743 Regular meeting of the City Council; Austin, Texas. March 22, 1917: The Council was called to order by Mayor pro tem Powell: Roll called : Present Councilmen Anthony, Bartholomew, Haynes & Powell 4 Absent Mayor Wooldridge 1 The minutes of the last regular meeting were read and approved: The Chair laid before the Council the following report from the City Clerk: Austin, Texas ,March 20th 1917: Hon Mayor, and City Council: City of Austin, Texas. Gentlemen : Report of City In compliance with the City Charter, I have the honor to report the following Clerk as the result of the Primary Election held in this City on the 19th day of March A D 1917, Primary for the purpose of nominating candidates for Mayor and four Councilmen ,to be voted upon Election at the general election to be held on the 2nd day of April A D 1917, viz : For Mayor: A P Wooldridge received 390 votes For Councilman : W B Anthony received 394 votes For do E C Bartholomew received 399 votes For do H L Haynes received 399 votes For do P W Powell received 396 votes Total votes cast at said election 411. Dear Sir : We have leased the property on corner Nueces and West 6th street, from Mr Jos Filled application Fischer, and we wish to make application to the City Council for permission to install and Gasoline operate a drive-in filling station at this place , and to conform to all City ordinances Station governing same . Permit This station will not be a curb station ,but cars will drive in the lot to be filled with gasoline ,this avoiding congestion of traffic. This equipment to be of most modern character and nature. We respectfully ask that this petition be investigated, and if practicable allowed. Respectfully, Nelson Davis & Son. By T F Davis. On motion the petition was granted, the work to be done under the supervision of the City Engineer, by the following vote: Yeas Councilmen Anthony, Bartholomew, Haynes & Powell 4 Absent Mayor Wooldridge 1 Councilman Powell offered the following resolution: Be it resolved by the City Council of the City of Austin, Texas : That permit is hereby granted to Cullen and Caswell to install and maintain a hose rack of a type to be approved by the Supt of Police and Public Safety, at the curb line in front of Nos 106 & 112 East 8th street , in the City of Austin, Tex Resolved further: That in connection with this hose rack said Cullen and Caswell are like-wise authorized to install and maintain three pipe lines not larger than one- -half inch in diameter across and underneath the sidewalk in front of Nos 106 & 112 East 8th street in such position as designated by the Supt of Streets and Public Improvements ,said sidewalk to be replaced in first class condition and according to specifications for sidewalks heretofore adopted by the City Council for the construction of sidewalks in the City of Austin. Resolved further: That the hose through which air and water are conveyed must be kept, when not in actual use, neatly coiled and suspended from the bracket upon the rack hereby authorized to be installed. Resolved further: That the work under this resolution authorized to be installed and maintaid where not otherwise assigned, shall be under the immediate supervision of the City Engineer of the City of Austin, Texas, who is hereby authorized to prescribe Necessary specifications for the work authorized to be done. Resolved further and finally: That this permit is granted only for the installation of a hose rack and necessary piping and does not include the installation or construction of a storage box for hose underneath the sidewalk and must be accepted as revocable at any time in the pleasure of the City Council. The resolution was adopted by the following vote: Yeas Councilmen Anthony, Bartholomew, Haynes & Powell 4 Absent Mayor Wooldridge 1 Approved, P WPewell, Mayor pro tem --- Page break --- Transfer funds The Rabb fine remitted Sewer line Travis Heights Purchase Sewer Pipe Paving Work Council Eng'r Report --- Page break --- said street ,the amount per front feet of abutting property to be paid by the owners thereof ,and also the names of persons,estates or Corporations owning property abutting on said improvements ,with a description of thier property and a statement of the total amount payable by each of said owners for said improvements; and Whereas,the City Council has examined the said report and finds the sameo correct;and Whereas, the necessity exists that a poertion of the cost of the said improvements s ould be assessed against said property owners and their propery subject to the terms of the Charter of the City and the ordinance in such cases made and provided,and after the notice and hearing provided by said Charter and ordinance; Now, therefore, Be it resolved by the City Council of the City of Austin,Texas : 1. That the said report of the City Engineer be,and the same is hereby approved. 2. That a portion of the cost of making the said improvements shall be assessed against said owners of property abutting on West Avenue, in this City, from the north property line of West 6th street to the south line of "West 19th street in the City of Austin,Texas, and against said property;that the said assessment shall be made at the rate of $ 3.78 per front feet of such propertyin accordance with the front feet rule or plan ,in propertion as the frontage of each owner in each block of said street is to the whole frontage in that block to be improved provided that if said rule of apportionment shall appear to the City Council to be unjust or unequal in any particular case ,or to result in an assessment in excess of the benefits received through said improvements by any owner or his property ,the City Council shall adopt such rule of apportionment as shall effect substantial equality and justice between said property owners,consider-ing benefits received by and burdens imposed upon said owners ,and that in no case shall any assessment be made in excess of the actual benefits receivedby the owners of said property though the enhanced value thereof by means of said improvement . 3. That a hearing shall be given before the Council to said property owners on the 5th day of April A D, 1917, at 10 O’clock A M,at the Mayers Office in the City Hall,in the City of Austin,Texas, at which hearing said property owners, their agents or Attorneys shall be fully and fairly heard as to all matters concerning the said improvements or any irregularity or invalidity in the pro-oceeding s with reference thereto,or as to the benefits thereof,if any ,to their property ,and as to the assessment proposed to be made against ther and their property ,and as to any other matter or thing connected therewith. At which hearing the said owners shall have the right to produce witnessesand testimony,and which hearing shall be adjourned from time to time and from day to to day until all are fully heard and all matters in connection with the said improvements and assessment are fully ascertained ;that after the said hearing --- Page break --- shall be closed, said City Council will proceed to assess said street and their property, who shall agree with the said Council upon the said assessments, such sums as may be so agreed upon and determined as provided by the Charter of the City and the said ordinance; and that as to any such property owner who may not so agree, the City Council will, after said hearing, appoint a commission to determine said assessment, and will take such further steps in ascertainment thereof as are provided by the Charter and ordinance. 4. That the Supt of Streets and Public Improvements of said City of Austin, is hereby directed to give notice hereof to the said property owners, their agents and attorneys by publication of a copy of this resolution not less than twice in the AustinStatesman, a daily paper of general circulation in the City of Austin, the first publication to be not less than five days prior to the date of hearing. 5. That this resolution take effect from and after its passage. March 26th 1917: All present: Mayor Wooldridge offered the following resolution: Resolved by the City Council of the City of Austin, Texas: That the sum of $ 1,073.05, be and the same is hereby appropriated out of the General Contingent fund and made payable to J W Maxwell and Brady, Lightfoot & Robertson Maxwell and Commission Rate! as a twenty per centum commission upon the collection of $ 5,365.15, for taxes for the years 1908 & 1909 from the American National Insurance Co. of Galveston on securities deposited with the Treasurer of the State of Texas for these years. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Barthelemew, Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. March 27th 1917: All present except Powell: Mayor Wooldridge offered the following resolution: Be it resolved by the City Council of the City of Austin, Texas: That the sum of $ 93.40, be and the same is hereby ordered transferred from the Transfer funds. appropriation made in the 1917 budget for general street fund for tarviating the speedway from 19th to 21st streets and re-appropriated to the account of repairs to two automobiles. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Barthelemew & Haynes 4 Absent Councilman Powell Approved, A P Wooldridge, Mayor. --- Page break --- 748 Ma'rch 20th : All present: Budget Amended Mayor Wooldridge offered the following resoluti[illegible]ment: Resolved by the City Council of the City of Austin,Texas: That the budget of the Mayor of the City of Austin,Texas, for the year 1917, be amended as follows : The salary of the Chief Engineer of the Water & Light Plantbe increased from $ 135.00, per month , to $ 140.00, per month. That the salary of one electrical Line man with wagonsbe increased from $ 90.00,per month to $ 95.00,dollars per month . That the salary of one electricaal lime man be increased from $ 80.00 per month to $ 85.00,dollars per month . That the salary of one electric lineman with wagon be increased from $ 85.0 dollars per month to $ 87.50, per month . That the salary of one Night Lineman be increased from $ 85.00, per month to $ 90.00, per month,and Be it further resolved by the City Council of the City of Austin : That the sum of $ 270.00,be transferred from the unappropriated balance in the Water & Light fund to cover the increases in salaries hereinabove recommend and that $ 270.00, be appropriated to the purpose of said increase of salaries. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Barthelemew, Haynes & Powell 5 Nays none, Approved, A P Wooldridge, Mayor: Mayor Wooldridge offered the following resolution : New official deed for E M Weiss Whereas, on February 7th 1917, E M Weisser Travis County, Texas, paid sixty five ($ 65.00),in payment in fullLet 116 ,Section "A",Oakwood Cemetery Annexand deed for same was executed and delivered to the said Weissen February 8th 1917,; and Whereas, said deed has been lost or mislaid and cannot after diligent search be found, Now, therefore, Be it resolved by the City Council of the City of Austin,Texas : That the Mayor of this City be and he is hereby authorized to execute a duplicate deed to said above described lot. Mundt The Mayor laid before the Council the following resolution: Whereas, it appearing to the City Council that A A Mundt has completed the construction of the concrete bridge across Waller creek at 14th street'te the satisfaction of the Supt of Streets and Public Improvements, Now, therefore, Be it resolved by the City Council of the City of Austin,Texas: --- Page break --- 749 That the Mayor of the City of Austin,Texas, be and he is hereby authorized to execute in favor of the American Indemnity Company of Galveston,Texas, a release of its obligation upon the bond securing to the City by A A Mundtin the construction of same.
