736 Regular meeting of the City Council: Austin, Texas : March 08, 1917: Roll called : All present,except Councilman Bartholomew: The minutes of the last regular and subsequent recessed meetings were read and approved: Reports of City Officers: The mayor laid before the Council the reports of the Assessor & Collector,the Marshal, the Sexton, the Public Weigher, the Supt of Weights and measures,the Engineer and the Chief of the Fire Dept, which were read and ordered filed. On the recommendation of Councilman Anthony,a fine in the Recorders Court against Lilly Mills,was remitted . Councilman Powell offered the following resolution: Whereas, the Supt of Streets and Public Improvements has filed his report with Paving Program the City Council to the effect that the Texas Bitulithic Company has completed 19th to 28th the work of paving and improving Xth Rio Grande street from the north line of accepted 19th street to the north line of 28th street ,under contract with the City of Austinand that said work has been fully done in strict accordance with said contract and specifications adopted by the City Council. Now, therefore, Be it resolved by the City Council of the City of Austin,Texas : That the said work of improvement be accepted by the City Council and that the final estimate due by the City to the said contractor be paid. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony,Haynes & Powell 4 Absent Councilman Bartholomew 1 Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin, that the City tax Tax Rolls rolls of the City of Austin for the year 1916 as made by the City Assessor & 1916 Collector& numbers 1 to 5282 & Supplimental Nos 1 to 15 inclusive& aggrugating Approved in the sum of $ 468, 004.98,& divided as follows: General Revenue tax es $ 240,002.50 School taxes 108, 000.97 Interest and Sinking fund 120,001. 51 Grand total taxes $ 468,004.68 be and the same are hereby approved: The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Haynes & Powell 4 Absent Councilman Bartholomew 1 --- Page break --- 737 Mayor Wooldridge offered the following resolution : Resolved by the City Council of the City of Austin, Texas : That the Wimbisch Drug Company is hereby authorized to install and maintain at their place of business 308 Congress Avenue in this City an Electric Light sign of the following description : The sign is to be double faced with plate glass sidesplaced on a frame of Metallined moulding. The lettering is to be painted on the glass and it is to be lighted internally with 40 wattlamps .It is to hang under the awning ,entirely within the curb line and the lowest point will be 8 feet above the sidewalk. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Haynes & Powell 4 Absent Councilman Bartholomew 1 Approved, A P Wooldridge, Mayor. By Mayor Wooldridge: An ordinance amending and enlarging an ordinance entitled " An ordinance to regulate traffic in and along the streets and ways of the City of Austin, Texas, and establishing rules of the road and prescribing penalties for its violation ,passed October 23rd 1911," and prescribing penalties for the violation of this amended and enlarged ordinance. The ordinance was read the first time, and a motion made to suspend the rule and place it on its second reading ,which motion prevailed by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Haynes & Powell 4 Nays none: The ordinance was read the second time, and a motion made to suspend the rule and place it on its third reading and final passage, which motion prevailed by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Haynes & Powell 4 Absent Councilman Bartholomew 1 The ordinance was then read the third time and passed by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Haynes & Powell 4 Absent Councilman Bartholomew 1 March 9th 1917: All present, except Councilmen Anthony & Bartholomew: Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin, Texas : That the sum of $ 300.00, be and the same is hereby appropriated out of the Sanitary Sewer fund for the purpose of constructing a six inch (6") sewer line ,500 feet long ,through the alley west of Wat Lynn street and across a portion of the lot belonging to Mr Stone on West 9th street, said line to extend from 9th to 10th streets The resolution was adopted by the following vote: Yeas Mayor Wooldridge ,Councilmen Haynes & Powell 3 Absent Councilmen Anthony & Bartholomew 2 Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin, Texas : That the sum of $ 100.00, be and the same is hereby appropriated out of any funds remain-ing unappropriated in the Permanent Street fund for the purpose of furnishing transpor- -tation to employees The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Haynes & Powell 3 " --- Page break --- 728 Absent Councilmen Anthony & Bartholomew 2 Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin,Texas : Herman That the Supt of Streets and Public Improvements be and he is hereby Pressler authorized to pay to Herman Pressler the sum of $ 75.00,for an easement for the Easement construction of a sewer line through and across Lot 8 Block 164 of the Original City,and, Be it further resolved : That the above amount be and is hereby ordered paid out of the appropriation of $ 3,000.00,made in the 1917 budgetof the Sanitary sewer fund for the completion of the North Austin Main,xxxx main between 12th & 16th streets. Councilman Haynes offered the following resolution : Whereas, the accompanying proposed contract between the City of Austin Contract with and Messrs J W Maxwell and Lightfoot,Brady & Robertson ,Attorneys of this Lightfoot Brady City ,looking to the collection of municipal taxes due the City of Austin & Robertson upon securities heretofore and likely hereafterto escape municipal taxat-tion ;and Whereas, the contingent fee of twenty per centum(20%) of the amount of taxes to be collected under the provisions of this proposed contract with the said J W Maxwell and Lightfoot, Brady and Robertson,Attorneys,is in the judgement of the City of Austin a fair one, Now,therefore, Be it resolved by the City Council of the City of Austin,Texas : That the City of Austin accepts said proposition contained in the accompanying proposal of the said J W Maxwell and Lightfoot, Brady & Robertson,dated March 9th 1917,and authorizes and directs the Mayor of this City to exe-cute a contract in the form set out in the accompanying proposal,and Be it further resolved : That the City Clerk of the City of Austin,Texas,be and he is hereby instr-ucted to record said contract ,when executed by the Mayor,in full in the minutes of the City Council of this City. Whereas, it is the desire of the City of Austin to enforce the collec-tion of all taxes due by domestic Corporations on securities owned by them and on depos- -its in the Treasury of the State of Texas for all years for which same are legally taxable; and, Whereas, it will be necessary ,in order to determine whether such securities are taxab-ble ,for the City to have instituted and prosecuted certain test suits for the enforcement and collection of such taxes, which suit or suits will probable not be finally determined until at least during the year of 1918; and, Whereas, pending the final determination of such suit or suits, taxes on such securities by such domestic Corporations for the years 1916,1917, and 1918 will in all probability have become due and owing to the City of Austin; and, Whereas, it is the desire of the City of Austin to retain and employ J W Maxwelland the firm of Lightfoot, Brady & Robertson ,Attorneys at Law, for the purpose of instituting and prosecuting to final determination of such suit or suits, and the collection of all such taxes for said years; now, therefore, This contract made and entered into on this date by and between the City of Austin, a municipal Corporation ,acting by A P Wooldridge, its Mayor, who is duly authorized to execute this contract by resolution duly passed by the City Council ,as party of the first part ,and J W Maxwell and Lightfoot, Brady & Robertson ,as parties of the second part, Witnesseth : 1. The parties of the second part hereby agree and bind themselves to prepare and compile or cause to be prepared and compiled a correct list of all such personal property and securities owned by all such domestic Corporations on deposits with the State Treasurer in the State Treasury of the State of Texas for and during the years 1916, 1917 and 1918, and to forward such lists to the party of the first part ,and in case any such unrendered property and securities have not theretofore been legally assessed for taxes by said City for said years 1916,1917 and 1918. to furnish said party of the first part, and the proper Officers thereof, with all of such data and information as will enable said party of the first part and its Officers to make a legal assessment thereof for taxes for the years 1916,1917 and 1918,and to furnish said party of the first part with data and information showing that such property and securities are legally taxable by the City under the laws of this State and under the Judgement and decisions of the Courts in said test case or cases before mentioned; and to receive and collect all such taxes ,interest and penalties on such property and securities aforesaid for the years 1916,1917 and 1918, whether heretofore or hereafter assessed; and to bring and diligently execute all suits that may be necessary to enforce the payment of all such taxes, interest and penalties thereon, whether the same are now due and delinquent or may be hereafter become due and delinquent for the years 1916,1917 and 1918, and to do and perform all other things necessary and proper to be done in the collection of all such taxes. interest and penalties. 2. That in consideration of the services heretofore performed by parties of the second part and of those hereafter to be performed by them ,as herein provided, the said party of the first part hereby agrees and binds itself to pay to the said parties of the second part a fee and compensation of twenty per cent (20%) of all such taxes, interest and penal-ties, which shall be collected and received by said party of the first part; --- Page break --- 740 whether collected directly by said parties of the second part or paid to the said party of the first part; such compensation and fees to be paid as and when such taxes, interest and penalties are collected and received by the party of the first part. 3. That it is mutually agreed between the parties hereto that the parties of the second part shall pay and alone be responsible for all fees, charges and expenses incurred by them, except Court costs and printing briefs, in performing the services herein required of them, and all fees and charges of any attorneys or other persons that they may see fit to employ to assist them in the performance of this agreement. 4. That nothing contained in this agreement shall in any wise effect the terms of a certain agreement heretofore made between the parties hereto, and dated January 20th 1917, and relating to taxes for the year 1915 and prior years. March 10th 1917: All present, except Councilman Anthony. Mayor Wooldridge offered the following resolution: Resolved by the City Council of the City of Austin, Texas: That the sum of $ 45.87, be and the same is hereby appropriated out of the General Contingent fund of the City of Austin, Texas, to pay for 417 feet of sidewalk in front of the City's park property at the corner of Blanco and West 10th streets in this City. Sidewalk Park Blanco + 10th Councilman Powell offered the following resolution: Be it resolved by the City Council of the City of Austin, Texas: That the sum of $ 42.85, be and the same is hereby transferred from the Sanitary Sewer fund to the General street fund to reimburse said fund for this amount which was erroneously drawn, see warrant # 3014. Be it further resolved: Transfer Sewer fund. That the City Treasurer and Book-keeper be requested to make said transfer. Be it further resolved: That the City Treasurer and Book-keeper be requested to make said transfer. The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin,Texas : Transfer w/L fund To Sanitary Sewer Earnings That the sum of Five thousand ($5,000.00, dollars be and the same is hereby transferred from the unappropriated balance of surplus funds in the Water, Light and Power Dept of this City to the Sanitary Sewer fund ,and is hereby made subject to appropriation from time to time ,as the needs of that department of the City government may require,and Be it further resolved : That the Treasurer of the City of Austin is hereby instructed to make a transfer of funds on his books in accordance with the provisions of this resolution.
