613 Regular meeting of the City Council : Austin,Texas, Sept 21st 1916: The Council was called to order by the Mayor: Roll called: Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Absent none: The minutes of the last regular and subsequent recessed meetings were read and Adop ted: The Mayor laid before the Council the report of the Inspector of W ights & Measures for the month of August 1916, which was read and ordered filed : The Mayor laid before the Council a resolution ordering the improvement of a certain part of Congress Avenue in the City of Austin ,and approving specifications, proposal, contract and bond therefor, which was introduced and read the 1st time on Sept 14th 1916, and laid o vers for one week. The resolution was passed by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none: Approved, A P Wooldridge, Mayor: The Mayor laid before the Council application of W L Hamilton for license to drive service Car which was granted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none: Mayor Wooldridge offered the following resolution : Whereas, there will be a very large body of U S Soldiers in Austin on saturday Sept 23rd 1916, some fifteen thousand men, besides army vehicles and several batteries of artillery and about five thousand horses,which body of troops ,with its attachments,will pass up Congress Avenue, Now, therefore, Resolved by the City Council of the City of Austin, Texas : That the management of the street car company in this City be requested to avoid crossing Congress Avenue with its cars at any street between 1st street and 24th streetin this City ,between the hours of 8:00 A M and 12:00 M of saturday Sept 23rd 1916. Sewer – $100.00 approp for plans --- Page break --- 614 Sewer - Alley betw 6th & 7th Sts. out of the sanitary sewer fund to pay for the construction of a six (6) inch sewer line in the alley between 6th & 7th streets ,west from Blanco stre t, a distance of three hundred (300) feet in order to furnish sewerage service for the Ledbetter property. The resolution was adopte by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none, Approved, A P Wooldridge, Mayor: Sewer - 3rd St. Councilman Fewell offered the following resolution : Be it resol ved by the City Council of the City of Austin,Texas: That the sum of two hundred ($ 200.00) dollars, be and the same is hereby appropriated out of the Sanitary Sewer fund to pay for the construction of an eight (8") inch sewer line two hundred and seventy five (275') feet long on 3rd street ,east from Nueces to furnish sewerage service XM to the Walker Cilli Factory. Sewer - Olive St. Councilman Fewell offered the following resolution : Be it resolved by the City Council of the City of Austin, Texas: That the sum of two hundred ($ 200.00) dollars, be and the same is hereby appropriated out of the Sanitary Sewer fund to pay for the construction of a six (6) inch sewer line on Olive street east from Branch street a distance of three hundred and fifty (350) feet ,to furnish sewerage service for the Olive street negro school. Sewer - Swisher St. Councilman Fewell offered the following resolution : Be it resolved by the City Council of the City of Austin, Texas : That the sum of one hundred (100)dollars, be and the same is hereby appro-priated out of the sanitary sewer fund for the construction of a six (6") inch sewer line on Swisher street south from 22nd street to the Rescue Fire Station a distance of two hundred (200') feet . Councilman Powell offered the following resolution: Be it resolved by the City Council of the City of Austin, Texas: That the sum of one hundred and twenty five ($ 125.00) dollars, be and the same is Sewer - E. 11th St. hereby appropriated out of the Sanitary sewer fund to pay for the construction of a six inch (6") sewer line on East 11th street ,east a distance of two hundred and fifty (250') feet in order to furnish sewerage service to the Gregory Town Negro School. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none, Approved, A P Wooldridge, Mayor: Councilman Powell offered the following resolution: Be it resolved by the City Council of the City of Austin, Texas: That permission be, and the same is hereby granted to Henry Maerki to construct and Henry Maerki - Permit to Construct Catch Basin. maintain a Catch Basin or sand trap in the alley east of Rei Grande street near the east line of said street, said catch basin to be located immediately against the south fence of the alley and to be covered with an adequate cast iron cover to be of such weight and dimensions as prescribed by the Inspector of Plumbing of this City,and, Be it further resolved: That this permit is granted with the understanding that said catch basin is to be at all times maintained and kept clean and in good working order as described in Section 14 in ordinances regulating the use of sanitary sewers and drains, and, Be it further and finally resolved: That permit is granted and must be accepted as revocable at any time at the pleasure of the City Council. Baker The Mayor laid before the Council a communication from R H Baker, asking the remission of interest and penalties on taxes, which was read and declined by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Po ell 5 Nays none. --- Page break --- 616 Service Cars- Permit Ordinance Penalty [illegible] to Camp Mabry. .By Mayor Wooldridge, An ordinance authoriz|ng automobile cars to be driven east and west on 24th or State street in this City and from Camp Mabry to the central part of this City on the days of Sept 22nd, 23rd, 24th, 25th and 26th 1916, fixing the charges to be allowed to be made against individuals who may use said cars ,and fixing a penalty for the violation of the provision thereof: The ordinance was read the first time and passed under suspension of the rules by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none: Councilman Haynes offered the following resolution : Whereas, it is deemed by the City Council, XXXXX desirable to collect the personal property taxes in arrears for the year 1914 and prior years, Now, therefore, Taxes in Arrears- Contract with J. W. Maxwell for collection. Be it resolved by the City Council of the City of Austin, Texas : That the contract which here follows and which is here recorded in full is is authorized to be entered into by and between the City of Austin and J W Maxwell,an attorney of this City . The State of Texas # County of Travis # Know all men by these presents: This contract and agreement entered into this day by and between the City Council of the City of Austin,party of the first part ,and J W Maxwell, an attorney of Austin, Texas, party of the second part,Witnesseth : The said City Council hereby employs the said J W Maxwellto collect, by suit or otherwise ,all delinquent taxes due on personal property ,and occupation ta taxes,that have been assessed ,or which may be hereafter assessed,and become due for the year 1914, and all previous years,and for the year 1915,when the delinquent owes for personal taxes for any previous year. In consideration of the premises the said City Council of the said City of Austin Hereby agrees to pay the said J W Maxwell twenty five (25%) cent of all such taxes ,penalties, interest and costs ,collected and paid in cash to the City Assessor & Collector for taxes for the year 1914 and all previous years and on and after October 1st 1916 ,for the year 1915 against such parties, partnerships or corporations, who owe taxes on personal property ,or occupa-tion to said City for the year 1914 or previous years. It is understood that the said Maxwellshall use his best efforts to collect all such taxes on personal property without suit; to furnish the City Tax Collector information as to any personal property that should be asse--ed --- Page break --- 617 .but for any cause left off the tax rolls for any year prior to 1916;and in case suit be necessary , to prepare all petitions,file such suits in the name of the City of Austin, and to prosecute such suits to a final termination ;provided that no new suits shall be filed without the approval of the Mayor or City Attorney;and to assume control of all suits now pending against delinquent taxpayers on personal property,where no real estate is is involved in such suit ,and to diligently prosecute the same . This contract shall remain in full force and effect for a period of one year from the date of this contract. Witness our hands in duplicate at Austin, Texas, on this the 28th day of September 1916. Mayor Wooldridge offered the following resolution : Whereas, there is to be a great military parade on the streets of Austin beginning Saturday, Sept 23rd 1916, from the hours of about 8 :A M to 12: M,which parade consists of about fifteen thousand United States troops,regular and volunteer,with their accompa-nying vehicles of all character and description, including many cannon and about five thousand horses; and Whereas, said military parade to reach its destination at Camp Mabry,northwest of this City,finds it most convenient for its own comfort to pass up Congress Avenue from the bridge across the Colorado river at the foot of Congress Avenue to 11th street as a part of its route; and Whereas, the spectacle of so large an army of men ,cannons,wagons,horses and other equipment affords to the people of Austin an unusual spectacle; and Whereas, said body of troops, with their accompanying vehicles,horses and other equipment are said to constitute the largest body of moving troops assembled upon any single occasion since the civil war, Now, therefore, Be it resolved by the City Council of the City of Austin,Texas: That, in view of the above,the east side of Congress Avenue from the bridge to 11th street be and the same is hereby ordered closed to vehicle and other traffic from the hours of 8: A M and 12; M, of Saturday Sept 23rd 1916;and Be it further resolved by the City Council of the City of Austin, Texas : That during said hours no vehicle of any character or description shall cross Congress Avenue from 1st to 11th streets, nor shall any vehicle of any description be permitted to stand on the east side of Congress Avenue from the street car tracks to the curbing during said hours, and the police of this City are hereby authorized and express-ly instructed to see that the provisions of this resolution are fully and thoroughly carried out. [illegible] 11- --- Page break --- 618 September 22nd 1916: Allpresent: Mayor Wooldridge off ered the following resolution : Whereas, there will be on tomorrow,Sept 23rd 1916, a large mass of United U.S. Army- States soldiersin parade on Congress Avenue in this City; and Regulation Whereas, there will be a large number of local citizens on foot and people Traffic for from out of town also on foot who will wish to witness said parade from places Parade. of fair and equal advantage ; and Whereas, in our Judgement a pedestrian has superior rightd and is entitled to greater privileges upon the streets of Austin upon occasions of this sort than persons driving in vehicles or persons on horseback. Now, therefore, Be it resolved by the City Council of the City of Austin, Texas: That no vehicle of any character or description ,nor any person on horses -back will be permitted to go upon ,stand or pass across Congress Avenue at any point from the bridge across the Colorado river at the foot of Congress Avenue to 11th street during the passing of said troops,and Be it further resolved by the City Council of the City of Austin : That the police force of the City of Austin is hereby instructed to rigorously enforce this order. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none, Approved, A P Wooldridge, Mayor : Sept 26th 1916: All present: Councilman Haynes offered the following resolution : Resolved by the City Council of the City of Austin, Texas: That A P Wooldridge, Mayor of the City of Austin, Texas,add his successTaxes in arrears- ors in office ,be and he and they are hereby authorized to execute and deliver Mayor within two years from November 19th 1915,quit claim deeds to any owner or any of Austin other persons having an interest in lands or lots heretofore sold to the City to give quit claim of Austin, Texas, under decree of court in any suit or suits brought for the collection of taxes thereon,or sold by the Collector of taxes of the City of Austin, Texas,; provided that such person having an interest in said land or lots in the City of Austin, Texas, shall pay the amount of taxes for which the sale was made,together with all costs,penalties and interestnow requiredbylaw and also shall pay all taxes, interest, penalties and costs on or against said lands or lots at the time of said redemption ; and providedthat the vendee in such quit claim deed or release shall pay for the proper acknowledgement. Johnson Tire Co. - Permit - Install tank. --- Page break --- 620 .conveyed, by pumping or otherwise, from the store house in front of the building at the north east intersection of 5th street with Colorado street or from the tank authorized to be placed in front of same must be kept, when not in actual use, neatly coiled, and stored in a receptical provided for such hose in the pump authorized to be installed or suspended from a suitable bracket attached to the pump. Resolved further: That the work under this resolution authorized to be installed and maintained must be installed and maintained ,where not otherwise assigned, under the imme-diate suprivision of the City Engineer of Austin, Texas, who is hereby authorized to prescribe necessay specifications for the work herein authorized to be done: Resolved further and finally: That this permit is granted only for the installation of a gasoline tank and pum pump and does not include the installation or construction of a storage box for hose underneath the sidewak and that this permit is granted and must be accepted as revocable at any time in the pleasure of the City Council. Approved, A F Wooldridge, Mayor, Attest, Jno G Johnson, City Clerk Councilman Powell offered the following resolution: Be it resolved by the City Council of the City of Austin, Texas: That the sum of one hundred and fifty ($ 150.00) dollars, be appropriated out of the Sanitary Sewer fund for the purpose of paying Robt Hamby for auditing the sewer books in the month of June .This money has been paid to Mr Hambyout of the incidental fund .This appropriation will be put back in the incidental fund to re-imburse the incidental fund. Sept 27th 1916: All present: Councilman Anthony offered the following resolution: Resolved by the City Council of the City of Austin, Texas : That the fine and costs amounting to $ 14.80, in cause No 11025. in the Corporation Court of the City of Austin, Texas, State of Texas vs Henry Tarver for train riding be and the same is hereby remitted, for the reason that this man Henry Tarver is a poor colored man who had saved up a little money which he was taking home at the time of his arrest for train riding, and which money thus saved for his family would be entirely lost if the fine and costs in this case should be imposed against him. Transfer of Funds Fine – case remitted --- Page break --- .It also seems to the City Council that Henry Tarver did not quite understand the seriousness of riding a train without paying his fare.
