268 W.J. Hammond on account SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, May 07, 1918. The Council met with all members present. The Mayor laid before the Council the following resolution; Whereas, it appears from the attached affidavit of W. T. Hammond that Paul O. Simms, his agent, made an error when he assessed the improvements on Lot No. 7, Block 12, Outlot 19, Division "O", at $450.00 as of the 1st of January, 1917, when as a matter of fact no improvements existed on said Lot No. 7, Block 12, Outlot 19, Division "O", of the City of Austin, Texas, on January 1st, 1917; and Whereas, it appears that W. T. Hammond in error paid to the City of Austin taxes on improvements in the amount of $9.45. Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: I. That said assessment of improvements on Lot No. 7, Block 12, Outlot 19, Division "O", in the amount of $450.00 for the year 1917 be and the same is hereby ordered to be cancelled and annulled. II. That $9.45 be and the same is hereby appropriated out of the General Contingent Fund of the City of Austin, Texas, to reimburse the said W. T. Hammond for taxes paid by him on the improve- ments hereinabove described in the amount of $450.00. The Council met with all members present. The Mayor laid before the Council the application of Roy Hough, 205 West 15th Street, for public service car license on a 7-passenger Reo car, No. 132176. The license was granted by a vote of 5 yeas, no nays. The Mayor laid before the Council the following resolution: RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: That the sum of $556.70 be and the same is hereby appropriated out of the General Contingent Fund of the City of Austin, Texas, in compensation of attorney's fees due to J. W. Maxwell for collecting delinquent taxes on personal property in this city, being the amount of taxes due the City of Austin by the Commonwealth Bonding & Casualty Insurance Company of Phoenix, Arizona, said company now being in the hands of a receiver at Fort Worth, Texas, per attached list which is made the basis of this appropriation. Said taxes being due for the years 1912, 1913 and 1915, of J.W. Maxwell Fees --- Page break --- 269 the aggregate amount of $2225.80. The percentage of same at 25c on the $1.00. the same being the contract price with the said J. W. Maxwell, is $556.70. The resolution was adopted by a vote of 5 yeas, no nays. The Mayor offered the following resolution: RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: That the sum of $81.25 be and the same is hereby appropriated out of the Jay W. Kerby General Contingent Fund of the City of Austin, Texas, in compensation of attorney's fees due to Jay W. Kerby of Fort Worth, Texas, for collecting delinquent taxes on personal property in this city, being the amount of taxes due the City of Austin by the Commonwealth Bonding & Casualty Insurance Company of Phoenix, Arizona, said company now being in the hands of a receiver at Fort Worth, Texas, per attached list which is made the basis of this appropriation. Said taxes being due for the year 1916, of the aggregate amount of $650.03. The percentage of same at 12½c on the $1.00, the same being by agreement of the City Council, is $81.25. The resolution was adopted by a vote of 5 yeas, no nays. APPROVED, May 7, 1918: A. P. Wooldridge, Mayor. The Mayor laid before the Council the following resolution: Whereas, in the case of Bacon Saunders vs. Commonwealth Bonding and Commonwealth Bonding & Casualty Co. Judgt Casualty Insurance Co., Cause No. 39861 in the District Court of Tarrant County, the City of Austin intervened in said cause to recover taxes alleged to be due by said company to said city, for the years 1912, 1913, 1915 and 1916; and Whereas, on the trial of said suit (or intervention) the court gave judgment in favor of the said city for the amount of the net taxes, to-wit: For the year 1912 . . . . . . . . . . . $665.34 " " " 1913 . . . . . . . . . . . 736.17 " " " 1915 . . . . . . . . . . . 825.29 " " " 1916 . . . . . . . . . . . 650.03 a total of . . . . . . . . . . . . . . $2876.83 but refused to give judgment of interest and penalties, due on said taxes, but ordered the receiver, J. W. Mitchell, to issue a voucher to said City of Austin for the amount of said taxes, and not for penalties and interests; Be it therefore resolved that the Tax Collector of the City of Austin be and he is hereby authorized and directed to apply the sums aforesaid for the respective years herein named, and to balance the accounts for said years.
