264 The Mayor laid before the Council the following resolution: Whereas, it is deemed desirable, especially during these war times, that all of the races of this city should cooperate with one another for the political, moral, social and physical uplift of the city; and Whereas, the colored people of this city, without reference to creed or political party, have asked to be appointed a committee to cooperate with the City Council, especially in the enforcement of the law. Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: Negro welfare Committee That the men and women named below are appointed a Welfare Committee and Advisory Board amongst the negroes of this city to cooperate with the City Council and the officials of the city, especially the Police and Charity Departments, in doing all things, short of the actual enforcement of the law itself on their part, to assist the City of Austin in its social, political, moral and physical progress and development. Said Welfare Committee and Advisory Board are asked to cooperate with the City Council in the way of making monthly reports and in the way of making frequent suggestions of the things they believe desirable to be done for the welfare of the whole city, especially the things which will help the progress, prosperity and happiness of the negro race in this community. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: 1. That the said report of the City Engineer be and the same is hereby approved and adopted. 2. That a portion of the cost of making the said improvements shall be assessed against said owners of property abutting on Sixteenth Street, in this City, from the west property line of Congress Avenue to the east property line of Lavaca Street, in the City of Austin, Texas, and against said property; that the said assessment shall be made at the rate of $3.4465 per front foot of such property in accordance with the front foot rule or plan, in proportion as the frontage of each owner in each block of said street is to the whole frontage in that block to be improved, provided that if said rule of apportionment shall appear to the City Council to be unjust or unequal in any particular case, or to result in an assessment in excess of the benefits received through said improvements by any owner or his property, the City Council shall adopt such rule of apportionment as shall effect substantial equality and justice between said property owners, considering benefits received by and burdens imposed upon said owners, and that in no case shall any assessment be made in excess of the actual benefits received by the owners of said property through the enhanced value thereof by means of said improvement. 3. That a hearing shall be given before the Council to said property owners, on the 16th day of May, A. D. 1918, at 10 o'clock A. M., at the Mayor's office in the City Hall, in the City of Austin, Texas, at which hearing said property owners, their agents or attorneys, shall be fully and fairly heard as to all matters concerning the said improvements or any irregularity or invalidity in the proceedings with reference thereto, or as to the benefits thereof, if any, to their property, and as to the assessment proposed to be made against them and their property, and as to any other matter or thing connected therewith. At which hearing the said owners shall have the right to produce witnesses and testimony, and which hearing shall be adjourned from time to time and from day to day until all are fully heard and all matters in connection with the said improvements and assessment fully ascertained; that after the said hearing shall be closed, said City Council will proceed to assess against owners of property upon said street and their property, who shall agree with said Council upon the said assessments, such sums as may be so agreed upon and determined as provided by the Charter of the City and the said ordinance; and that as to any such property owners who may not so agree, the City Council will, after said hearing, appoint a commission to determine said assessments, and will take such further steps in ascertainment thereof as are provided for by the Charter and ordinance. 4. That the Superintendent of Streets and Public Improvements of said City of Austin is hereby directed to give notice hereof to the said property owners, their agents and attorneys by publication of a copy of this resolution not less than twice in the Austin American, a daily paper of general circulation in the City of Austin, the first publication to be

Gentlemen:
I herewith submit to you my report as to improvements on Sixteenth street from the west line of Congress avenue to the east line of Lavaca street, as follows, to-wit:
I estimate the total cost of the said improvements, in accordance with the contract and specifications therefor, at the sum of $5,558.90.
The above estimate includes all excavation, curbs, rebuilding of curbs, resetting of curbs, drainage system, and the cost of paving.
I estimate the total cost of the said improvements (not including the cost of curb, which is 35 cents per lineal foot) to owners of the abutting property per front foot at $3.4465.
The above estimate ($3.4465) includes excavation on the roadways to the depth of the pavement, (7") -- this being the thickness of the Bitulithic pavement, including concrete base, ad- ditional excavation to be done by the city.
Other data is as follows:--

SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, May 4, 1918. The Council met with all members present. W. D. Patton The Mayor laid before the Council the application for public service service car car license of William Thomas Patton, 2110 Oldham street, on a 7-passenger license Cadillac touring car, No. 233440. The application was granted by a vote of 5 yeas. The Mayor offered the following resolution: RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: That Congress Avenue from Fifth to Seventh Streets, and Sixth Street Congress from Colorado to Brazos Streets, be and the same are hereby ordered to be vacated Avenue from vehicles of all sorts standing or moving thereon from 12:15 P. M. to 12:45 vacated P. M., of Sunday, May 5th, 1918. This is for the purpose of helping to celebrate the Third Liberty Loan victory for Travis County when it obtained more than its quota of the amount assessed for the county, the amount obtained approximating $1,500,000.00.
