34 Regular meeting of the City Council: Austin, Texas, ugust 23rd 1917: The Council was called to order by the Mayor; Roll called: Present Mayor Wooldridge, Councilmen Anthony, Haynes & Powell 4 Absent excused Councilman Bartholomew 1 The minutes of the last regular and subsequent recessed meetings were read The minutes of the last regular and subsequent recessed meetings were read and adopted: Application of Chas Haywood for licenese as driver of sorvice car was presented and approved [struck through] granted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Haynes & Powell 4 Nays none: The Mayor laid before the Council the following resolution: Be it resolved by the City Council of the City of Austin, Texas: That the sum of $ 42.15, be and the same is hereby appropriated out of any Salary H B Barnhart funds not already appropriated, in the sanitary sewer fund for the purpose of paying the August salary of H B Barnhart, employed to enforce connections to the sanitary sewer system of the City of Austin. Mayor Wooldridge offered the following resolution : Resolved by the City Council of the City of Austin,Texas : That for good and sufficient reasons unto the City Council moving, the pound fees, amoun-ting to $ 1.50,imposed against Zack Blocker in the Corporation Court of the City of Austin, Texas,for one cow impounded on the 25th day of July, 1917,be and the same are herebyremitted, and Be it further resolved by the City Council of the City of Austin: Th at the sum of one dollar and fifty cents ($1.50) be and the same is hereby appropriated out of the general contingent fund of the City of Austin ,Texas, as a refund th the said Zack Blocker. August 29th 1917: All present: Mayor Wooldridge offered the following resolution : Resolved by the City Council of the City of Austin,Texas: That the City of Austin hereby agrees to purchase of A J Zilker of Austin,Texas, for the sum of one hundred thousand ($ 100.000.00) dollars, the proceeds of the sale to go to the Austin School Board for the benefit of industrial training in the public FreeSchools of this City,a tract of land of about fifty acres,including therein the whole of what is known as Barton Springs on both sizxX sides of Barton Creek. It is understood that a roadway of about thirty feet ( 30) in width out of said fifty acres is to be reserved to A J Zilker for access for cattle and otherwise west of Barton Creek and to the Colorado River. That the price to be paid for the fifty acres, including said Barton Springs and the creek formed by the flowing of said springs ,is, as above stated, the sum of one hundred thousand ($100.000.00) dollars,and is to be paid by the City of Austin to the said A J Zilker for the benefit of the manual training department of the Austin Public Free Schools in ten equal annual installments of ten thousand ($ 10,000.00) dollars,MACK the deferred pay ments to bear interest at the rate of 6% per annum. This purchase is made subject to and conditioned upon the following of the correct procedure, whatever it may be determined to be ,that will vest perfect title to the City --- Page break --- 36 of Austin in said fifty acres of land hereby agreed to be purchased of the said A J Zilker. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony & Powell 3 Nays Councilmen Bartholomew & Haynes 2 Approved, A P Wooldridge, Mayor. Bartholomew reasons for Vote Councilman Bartholomew filed the following reasons for his vote and asked that they be spread upon the minutes of the Council: I am in favor of purchasing the Bartons springs property,but not at the price of $ 100,000.00, It was offered the City many times last year for $ 50,000 which was then considered twice its value. I am now willing to pay $ 50,000.00,for the property,but not $100,000. Bartholomew. Councilman Haynes filed the following as the reasons for his vote, and asked that they be spread upon the minutes of the Council: While I believe that the City should owns Bartons springs,I consider $ 100.000.00 an excessive price and that the Council has no legal or moral right to make such a contract without a vote of the taxpayers.
