285 - Regular meeting of the City Council; Austin, Texas, April 20, 1916: - The Council was called to order by the Mayor: Roll called: - Present Mayor Wooldridge, Councilmen Anthony, Barthelemew, Haynes & Powell - Absent none: - The minutes of the last regular and subsequent recessed meetings were read and Adopted: - The following application sfer License to operate Jitneys,were presented & read, - and licenses granted by the following vote : - Yeas Mayor Wooldridge, Councilmen Anthony, Barthelemew, Haynes & Powell 5 - Nays none: Jitney application Service Car License - W B Calloway , G M Wagner, Roy Hough, W B Hart, Jne Wallace. - Application of A R Day , for license as Driver Service car was presented and license - granted by the following vote : - Yeas Mayor Wooldridge, Councilmen Anthony, Barthelemew, Haynes & Powell 5 - Nays none: - The Mayor laid before the Council a resolution ordering the improvement of a part of - West 19th street, from West line of Rio Grande street, South from 19th street, to the West line - of Rio Grande street, north from 19th street, which resolution was presented and read - on the 13th day of April and laid over. The resolution was read the second time and - passed by the following vote : - Yeas Mayor Wooldridge, Councilmen Anthony, Barthelemew, Haynes & Powell 5 - Nays none. Paving 19th Rio Grande - Councilman Powell offered the following resolution : - Whereas, A A Mundt , to whom was awarded the contract for the construction of a - reinforced concrete bridge across Shoal creek on State street, in this City, has completed - the entire work covered by his contract, excepting the slope protection walls and paving; - and - Whereas,it seems best to leave off this slope protecting paving for the present;and - Whereas, the contractor is willing to deduct the sum of five hundred ($500.00) dollars - from his contract price and to turn over to the City the reinforced steel intended for - use in this part of the work,amounting in value to approximately one hundred ($100.00) - dollars ; - Now Therefore_ - Be it resolved by the City Council of the City of Austin, Texas: - That the bridge across Shoal creek on State street, in this City, be,and the same - is hereby accepted, from the contractor in its present condition, that the contract price - be reduced by the amount of. five hundred ($ 500.00) dollars ,and that the City take - possession the reinforced steel intended for this work. - The resolution was adopted by the following vote : - Yeas Mayor Wooldridge, Councilmen Anthony, Barthelemew, Haynes & Powell 5 - Nays none. Bridge Shoal Creek on State Street A A Mundt - Councilman Powell offered the following resolution : - A resolution finally accepting pavement and improvement of Colorado street,from the - [illegible] line of 9th street to the South property - line of 11th street. - Whereas, the Supt of Streets and Public Improve, ents has filed his report with the City - Council to the effect that the Texas Bitulithic Company has completed the work of paving - and improving of Colorado street ,from the North property line of 9th street to the South - curb line of 11th street, under contract with the City, and that said work has been fully - and that the said work has been fully done in strict accordance with said contract and the specific- ations adopted by the City, Paving Colo. Therefore , Be it resolved by the City Council of the City of Austin, Texas: That the said work of improvement be finally accepted by the City and that the final estimate due by the City to the said Company be paid. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Barthelemew, Haynes & Powell 5 Nays none Councilman Powell offered the following resolution : Resolved by the City Council of the City of Austin, Texas : Storm Sewer Little Shoal Creek Plans adopted 1st. That the plans and specifications for the construction of a storm Sewer up Little Shoal Creek on Nueces street in this City,from the alley between 7th & 8th streets to West 16th street,thence easterly on West 16th streetone block to San Antonio street ,thence Northerly on San Antonio street to 19th street,together with a branch sewer up Nueces street from 16th to 19th street, as presented to the City Council of the City of Austin, Texas,by the Supt of Streets and Public Improvements ,be and the same are hereby adopted and approd 2nd.That the Supt of Streets and Public Improvements be and he is hereby authorized and instructed to invite bids in accordance with said plans and specifications for the construction of said above described storm sewer,with its branch sewer ,as hereinabove set out,which bids must be filed with the City Clerk of the City of Austin, Texas, on or before 11 O'clock A M of Wednesday May 10th. 1916. 3rd. That all resolutions ,or parts of resolutions ,in conflict with the provisions of this resolution be and the same are hereby repealed. The resolution was read the first time and laid over. Councilman Powell offered the following resolution : Resolved by the City Council of the City of Austin, Texas : That the sum of $ 50,000.00) or so much thereof as may be necessary,be and the same is hereby appropriated as a special appropriation out of the Permanent Street Improvement fund of the City of Austin, Texas, for the year 1916,to pay for the construction of a storm Sewer up Little Shoal Creek from the alley between 7th & 8th streets to 16th street;thence East one block on 16th street to San Antonio street; thence North on San Antonio street to 19th street,and fo for the construction of a branch storm sewer to the main stor m sewer above described ,up Nueces street from 16th street to 19th street. The resolution was read the first time and laid over. Councilman Powell offered the following resolution : Resolution approving City Engineers report concerning improvements upon Rio Grande street ,in this City,from the North property line of 6th street to the North property line of 28th street ,and directing a hearing to property owners concerning the assessment for a part of the cost of such improvements against them and their property ,fixing a time for said hearing and directing that a notice be given to said property owners concerning the said hearing: appropriation Storm Sewer Little Shoal Creek ... --- Page break --- Whereas, the City Council of the City of Austin, Texas, has heretofore determined to improve Rio Grande street, from the north property line of 6th street to the north prop-erty line of 28th street, in the City of Austin, by paving the same with Bitulithic pavement upon gravel concrete foundation with concrete gutters along curb lines and necessary excavation, and has adopted specifications for said work, and has entered into a contract for the same with the Texas Bitulithic Company, a corporation; and Whereas, the City Engineer of the City of Austin has this day filed his report in writing with the City Council, showing the total cost of the said improvements upon the said street, the amount per front foot of abutting property to be paid by the owners thereof and also the names of the persons, estates or corporations owning property abut-ting on said improvements, with a description of their property and a statement of the total amount payable by each of said owners for said improvements; and Whereas, the City Council has examined the said report and finds the same correct; and Whereas, the necessity exists that a portion of the cost of the said improvements should be assessed against said property owners and their property, subject to the terms of the Charter of the City and the ordinance in such cases made and provided, and after the notice of hearing provided by said Charter and ordinance, Now, Therefore, Be it resolved by the City Council of the City of Austin, Texas : 1. That the said report of the City Engineer be, and the same is hereby, approved and adopted . 2. That a portion of the cost of making the said improvements shall be assessed against said owners of property abutting on Rio Grande street, in this City, from the north property line of 6th street to the north property line of 28th street, in the City of Austin, and against said property; that the said assessment shall be made at the rate of $3. 0334 per front foot of such property in accordance with the "front foot" rule or plan in proportion as the frontage of each owner in each block of said street is to the whole frontage in that block to be improved, provided that if said rule of apportion-ment shall appear to the City Council to be unjust or unequal in any particular case, or to result in an assessment in excess of the benefits received through said improve-ments by any owner or his property, the City Council shall adopt such rule of apportion- -ment as shall effect substantial equality and justice between said property owners, considering benefits received by and burdens imposed upon said owners, and that in no case shall any assessment be made in excess of the actual benefits received by the owners of said property though the enhanced value thereof by means of said improvement. 3. That a hearing shall be given before the Council to said property owners on the 4th day of May A D 1916, at 10 O'clock A M, at the Mayors office in the City Hall, in the City of Austin, Texas.; at which hearing said property owners, their agents or attor-neys shall be fully and fairly heard as to all matters concerning the said improvements or any irregularity, error or invalidity in the proceedings with reference thereto, or as to the benefits thereof, if any, to their property, and as to the assessment proposed to be made against them and their property, and as to any other matter or thing connected there-with. At which hearing the owner shall have the right to produce witnesses and testimony, and which hearing shall be adjourned from time to time and from day to day until all are fully heard and all matters in connection with the said improvements and assessments fully ascertained; that after said hearing shall be closed, said City Council will proceed to assess against owners of property upon said street and their property, who shall agree with said Council upon the said assessments, such sums as may be so agreed upon and --- Page break --- 288 determined as provided by the Charter of the City and the said ordinance; and that as to any other property owners who may not so agree,the City Council will, after said hearing, appoint a commission to determine said assessments, and will take such further steps in ascertainment thereof as are provided by the Charter and ordinance. 4. That the Supt of Streets and Public Improvements of the City of Austin Texas, is hereby directed to give notice hereof to the said property owners, their agents and attorneys by publication of a copy of this resolution not less than twice in the Austin Statesman ,a daily paper of general circulation in the City of Austin , the first publication to be not less than five days prior to the date of hearing . 5. The Mayor laid before the Council ,An ordinance to amend an ordinance entitled " An ordinance to define the term Jitney; to license and regulate the operation of Jitneys. KNAXMXIXANMNXX on the streets and public places of the City of Austin ; and prescribing penalties for the violation thereof". Paving Guadalupe Councilman Powell offered the following resolution : Resolution approving City Engineers reportconcerning improvements upon Guadalupe street,in this City, from the north property line of 24th streetto the north property line of 27th street,east, and directing a he ring to property owners concerning the assessment for a part of the cost of such improvements against them and their property,fixing a time for said hearing and directing tha t a notice be given to said property owners concerning the said hearing : Whereas, the City Council of the City of Austin, Texas, has heretofore determined to improve Guadalupe street,from the north property line of 24th street to the north property line of 27th street,East, in the City of Austin, Texas, by paving the same with Bitulithic pavement upon gravel concrete foundation with concrete gutters along curb lines and necessary excavation,and has adopted specifications for said work and has entered into a contract for the same with the Texas Bitulithic Company, a Corporation; and Whereas, the City Engineer ,of the City of Austin, Texas, has this day filed his report in writing with the City Council, showing the total cost of the said improvements upon the said street,the amount per front foot of abutting property to be paid by the owners thereof and also the names of persons,estates or Corporations owning property abutting on said improvements ,with a description of their propertyand a statement of the total amount payable by each of said owners for said improvements; and Whereas, the City Council has examined the said report and finds the same correct ; and Whereas, the necessity exists that a portion of the cost of said improvements should be assessed against said property owners and their property,sub- ject to the terms of the Charter of the City and ordinance; Now, Therefore, Be it resolved by the City Council of the City of Austin, Texas: 1. All present except Haynes Councilman Powell offered the following resolution : Resolved by the City Council of the City of Austin, Texas : That the plans and specifications this day submitted by P W Powell , Sup of Streets and Public Improvements ,for a concrete arch bridge across Blunn creek( on the south side)in the City of Austin, Texas, be and the same are here -by adopted and approved by this Council, and Be it further resolved by the City Council of the City of Austin : That the said Supt of Streets and Public Improvements be and he is hereby authorized to invite bids for the construction of said concrete arch bridge in accordance wit said plans and specifications,whic bids are to be filed with the City Clerk on or before 11 o'clock A M ,of Thurs ay May 4th 1910.
