Councilman Powell offered the following resolution : Be it resolved by the City council of the City of Austin, Texas : August Anderson That P S Spiller, Cashier of the Sanitary Sewer Earnings fund, be authorized and instructInspection fees -ed to refund to August Anderson , inspection fees which he paid at 603 & 605 East 13th refunded street , amounting to $ 3.00, which premises subsequently was discovered could not be connected with the sewers on account of topographical conditions. ..The Mayor laid before the Council the following resolution : Texas Life Ins Whereas, for the years 1908 & 1909, assessments for taxes against the Texas Life Insura Co taxes 1908-09 company ,of Waco, Texas, of its securities on deposite in the State Treasury of the State of Texas,were made at a valuation of $ 142,254.80; And whereas, there are included among said securities on deposite in the State Treasury ,certain National Bank stock ,and stock of other Corporations,which are not subjec to taxation in the City of Austin ,and there was an error in said assessments of the amoun of said securities on deposite in the State Treasury of the State of Texas for said years aforesaid; And whereas, in truth and in fact, said Texas Life Insurance company only had on depos-ite on the 1st days of January,1908 & 1909, securities to the amount and value of $33,000.0 which were subject to taxation in this City for said two years; And whereas, said Texas Life Insurance company desires to pay taxes on said securitie for said years 1908 and 1909, whenever the proper corrections and errors in the assessment of said securities for said years shall have been made; Now, therefore,Be it resolved by the City Council of the City of Austin,Texas, that said errors in the assessments of the securities of the TexasLife Insurance company, of Waco,Texas, on deposite in the State Treasury of theState of Texas, for the years 1908 & 1909, be and the same are hereby corrected and reduced to $ 33,000.00 for each of said years ,and the Assessor & Collector of taxes of this City be, and he is hereby directed to make said corrections in said Assessments on his books accordingly. Contract Maxwell & Lightfoot Brady & Robertson op Colleel & Bach Gray
The State of Texas County of Travis
This contract and agreement made and entered intoon this the 22nd day of January A D 1917, by and between the City of Austin, Texas acting by and throug+ its Mayor, who has been duly authorized so to do by the City Council of said City, party of the first part, and J W Maxwell, and the firm of Lightfoot, Brady & Robertson ,partied of the second part, witnesseth:
Whereas, the said parties of the second part have heretofore rendered to the party of the first part certain services for the discovery for taxation by said City of Austin of certain personal property and securities belonging to certain Corporations and which were and are on deposite in the State Treas -ury of this State ,and in compiling and furnishing to the party of the first part a list of such property and securitiesfor the purpose of being assessed for taxes, and in advising the said party of the first part and its Officers in legally assessing said property and securities for taxes, and in representing said party of the first part in prosecuting the test case of the City of Austi vs Guarantee Life Insurance Company of Houston, Texas, to final judgement and decision ,in the Dist Court of Travis County, the Court of Civil appeals of the third Supreme Judical District, and the Supreme Court of Texas, resulting in a judgement in favor of the party of the first part ,and a decision of the said Courts to the effect that all such personal property and securities of such domestic Corporations on deposite in the State Treasury as aforesaid ,as are subject to taxation by the party of the first part, which said services so rendered by the parties of the second part as aforesaid were rendered by them under a contract and agreement between the said City of Austin and the said J W Maxwell ,dated the 15th day of August 1912, whereby the said Maxwell was to be paid by the said City of Austin the same rate of compensation as herein-after provide to be paid to the said parties of the second part hereto, for said services rendered as aforesaid, and which said contract, according to its terms, has partially expired, and the parties hereto desire to renew and ext-d the same so as to insure the collection of all such taxes, and interest and penalties thereon.
Now, therefore, it is hereby agreed as follows:
1. Said prior contract and agreement dated the 15th day of August 1912, above mentioned is hereby renewed and extended until the taxes, interest and penal-ties mentioned herein are fully collected. 2. The parties of the second part hereby agree and bind themselves to prepare and compile or cause to be so prepared and compiled a correct list of all such personal property and securities owned by all such domestic Corporations and on deposite with or in said State Treasury of this State for and during the years 1915 and all prior years ,that have not already been assessed for Taxes or either of said years ,that have not already been assessed for taxes [illegible]

719 .said City of Austin , and to forward such list to the party of the first part,and in case any such property and securities have not heretofore been legally assessed for taxes by said City of Austin for said years 1915 and prior years,to furnish said party of the first part , and the proper Officers thereof ,with all such data and information as will enable said party of the first part and its Officers to make a legal assessment thereof for taxes for said years 1915 and all prior years ,and to furnish said party of the first part with data and information showing that such property and securities are legally taxable by said City of Austin under said Judgement and decisioninthe testcase before mentioned; and to receive and collect all such taxes ,interest and penalties on such prop-erty and securities aforesaid for the said years 1915 and all prior years,whether heretofore or hereafter assessed;to bring and prosecute allsuit or suits that may become necessary to enforce the payment of all such taxes ,interest and penalties thereon,whether now due and delinquent or hereafter to become due and delinquent for the taxes for said year 1915 and all prior years; and to do and perform all other things necessary and proper to be done in the collection of all such taxes ,interest and penalties.
3. In consideration of the services heretofore performed by the said parties of the second part ,as aforesaid, and of those hereafter to be performed by them as hereinprovi-ded,the said party of the first part hereby agrees and binds itself to pay to the said parties of the second part a fee and compensation of twenty (20%) per cent of all such taxes,interest and penalties which shall be collected and received by said party of the first part ,whether collected directly by said parties of the second part,or paid to the said party of the first part; such compensation and fees to be paid as fast as such taxes,interest and penalties are collected or paid.
4. It is further mutually agreed that said parties of the second part shall pay,and alone be responsible for all fees ,charges and expenses incurred by them,except Court costs, in performing the services herein required of them, and all fees and charges of any Attor-neys or other persons they may see fit to employ to assist them in the performance of this agreement.
