Resolved further : That Dewey Puryear shall install and maintain at the top and upon the gasoline pump hereby authorized an electric light of not less than forty (40) watt power and placed in a globe of not less than ten (10") inches in diameter,which electric light must be kept illuminated not less than three hours daily,between the hours of six and twelve O'clock P M,during the existence of this permit. Councilman Powell offered the following resolution: Resolution approving City Engineer report concerning improvements upon 11th street in this City, From the east property line of Brazos street (North) to the east property line of San Jacinto street, and directing a hearing to property owners concerning the assessment for a part of the cost of such improvements against them and their property, fixing a time for said hearing and directing that a notice be given to said property owners concerning the said hearing:

Whereas, the City Council of the City of Austin, Texas, has heretofore determined to improve 11th street from the east property line of Brazos street (North) to the east prop-erty line of San Jacinto street, in the City of Austin, Texas, by paving the same with Bitulithic pavement upon gravel concrete foundation with concrete gutters along curb lines and necessary excavation, and has adopted specifications for said work and has entered into a contract for the same with the Texas Bitulithic Company, a Corporation; and Whereas, the City Engineer of the City of Austin, Texas, has this day filed his report in writing with the City Council, showing the total cost of the said improvements upon the said street, the amount per front foot of abutting property to be paid by the owners therefrom, and also the names of persons, estates or Corporations owning property abut-ting on said improvements, with a description of their property and a statement of the total amount payable by each of said owners for said improvements; and Whereas, the City Council has examined the said report and finds the same correct; and Whereas the necessity exists that a portion of the cost of said improvements should be assessed against said property owners and their property, subject to the terms of the Charter of the City and the ordinance in such cases made and provided, and after the notice and hearing provided by said Charter and ordinance; Now, therefore, Be it resolved by the City Council of the City of Austin, Texas: 1. That the said report of the City Engineer be, and the same is hereby approved and adopted. 2. That a portion of the cost of making the said improvements shall be assessed against said owners of property abutting on 11 th street, in this City, from the east property line

586 of Brazos street ( North ) to the east property line of San Jacinto street, and against said property;that the said assessment shall be made at the rate of $ 3.6764 per front foot of such property in accordance with the " Frontxal xukax Foot " rule or plan in proportion as the frontage XX of each owner in each block of said street is to the whole frontage in that block to be improved,provided that if such rule of apportionment shall appear to the City Council to be unjust or unequal in any particular case ,or to result in an assessment in excess of the benefits received through said improvements by any owner or his property,the City Council shall adopt such rule of apportionment as shall effect substantial equality and justice between said property owners, considering benefits received by and burdens imposed upon said owners,and that in no case shall any assessment be made in excess of the actual benefits received by the owners of said property through the enhanced value thereof by means of said improvement. 3. That a hearing shall be given before the Council to said property owners on the 31st day of August ,A D 1916, at the Mayors office in the City Hall ,in the City of Austin, Texas; at which hearing said property owners,their agents or attorneys shall be fully and fairly heard as to all matters concern-ing the said improvements or any irregularity or invalidity in the proceed- -ings with reference thereto,or as to the benefits thereof, and as to any other matter or thing connected therewith.At which hearing the said owners shall have the right to produce witnessesand testimony,and which hearing shall be adjournd from time to time and from day to day until all are fully heard and all mattes in connection with the said improvements and assessment fully ascertained; that after the said hearing shall be closed,said City Council will proceed to assessagainst owners of property upon said street and their property,who shall agree with said Council upon the said assessments,such sums as may be so agreed upon and determined as provided by the Charter of the City and the said ordinance; and that as to any such property owner who may not so agree,the City Council will, after said hearing, appoint a Commission to determine said assess-ments ,and will take such further steps in ascertainment thereof as are provi -ed by the Charter and ordinance. 4. That the Supt of Streets and Public Improvements of the City of Austin, Texas, is hereby directed to give notice hereof to the said property owners, their agents and attorneys by publication of a copy of this resolution notless than twice in the Austin Statesman ,a daily paper of general circulation in the City of Austin ,the first publication to be not less than five days MXIÐ prios.to the date of hearing. 5. Mayor Wooldridge offered the following resolution : Whereas, on the 21st day of August A D 1916, a petition was filed by the Dixie Oil & Refining Company for authority, permission and license to erect and maintain ,within the Corporate limits of the City of Austin ,one or more tanks for the reception and storage of Oil and oil products, gasoline and gasoline products, said building and erections to be placed on what is known as part of Lot No 1, in Block No 6, Raymond's subdivision of Outlot No 11 of Division "Z", being more particularly described as follows: Beginning at the North Eaxxcorner of said block No 6, thence southerly on the east line of Bowie street 50 feet to a point for place of beginning; thence easterly and at right angles with said street 60 feet to a point; thence southerly 60 feet from and parallel to said street line xx 60 feet to a point; thence westerly 60 feet to said street line; thence northerly along said street 60 feet to place of beginning; and Whereas, the Mayor and City Council of the City of Austin have personally inspected the site on which the applicant Dixie Oil and Refining Company is to construct and maintain said .tank or tanks as indicated; and Whereas, the City Council is in all things satisfied with the site indicated herein and upon a vote duly taken in all things approves the site so selected and the character of storage tanks to be used: Be it therefore resolved by the City Council of the City of Austin, acting herein by and through its Mayor and constitute' Councilmen: That the Dixie Oil and Refining Company be and it is hereby granted permission to build and maintained on the property above described one or more storage tanks for the reception and storage of oil and oil products, gasoline and gasoline products, to be built on a rock ,brick or concrete foundation, with all appurtenances or appliances requisite or incidental to the right herein conferred. The said Dixie Oil and Refining Company is hereby authorized and empowered to store or warehouse in said tank or tanks oil and oil products ,gasoline and gasoline products in excess of two hundred and fifty ( 250) gallons, standard measure. Lawrence Hanley Reckless Driving
The Mayor laid before the Council the following resolution: Whereas, in the judgement of the City Council ,Lawrence Hanley , the then driver of North Austin Hose Company No 5,was guilty of reckless driving in driving the car of said North Austin Hose Co No 5 to a reported fire at 1505 Colorado street on the night of Friday August 18th 1916, in that by reason of said reckless driving the greatly injured the car he was driving and destroyed the store building situated at the corner of 19th and

Guadalupe streets in this City, and more or less injured all of the persons upon said car which the said Lawrence Hanley was driving.
Now, therefore, Be it resolved by the City Council of the City of Austin, Texas : That in punishment for said reckless driving which in the judgement of the City Council constitutes a breach of the necessary discipline to be enforced in said Austin Fire Department, the said Lawrence Hanley is hereby suspended from occupation and pay from the 20th day of August 1916, to the 1st day of January 1917, and Be it further resolved by the City Council of the City of Austin, Texas: That James Quinlan and John Luckey be and they are hereby summonsed to appear before the City Council at its meeting to be held on Thursday, the 24th day of August, 2916, to receive a public reprimand for failure to remonstrate with the said Lawrence Hanley for the reckless gate at which he was driving said North Austin Hose Co No 5 car.
