Barton Springs Acquisition:
The Council approved a proposition to purchase the historic Barton Springs property for $100,000, intended for the city's water supply. Jim Glass. funeral expenses The Mayor laid before the Council a bill from Ed Rosengren ,amounting to $ 172.00 for burial expenses of Jim Glass,which was read but no action taken. Mayor Wooldridge presented the following resolution : Resolved by the City Council of the City of Austin,Texas : That the sum of two thousand five hundred and eighty six dollars and fourteen cents. (¢ 2,586.14) at this time remaining unexpended in the appropriations made for permanent street improvements of the City,be and the same is hereby specifically withdrawn from the appropriations to which the same,were heretofore assigned and consolidated as appropria-tions for the following purposes: $184.81 cents of said $ 2,586.14,at this time remaining unexpended is set apart to cover an overdraft for brick repair work done on certain of the streets of the City of Austin,Texas; Budget Amended $44.05 is set apart and appropriatedto the reapir of the alley between Congress avenue and Colorado street and between 4th & 5 th streets in this City,and the balance of said unexpended amounts heretofore made for permanent street improvement work ,and amounting to $ 2,357.28,is set apart and specifically appropriated to the paving of West Avenue between 6th and 19th streets in this City.

. Mayor Wooldridge offered the following ordinance: An ordinance amending an ordinance entitled " An ordinance amending and enlarging an ordinance entitled " An ordinance 'to regulate Traffic in and along the streets and ways of the City of Austin,Texas, and establishing the rules of the road and prescribing penalties for its violation passed October 23,1911," passed March 8th 1917, and prescribing penalties for the violation of this amended ordinance. 11 August 31st 1917: All present : The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin,Texas: That the City Assessor & Collector of the City of Austin,Texas,is hereby authorized and instructed to assess credits for taxation at the rate of 662/3 % of their market value. September 1st 1917: Mayor Wooldridge offered the following resolution : Whereas, A J Zilker has made a proposition in writing,of date August 31,1917, through the Board of Trustees of the Public Free Schools of the City of Austin ,wherein he proposes to convey to the Board of Trustees of the Public Free Schools of the City of Austincertain land therein described ,including Barton Springs, for the sum of one hundred thousand ($100,000.00) dollars,payable in the terms stated in said proposition,and further proposing that if it be deemed advisable that the conveyance of said land would be made directly to the City of Austin,and that the vendor's lien notes to be executed in payment of said land shall be made payable to said Board of Trustees,its successors and assigns,and that the proceeds derived from the sale of said property to the City shall constitute a trust fund to be used by said Board of Trustees,and its successors, for the purposes set out in said proposition above mentioned; and Whereas, The City Council of the City of Austin is of the opinion that it would be to the best interest of said City to purchase said land from said Zilker at the price and upon the terms set out in his said proposition above mentioned;therefore, Be it resolved by the City Council of the City of Austin : That the proposition of said A J Zilker,above mentioned, be and the same is hereby accepted by the City Council of the City of Austin; provided, however, that said City Council shall first be authorized by the taxpaying voters of the City of Austin , as required by section 4 of Article 15 of the City Charter,to purchase said land for the City of Austin ,and to cause to be executed vendor's lien notes in payment therefor;and Be it further resolved, that an election be ordered at once submitting the question to the taxpaying voters of the City of Austin for their action thereon,said election to be held on the 2nd day of October A D 1917; provided,that if the purchase of said land and the execution of the vendor's notes in payment thereofbe authorized by the taxpayers of said City ,who are qualified voters in said City,said A J Zilker is to deliver his warranty deed conveying said land to the City of Austin ,such land to be described according to field notes and the description thereof ascertained from an actual survey of said land ,and that the title to said land shall be dound to be good and sufficient in said A J Zilker; and Be it further resolved, that a certified copy of this resolution be furnished at once by the City Clerk to said A J Zilker and to said Board of Trustees of the Public Free Schools of the City of Austin. Austin, Texas, August 31st 1917. To the Hon Board of Trustees of the Public Free Schools of the City of Austin. Gentlemen :
At your request and in accordance with the tentative agreement entered into by your Honorable Body and the Honor-able City Council of the City of Austin,Texas,I beg to herewith submit the following propositionregarding the gift to the Public Free Schools of the City of Austin of my Barton Springs property,-in lieu of and by way of modification of my proposition to you of May 15th 1917 to which reference is here made.
I now propose to convey by good and sufficient warranty deed to the Board of Trustees of the Public Free Schools of the City of Austin ,Texas, their successors and assigns,a tract of land containing fifty acres more or less,upon which are located all the Springs known as " Barton-Springs", said tract being breifly described as follows: " All that certain tract of land , a part of the William Barton Labor and H P Hill League ,which lies East of the Bee Cave road,and lies between the iron bridgeacross Barton or Spring creek on said road,and the place where the old stone arched bridge formerly crossing said creek was located, a short distance up said creek from Barton springs. The tract to be conveyed embraces that portion of the 131½ acre tract purchased by me from C D Walsh et al,and described in deed recordedin book 171 ,pages 577 et seq of the records of Travis County ,Texas, -to which reference is here made,-which lies between said bridges and between the Bee Cave road as now located and said creek;- also that tract of land conveyed to me by G T Rabb and Wife by deed record ed in Book 228,pages 274 et seq, of the records of Travis County, Texas,reference being here specifically made to the conditions of said conveyance? . Also that tract of land conveyed to me by C E Lamar by deed recorded in Book 228, page 211 of the records of Travis County. Texas, _ to which refe-ence is here made. Including all springs on said premises and all water rights and water powerprivileges pertaining or incident thereto. There is to be expressly reserved,however. the right of way or easement over a strip of land thirty feet wide running from the said Bee Cave roadeasterly to Barton [illegible] creek,said strip to be so located as to include the passage for stock from the premises west of said road to said creek as same now exists;this reservation however,shall not be construed to in any manner interfere with the use of the water from said springs by the City of Austin for its minicipal purposes.

44 . I also agree that in the event the property above described shall be acquired by the City of Austin for the purposes of a water supply,the City shall have a perpetual easement ,should it so desire the same,over my land on the west si side of Barton Creek and north of the iron bridge over said creek for the purpose of laying its water mains or conduits from said springs,in order to convey water therefrom to its pumps. This proposition however is made subject to the following termsand,NNXXXIn conditions ,to-wit :
1. The property above described as having been conveyed to me by G T Rabb and Wife by deed recorded in Book 229 pages 274,et seq.is to be conveyed subject to all the restrictions and limitations as to use and occupancy of said said premises contained in said deed from said Rabb and Wife to myself.
2. That the City Council shall purchase from your honorable body the premises above described ,for a water supply to the City for its municipal purposes ,for the sum of one hundred thousand ($ 100.00.00) dollars,payable by the City of Austin to your honorable body ,its successors and assigns,in ten(10) equal annual installments of ten thousand ($10,000.00) dollars,each, payable one (1) two(2) three(30) four (4) five (5) Six (6) seven(7) eight (8) nine(9) and ten(10) years,after the execution and delivery of said deed of conveyance to the said property to the City of Austin ,with interset from date of conveyence until paid at the rate of six { 6% } per annum,interest payable annually. Such payments to be made out of the Earnings of the Water and Light plant of the City of Austin. and such adequate and legal provision to be made by the City of Austin for the payment of said considerations as may be required by the Charter of said City and the laws of the State of Texas and in addition thereto the payment of said consideration to be secured by the reservation of a vendors lien on the premises to be so conveyed,until full and final payment of said consideration. Should it be deemed advisable the conveyence in question could be made directly by myself and the notes or obligations of the City to be executed in payment of such consideration to be made payable directly to your honorable body.
3. The proceeds to be derived from the sale of said property to the City of Austin ,for the consideration and in the manner aforesaid shall consti -tute a trust fund to be used by your honorable body and its successors for the equipment and maintenance and the promotion of the needs and best inter-ests of the school of manual training and home economics for the instruc- -tion of white youths in the City of Austin,Texas. in the useful arts and sciences,as said school now exists or may hereafter exist,as a part of the Public Free Schoolsystem of the City of Austin,Texas.Said fund thus derived t to be used and expended for the purposes named, under the sole and absolute direction of your Board and its successors. 4. Upon the legal acceptance of this proposition by the City of Austin, and the execution and delivery of its notesor other obligations representing the purchase money for said property, I agree to execute and deliver the deed of conveyance and easement above referred to ,either to your Board or to the City of Austin as may hereafter be determined,and to surrender to said Cityof
