    Approved a $4,200+ paving initiative for West 5th Street, with property owners contributing a significant portion (over $6 per front foot). A public hearing was set for November 15 for affected owners to discuss their assessments.

    Established detailed elevation grades and a 38-foot roadway width for East Nellie Street, mapping out future development or improvements for the area.

November 01, 1917: The Council was called to order by the Mayor: Roll called: Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Absent none: The minutes of the last regular and subsequent recessed meetings were read and adopted. Reports of City Officers: The Mayor laid before the Council the report of the Dog Catcher & the Public Weigher,for Sept 1917, and that of the Supt of the Water & Light Plant for the month of Sept 1917, which were read and ordered filed: The Mayor laid before the Council a resolution ordering the improvement of a certain part of 5th street,in the City of Austin, and approving specification proposal ,contract and bond therefor, which had been read the first time on the 25th of October 1917, and laid over for one week. The resolution was read and adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none: Councilman Powell presented the following report of the City Engineer: Austin, Texas 1 Nov 1917: Report of the City Engineer as to paving assessment on West 5th street between the west property line of Colorado street and the east curb line of Lavacca street. To the Hon Mayor and City Council . City of Austin, Texas. Gentlemen : Report of City Engineer 5th st. Paving I herewith submit to you my report as to improvements on West 5th street from the west property line of Colorado street to the curb line of Lavacca street, as follows, To wit: I estimate the total cost of the said improvements ,in accordance with the contract and specifications t erefor,at the sum of $ 4,251.78. The above estimate includes all excavations,curbs, rebuilding of curbs,drain-age system and the cost of, Concrete Paving. I estimate the total cost of said improvements ( not including the cost of curb,which is 35 cents per lineal foot) to owners of the abutting property per front foot at $ 6.8933. The above estimate ($ 6.8933)includes excavation on the roadways to the depth of the pavement,(7") - this being the thickness of the Bithulithic pavement, including concrete base.additional excavation to be done by the City. Other data is as follows:- Width of roadway 60 feet Each abutter to pay for the curband ½ the cost of paving the street in front of his property. Whereas, the City Council of the City of Austin,Texas, has heretofore determine to improve west 5th street ,from the west property line of Colorado street to the east curb line of Lavacca street ,in the City of Austin, Texas, by paving the same with standard Bitulithic pavement upon gravel concrete foundation with concrete gutters along curb lines and necessary excavation ,and has adopted specifications for said work and has entered into a contract for the same with the Texas Bitulithic Company a Corporation ; and Whereas, the City Engineer of the City of Austin,Texas, has this day filed his report in writingwith the City Council,showing the total cost of the said improvements upon the said street ,the amount per front foot of abutting property to be paid by the owners thereof and also the names of persons,estates or corporations owning property abutting on said improvements ,with a description of their property and a statement of the total amount payable byeach of said owners for said improvements ; and Whereas, the necessityexists that a portion of the cost of said improvements should be assessed against said property owners and their property,subject to the terms of the Approving as Engineer's re- port on paving w. 5th st. --- Page break --- 68 .Charter of the City of Austin and the ordinance in such cases made and provid -ded,and after the notice and hearing provided by said Charter and ordinance; Now therefore, Be it resolved by the City Council of the City of Austin, Texas : 1. That the said report of the City Engineer,be and the same is hereby approved and adopted. 2. That a portion of the cost of making the said improvements shll be assessed against said owners of property abutting on west 5th street,in this City, from the west property line of Colorado street to the east curb line of Lavacca street,in the City of Austin, Texas, and against said property, that the said assessment shall be made at the rate of $ 6.8933(not including curbing ) per front foot of such property in accordance with the front foot rule or plan,in proportion as the frontage of each owner in each block of said street, is to the whole frontage in that block to be improved, provided that if said rule of apportionment shaal appear to the City Council to be unjust or unequal in any particular case ,or to result in an assessment in excess of the benefits received through said improvement by any owner or his property ,the City Council shall adopt such rule of apportionment as shall effect substantial equality and justice between said property owners,consid-ering benefits received by and burdens imposed upon said owners, and that in no case shall any assessment be made in excess of the actual benefits received by the owner of said property throgh the enhanced value thereof by means of said improvements. 3.That a hearing shall be given before the Council to said property owners on the 15th day of November,A D 1917, at ten O'clock A M,in the City of Austin, Texas, at which hearing said property owners ,their agents or attornys shall be fully and fairly heard as to all matters concerning the said improvements or any irregularity or invalidity in the proceedings with refer-ence thereto,or as to the benefits thereof, if any, to their property,and as to the assessment proposed to be made against them and their property,and as to any other matter or thing connected therewith.At which hearing the said owners shall have the rightto produce witnesses and testimony,and which hearing shall be adjourned from time to time and from day to day until all as are fully heard and all matters in connection with the said improvements and assessment fully ascertained; that after the said hearing shall be closed, said City Council will proceed to assess against owners of property upon said street and their property,who shall agree with the said Council upon the said assessments .such sums as may be so agreed upon. and determined as provided by the Charter of the City and the said ordinance;and that as to any such property owners who may not so agree,the City Council will, after said hearig appoint a commission to determine said assessment,and will take such further steps in ascertainment thereof as are provided by the Charter and ordinance. 4. That the Supt of streets and public improvements of the said City of Austin,is hereby directed to givw notice hereof to the said property owners, their agents and attorneys by publication of a copy of this resolution not would be valid.el --- Page break --- less than twice in the Austin Statesman.a daily paper of general circulation in the City of Austin ,the first publication to be not less than five days prior to the date of hearing. 5. Mayor Wooldridge offered the following resolution : Whereas, it appears that there is a judgement in Justice M M Johnson's Court of this City against Claud D Trawick in the sum of $ 11.25,and costs amounting to $ 3.35 for sewer service appariently owing by the said Claud D Trawickon his premises at 3904 Avenue "C",Dyde Park, City of Austin, Texas, and Whereas, it appears that the said Claud D Trawick had sold said premises to one Hudson Maud on May 15th 1916, and was not liable for sewer service thereafter; and Whereas, it further appears from the statement of H B Barnhart ,Special Attorney,that the said Claud Trawick was not to be sued for sewer rentals in arrears until an apportionment of the amount owing should be made between the said Claud D Trawick and the said Hudson Maud ; and Whereas, it appears from the same statement of the said H B Barnhart, special Attorney in charge of sewer connections ,that said suit was brought in error; and Whereas, it appears that $ 5.62 is the full amount of the sewer rentals in arrears on said premises at No 3904. venue "C",Hyde Park, owning by the said Claud D Trawick, Now therefore, Be it resolved by the City Council of the City of Austin, Texas: That upon payment of $ 5.62 ,by the said Claud D Trawick,to the Cashier of the sewer department ,the judgement against the said Claud D Trawick,amounting Claude D. Trawick week - Judgment Payment for sewer Rec[illegible] --- Page break --- ,to $ 11.25, is receipted and released as against the said Claud D Traweek; and Whereas, it appearing that the suit brought in this case in error and contrary to agreement with the said Claud D Traweek, Therefore, Be it further resolved by the City Council of the City of Austin, Texas: That said costs, amounting to $ 3.35, are remitted against the said Claud D Traweek and agreed to be paid by the City of Austin, Texas.
