Austin Forfeits Rail, Plans Paving, Adds Fuel

358 Regular meeting of the City Council : Austin, Texas, November 04, 1915. THos. Wooldridge, of Councilmen Anthony, Bartholomew, Haynes & Powell The Council was called to order by the Mayor : Roll called : Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Absent none: The minutes of the last regular and subsequent recessed meetings were read and adopted : The Mayor laid before the Council the following petition: Austin, Texas 11/1/15. To the Mayor and City Commissioners, Austin, Texas. Gentlemen : We hereby make application for the privilege of installing a Caedwell & Miller gasoline tank & pump on our sidewalk in front of our place of business at Gas Pump 1700 South Congress Avenue. Very Respectfully, Caldwell & Miller. On motion the petition was granted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. The Mayor laid before the Council ,applications for license for Drivers of Service Cars ,from the following named persons, viz : Driving Licenses M N Johnson, No street adress, G L Cunningham, 404 East 8th street, J L Eppler, 2205 East 2nd street. Licenses were granted to each by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. The Mayor laid before the Council an ordinance granting to Messrs Gullett & Gas Franchise Robinson a Franchise to furnish the City with Natural Gas, which was read Gullett & Robinson the first time and referred to the City Attorney. Mayor Wooldridge offered the following resolution : Mayor Wooldridge offered the following resolution : Whereas, it appears, from the accompanying statement of M C Welborn, City Engineer, that the sum of $ 5,513.86, of the Permanent Street Improvement fund of this City was during the spring of 1914,used to pave in front of th Paving Guadalupe University grounds facing Guadalupe street in this City between 21st and 24th Street University streets ; and Part of explained Whereas, said paving, while of great public benefit and convenience to Fund paid in. the City at large,was especially so to the State University,an institution in which the City takes great pride and interest,and by reason of that and other facts,said advance of $ 5,513.86,was a wise investment on the part of the City of Austin of a portion of its Permanent Street Paving fund ; and Whereas, the Permanent Street Improvement fund of this City is in urgent need of the reimbursement to itself of this said sum of $ 5,513.86, for the construction of permanent street paving elsewhere in the City of Austin, Texas ; and, again, --- Page break --- 359 Paving on 11th Colorado streets fund to be held for that purpose .Whereas, the City of Austin out of its general contingent fund has at various times during the last four years made special advances to the street fund account of the City of Austin, Texas, in the total sum at this date of $ 9,244.49; and Whereas, $ 4,000.00, of this $ 9,244.49, was advanced to the general street fund during the summer just gone by for use, more or less,in the way of permanent street construction ,with the understanding that said sum of $ 4,000.00,should be refunded to the general contingent fund when the City should come into the possession of monies from the sale of its street and bridge bonds ; and Whereas, there is still urgent need for money to do permanent street work,and especially to pay the City 's part.of the cost of paving 11th street from Lavacca to Brazos street, Colorado street from 10th to 11th streets,and Brazos street from the alley north of 10th street to 11th street; Now, therefore, Resolved by the City Council of the City of Austin, Texas: First, that for good cause unto the City Council moving ,especially as herein before set out ,the obligation, if such exist,legal, moral or financial ,on the part of any department of the City government to the permanent street paving fund of this City by reason of paving to the west of the State University on Guadelupe street between 21st and 24th streets ,as herein before set out ,the cost of which was $ 5,513.86, be and the same is hereby declared cancelled ,obliterated and annulled; and second,that the excess owing by said street depart -mentto the general contingent fund of this City, and amounting to $ 3,730.63,as a just measure of public policy,is hereby remitted to the street department of this City,but it is hereby expressly stipulated ,understood, agreed and resolved that the $ 4,000.00 ,of the general fund of the City advanced to the street department in the summer of 1915,be and the same is to be considered ,held and resolved to be kept in tact in the Permanent Street Improvement fund solely for the expense of the City's part of the cost of paving 11th street from Lavacca to San Jacinto streets, and Colorado street from 10th to 11th streets,and that part of Brazos street which lies between the alley north of 10th and 11th streets ,which expense is about the cost of defraying the City's cost of the expense of paving said 11th street from Lavacca to San Jacinto streets,Colorado street from 10th to 11th streets and Brazos from the alley north of 10th street to 11th street,as hereiabove set out. The Mayor laid before the Council the following resolution : To be paid out of Contingent fund of $310 Resolved by the City Council of the City of Austin, Texas : That the sum of $ 310.00, be and the same is hereby, appropriated out of the General Contingent fund of the City of Austin, Texas, to pay the bill of E W Long, for painting the South Austin Fire Hall. This bill is approved by the Supervising Architect, W E Ketchum, which approval is attached hereto. Approved, A P Wooldridge, Mayor. --- Page break --- 800 Curb lines & street width fixed Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin,Texas: That the width between curbs from East 1st street from the East line of East Avenue to the West line of Chicon street be, and the same is hereby, established thirty six ( 36') feet The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Mayor Wooldridge offered the following resolution : Resolved by the City Council of the City of Austin, Texas : That the supplemental and amendatory budget of the Mayor of this City to the original budget of this City for the year 1915,as presented this day and covering ,in the first instance ,a credit to the Permanent Street Improvement fund of $ 418,332.17,arising from the sale of $ 425,000.00, of street and bridge bonds ,and then a charge against said proceeds in the amount of $ 18,067.00, in favor of the general street fund to reimburse expenditures heretofore made out of the general street fund for permanent street improvement purposes,be and the same is approved and the receipts and appropriations therein recommended allowed . XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX1915XXX November 9th 1915: The Council was called to order by the Mayor : Roll called : Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell Absent none: The following call of the Council was read: Austin,Texas, November 9,1915: Hons W B Anthony, E C Bartholomew, H L Haynes and P W Powell: Councilmen of the City of Austin, Texas: Gentlemen : Franchise Grant Power amended Call Council Please take notice that a special meeting of the City Council is hereby called to meet in my office at ten o'clock A M tomorrow,November 9th for the purpose of considering and enacting an ordinance declaring forfeited the franchise heretofore granted E L Brown, W.B.Dunlap,J H Abbott,Jno W Maxcy,Walter J Crawford and their Associates to build, construct,operate and maintain a single and double line interurban railroad track over certain streets and public places of the City of Austin, Texas,and which ordinance was enacted on the 31st day of October ,1912, and made effective by a vote of the people on the 27th of November ,1912, and of forfeiting the deposite of $ 5,000.00 made with this Cityfor the purpose of carrying the ordinance granting said franchise into effect. Respectfully, A P Wooldridge, Mayor. --- Page break --- The Mayor laid before the Council An ordinance declaring the forfeiture of the certain Franchise Interurban Forfeited franchise granted to E W Brown, W R Dunlap, J M Abbott, Jno W Maxoy, Walter J Crawford, their successors heirs and Assigns, to build and construct railroad tracks over certain streets of the City of Austinfor the purpose of operating interurban cars ,and declaring the for-feiture of five thousand dollars deposited by said granteeswith the City of Austin as liquidated damages for failure to comply with the terms of said framchise. The ordinance was read the first time, and a motion made to suspend the rule and place it on its second reading, which motion prevailed by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none: The ordinance was read the second time and a motion made to suspend the rule and place it on its third reading and final passage, which motion prevailed by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none: The ordinance was then read the third time and passed by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew ,Haynes & Powell 5 Nays none: .Councilman Bartholomew offered the following resolution : Resolved by the City Council of the City of Austin, Texas: That the sum of $ 531.98, be allowed and appropriated out of the Earnings fundof the L. T. Belmont Damages. Water ,Light and Power Department of the City of Austin, Texas, to pay the Judgement and costs in cause No 32155, L T Belmont vs the City of Austin ,the same to be pai d upon execution of release of Judgement by L T Belmont .Five hundred dollars ($500.00, of this amount is in settlement of the Judgement of L T Belmont and a warrant for that amount is to be drawn in his favor, and thirty one dollars and eighty cents ($ 31.80)is for costs of court in this cause, for which a seperate warrant shall be drawn in favor of D J Pickle, Distriot Clerk of Travis County, Texas. Councilman Powell offered the following resolution : Resolved by the City Council of the City of Austin, Texas: That the sum of three hundred and fifty ($ 350.00 ) dollarsbe and the same is hereby G.W. Chancellor Damages appropriated out of the cost and damage fund in the budget of the Street department of the City of Austin, Texas, for the year 1915 in payment in full of the claim of G W Chancellor for injuries sustained at tenth street across Shoal creek in this City, the accident occr-ing in the month of January ,1915. The receipt in full for said claim is attached hereto as an exhibit and made a part of this resolution. Wooldridge, Mayor. --- Page break --- 362 Paving E. 1st Ordered Councilman Powell offered the following resolution : Resolved by the City Council of the City of Austin,Texas,as follows : First_That East first street from Congress Avenue to Chicon street in this City be and the same is hereby ordered and directed to be paved. Second_That the Supt of Streets and Public Improvements be and he is hereby instructed to advertise for the paving of said street and invite bids for said paving to be submitted to the City Council on or before Noon of November 26th 1915, Third_ That on November 26th ,1915, or as soon thereafter as may be practi -cable and convenient to the City Council ,it will determine the class of material with which East first street from Congress Avenue to Chicon street shall be paved and the price to be paid for said paving. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell . Nays none, Approved, A P Wooldridge, Mayor. Red River St Ordered pmt Councilman Powell offered t e following resolution : Resolved by the City Council of the City of Austin,Texas, as follows: First_ That Red River street from 6th to 16th street in this City be and the same is hereby ordered to be pavedwith permanent paving. Second_That the Supt of Streets and Public Improvements be and he is hereby instructed to invite bids for the paving of said Red Reiver street from 6th to 16th streets ;bids for said paving to be submitted on or before noon of November 26th ,1915. Third_That on November 26th ,1915, or as soon thereafter as may be conve -nient ,the City Council shall determine the class of permanent paving to be put down on Red River street from 6th to 16th street and the price to be paid for same . The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell . Nays none, Approved, A P Wooldridge, Mayor. Appropriation Shoal Creek Bridge repairs Councilman Powell offered the following resolution : Resolved by the City Council of the City of Austin,Texas : That the sum of two thousand five hundred ( $ 2,500.00,) dollars ,or so much thereof as may be necessary,be and the same is hereby appropriated out of the Permanent Street Improvement fund of this City to repair the stone Arch bridges across Shoal creek in this City between 8th,9th, 10th,11th, 12th,13th,14th and 15th streets; the work under this appropriation to be done by the Suptof Streets and Public Improvements by contract or day labor ,as he may see fit to order and direct. Resolved further by the City Council of the City of Austin,Texas : That the Supt of Streets and Public Improvements be and he is hereby instructed to direct the Supt of Parks and Public Property to remove any water mains that may obstruct the flow of water along Little Shoal Creek under or near the bridges hereinabove directed to be built ,rebuilt or repaired,and the that he is further directed to remove any intercepting sewer mains --- Page break --- 203 .Across said Little Shoal Creek interfering with the bridge herein ordered to be built, rebuilt or repaired,and he is likewise instructedto notify the Austin Gas Co.to remove all intercepting or obstructing pipes across Little Shoal Creek in any way interfering with the passage of water under or near the bridgehereby directed to be rebuilt or repaired.
