of the most modern and approved fashion ,character, construction and design,and subject to the approval of Supt of Police and Public Safety, Resolved further: That W T Wroe & Sons shall install and maintain at the top and upon the gasoline pump hereby authorized ,an electric light of not less than 40 watt power and placed in a globe of not less than ten inches diameter,which electric light shall be kept illuminated notless than three hours daily ,between the hours of six and twelve O'clock P M. Resolved further : That the hose through which air,gasoline or any other oil or volatile substance is conveyed by pumping or otherwise from the store house 417_419 Congress Avenue ,or from the tank authorized to be placed in front of same ,must be kept when not in actual useneatly coiled and stored ,either in the receptacle in the sidewalk provided for such hoseor in the receptacle in the pump authorized to be installed and provided for the storing of said hose. Resolved further : That the work under this resolution authorized to be installed and maintainedmust be installed and maintained ,where not otherwise assigned ,under the immediate supervision of the City Engineer of the City of Austin, Texas, who is hereby authorized to prescribe necessary specifications for the work herein authorized to be done. Resolved further and finally : That this permit is granted and must be accepted as revocable at any time in the pleasure of the City Council . Merritt Otting The Mayor laid before the Council the follo ing resolution : Whereas, in consideration of the attached affidavit of A Otting,showing that his merchan-dise on handon the 1st day of January ,1914, was assessed in error for the year 1914, in the sum of $ 2,500. when the true amount should have been $ 1,700.00 .

.Now, therefore, Resolved by the City Council of the City of Austin, Texas : That the assessment of merchandise against the said A Otting for the year 1914, be and the same is hereby reduced from $ 2,500. to $ 1,700. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin,Texas : Grades Rio Grande St That the following grades be, and the same are hereby established for the center line of Rio Grande street from the center line of West 12th street to south property line of West 13th street : Center of 12th street 524.20 Cut 2 feet, 9 inches South line of alley north of 12th street 521.00 out 8 inches 50 feet north of south line of alley north of 12th street 520.44 unchanged South line of 13th street 519.90 " .. Be it further resolved : That the action taken by this body on August 26th 1915,establishing grades on Rio Grande street ,be and the same is hereby repealed,insofar as the grades on this block are involved.
