795 Regular meeting of the City Council: Austin, Texas, June 21, 1917: The Council was called to order by the Mayor: Roll Called: Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Absent none: On motion the reading of the minutes was postponed until the next regular meeting: The Mayor laid before the Council the following resolution: Be it resolved by the City Council of the City of Austin,Texas: That a permit is hereby granted to Messrs A L Peterson and A D Peterson to install and maintain a Gilbert and,Barker gasoline pump,to be located on the sidewalksface in front of No 4100Alice Avenue,in a position to be designated by the Supt of Streets & Public Improvements,said gasoline pump to be of a modern and approved construction and design and subject to the approval of the Supt of Police and Public Safety. Resolved further: That the hose through which air,gasoline or any other oil or volatile substance is conveyed by pumping or otherwise from the tank to be placed upon private property at No 4100 Alice Avenue ,or from the pump authorized to be installed,must be kept,when not in actual use,neatly coiled and stored in a receptacle provided for such hose in the pump authorized to be installed or suspended from a bracket attached to the pump. Resolved further; That the work under this resolution authorized to be installed and maintained must be installed and maintained ,where not otherwise assigned,under the immediate supervision of the City Engineer ,of Austin,Texas,who is hereby authorized to prescribe necessary specifications for the work herein authorized to be done. Resolved further and finally: That this permit is granted only for the installation of a gasoline pump andtank and does not include the installation or construction of a storage box for hose underneath the sidewalk and this permit is granted and must be accepted as revocable at any time in the pleasure of the City Council . Peterson Gasoline Pump Approved, A P Wooldridge, Mayor. The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin, Texas : That a permit is hereby granted to the Southwestern Auto Supply Companyto install and maintain a 5 barrel gasoline tank ,to be approved by the Supt of Police and Public Safety, under the sidewalk in front of No 105 West 5th streetin the City of Austin,Texas. Resolved further : That in connection with this gasoline tankhereby authorized to be installed,the said Southwestern Supply Company are like wise authorized to install and maintain an automatic gasoline pump to be located at the curb line in front of No 105 West 5th streetin a position to be designated by the Supt of Streets and Public Improvements ,said gasoline pump to be of the most modern and approved construction and designand subject to the approval of the Supt of Police and Public Safety. Resolved further: That the said Southwestern Auto Supply Company shall install and maintain at the top of South Western Auto Supply 5 bbl tank --- Page break --- 796 and upon the gasoline pump hereby authorized, an electric light of not less than 10 watt power and placed in a globe of not less than 10 inches in diameter which electric light must be kept illuminated not less than three hours daily between the hours of 5 and 12 O’clock P M during the existence of this permit. Resolved further : That the hose through which air, gasoline or other oil or volatile substance is conveyed, by pumping or otherwise, from the store house at N° 105 West 5th street, or from the tank authorized to placed in front of the same must be kept, when not in actual use, neatly coiled, and stored in a receptacle provided fro such hose authorized to be installed, or suspended from a bracket attached to the pump. Mayor Wooldridge offered the following resolution: Resolved by the City Council of the City of Austin : That the place, Office and position of censor of commercialized amusements of this City be and the same is hereby created at the monthly salary of Seventy five dollars (¢ 75.00) to the censor appointed and confirmed by the City Council. The resolution was lost by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony & Powell 3 Nays Councilmen Bartholomew & Haynes. 2 Councilman Powell offered the following resolution : Stormdrains Janes st. Resolved by the City Council of the City of Austin, Texas : That the sum of five thousand (¢5,000.00 dollars, be and the same is hereby appropriated out of the general contingent fund of the City of Austin, Texas, to construct a storm sewer on South Congress Avenue extending from James street where it crosses Congress Avenue to a point beyond Nellie street where it will come out of South Congress Avenue at one hundred and twenty five feet wide into Fairview Park, and Be it further resolved : That any surplus over and above the full costof the storm sewer provided for and above the full cost of the storm sewer provided for by this appropriation may be applied to the filling of the Ravine in which said storm sewer is constructed where said ravine intersects Nellie street off of South Congress Avenue, and --- Page break --- 797 Be it resolved further: That the appropriation out of the general contingent fund herein and hereby made be passed to the Credit of the Permanent Street Improvement fund of the City of Austin, Texas, and Be it resolved further: That the disbursement of this appropriation and the supervision of the work authorized to be done thereunder be placed with the Sup of Streets and Public Improvements,and Be it further and finally resolved: That the five thousand ($5,000.00) dollars,hereby directed to be transferred out of the general fund to the Permanent Street Improvement fund be made upon the Books of the City Treasurer of the City of Austin,Texas. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none, Approved, A P Wooldridge, Mayor. Councilman Haynes offered the following resolution: Whereas, in the year 1914, A H Yarrington sold to Mrs Ora Belle Mc Innis fifty three($53) by one hundred and sixty (160) feet of the northwest corner of Lot No 1,Outlot No 50 Div "E" of the City of Austin,Texas, which property she assessed for the year 1915 at four thousand one hundred ($4,100.00) dollars,the municipal taxes uponwhich for said year amounted to eighty four & five( 84.05 )dollars; and Whereas growing out of said sale of A H Yarrington to Mrs Belle McInnisthree thousand ($ 3,000.00) dollars,in vendors lien notes ,representing deferred payments owing to the said A H Yarrington,were assessed were assed by the said A H Yarrington for taxes for the year 1915,upon which the City taxes amounted to sixty one &50/10 ($ 61.50),and which said taxes have been paid by the said A H Yarrington; and Whereas, for reasons deemed by the said Mrs Ora Belle McInnis sufficient, said transaction was repudited and the deed from the said A H Yarrington and Wife to the said Mrs Ora Belle McInnis was by decree of Court cancelled and annulled; and Whereas, prior to said cancellation ,the said A H Yarrington had paid the taxes on said vendors lien notes ,amounting to sixty one dollars and fifty cents($61.50); and Whereas, the said Mrs Ora Belle McInnis had not paid, and to this day has not paid the taxes on said fifty three (53) feet by one hundred and sixty(160) feet out of the North west corner of Lot No 1,Outlot 50 Div "E",but has left the same unpaid and for which delinquent taxes said property is liable, Now therefore, A H Yarrington J Howe Be it resolved by the City Council of the City of Austin,Texas; That the assessment of said three thousand ($3,000.00) dollars,of vendors lien notes by the said A H Yarrington for the year,1915 and the same is hereby cancelled and annulled, and Be it further resolved by the City Council of the City of Austin: That sixty one dollars and fifty cents ($ 61.50) be and the same is hereby appropriated out of the general contingent fund of the City of Austin,Texas,and made payable to the said A H Yarrington for said taxes improperly paid by him on said three thousand($3,000.00) dollars, vendor lien notes assessed by him for the year 1915; and Be it further resolved : --- Page break --- 798 That inasmuch as an application on the part of the said A H Yarrington to the City Council to cancel and annull said assessment of three thousand ($3,000.00) dollars,was pending to the City Council for many months ,the interest and penalties due on the taxes on the above described real estate be and the same are hereby remitted. Mayor Wooldridge offered the following resolution : Appropriation curb & sidewalk Sidewalks Resolved by the City Council of the City of Austin,Texas That the sum of one hundred sixty six dollars and sixty four cents be and the same is hereby appropriated out of the general contingent fund of this City in payment of and upon the consideration of the transfer of the claims of Wallace R Miller against Joseph Cavanaugh, [illegible] for $ 113.64 ,and W B Worth -em for $ 53.00. These payments represent work ,in the way of curbing and sidewalk construct-ion ,done by the said Wallace R Miller for the persons named above at the instance of the City of Austin, Texas. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. Tom B Jones fine remitted The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin,Texas : That in view of what appears to be the equities of the case,one-half,or $ 9 $9.90,of the fine and costs imposed upon Tom B Jones,in cause No 12045,State of Texas vs Tom B Jones, for speeding, be and the same is hereby remitted. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Approved ,A P Wooldridge, Mayor. Lewis Mayfield Reward. The Mayor laid before the Council the following resolution: Whereas, Lewis Mayfield, a Policeman of this City, under very courageous circumstances ,assisted at the capture of two negroes who had been thieves and barn burners in the neighborhood of Taylor ,Texas; and Whereas in so doing he used the sleuth hounds of the City; and Whereas, a reward of one hundred dollars had been offered by the owner of the barn burned and the horses and cattle destroyed in said barn for the capture of the criminals committing these deeds; and Whereas, there was seventy dollars ($70.00)left of said one hundred dollarsafter defraying the expenses of running down said criminals, Now, therefore, --- Page break --- 799 .Be it resolved by the City Council of the City of Austin: That in view of the bravery of the conduct of said Lewis Mayfield ,the balance of said reward ,or seventy dollars,be and the same is hereby authorized to be kept by the said Lewis Mayfield. To this resolution ,Councilmen Barthelemew, Haynes & Powell voted Yea.Mayor Wooldridge and Councilmen Anthony voted Nay.The negative votes were placed on the ground that it was not best for men in the employment of the City who are paid an adequate salary for their services and who use the facilities of the City in making arrests to receive rewards for services along the lines of their official employment. Councilman Powell offered the following resolution : Resolve- by the City Council of the City of Austin,Texas Piping Reach lines E 6th XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX That from proof made to us by the accompanying and attached plate of Outlet No 1 Div "A" of the City of Austin,Texas, and a special survey of physical conditions on the ground as they exist at the present time ,which conditions show conditions as they have probably existed since the year 1871,as proved to us by D B Gracybase upon the records of his office as an abstracter of titles for the County of Travis ,Texas,we hereby find ,establish and declare that the north east corner of Block No 2,Outlet No 1 Division F A- "A"of the City of Austin,Texas, is found by beginning at a point on the south line of East 6th street at its intersection with the center line of Brushy street and going thence in an easterly direction along the south line of East 6th street a distance of three hundred and twenty two and fifty-one-hundredths(322.50) feet to a point ,which said point is at the intersection of this line with the present fence line on the east side of said Block No 2,Outlet No 1 Division F A "A" This resolution is expressly based upon the report and advice of W R A Muemster Assist nt City Engineer,attached hereto and dated June 26th 1917. Refund Councilman Powell offered the following resolution : Dominican Sisters Be it resolved by the City Council of the City of Austin,Texas: Sewer Rebate That the sum of $ 15.00 be refunded to the Dominican Sisters by reason of the fact that they paid this amount for sewerage at 2501 Nueces street ,when by recent inspection of the Plumbing Inspector ,he reports that this house is connected with a cesspool and not connected with the City's sewer system Be it further resolved: That P S Spiller,Cashier sewer Earnings fund be instructed to refund to them this amount. June 14th, 1917: All present: whistle The Mayor laid before the Council An ordinance to regulate the use of whistles, horns, gongs and ordinance other devices on street cars and motor vehicles, and providing penalty for violation thereof. The ordinance was read the first time, and passed under suspension of the rules by the following Yeas-Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell. 5 Nays none, The Council then adjourned.
