12 SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, June 17, 1918. The Council met with all members present. Councilman Anthony submitted the resignations of Ben Green and L. J. Touchstone as hosemen in the Fire Department, which resignations were accepted by a vote of 5 yeas. Mr. Anthony then nominated E. L. Lockwood and W. W. Johnston to fill the two vacancies as hosemen. The nominations were confirmed by the following vote: Yeas, Mayor Wooldridge, Councilmen Bartholomew, Haynes, and Powell, 4; Councilman Anthony not voting. The Council then adjourned. V. S. Martin City Clerk SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, June 18, 1918. The Council met with all members present. After the Council had heard a statement by W. H. Stacy, representing the Citizens Loan and Investment Company of Austin, the Mayor offered the following resolution: Whereas, on the 19th day of July, 1913, the Citizens Loan and Investment Company of the City of Austin, Texas, entered into a contract with the City of Austin, Texas, for the construction of a system of water mains to and through Travis Heights in said City of Austin, Texas, under the terms of which contract, amongst other things, the said Citizens Loan and Investment Company agreed to deposit with the City of Austin, Texas, a sum equal to one-sixth of the total cost of said water mains and was to do certain other things as stipulated in said contract, especially guaranteeing a certain income to the City of Austin from said water mains laid into Travis Heights; and Whereas the City of Austin in said contract agreed that when a total bona fide gross income of 15% of the cost of the construction of said water mains into Travis Heights was realized from the use of said water mains to said City of Austin then the guarantees of said Citizens Loan and Investment Company should cease; and Whereas, said gross income on the total cost of said mains into Travis Heights is now substantially realized, Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: 1. That the guarantees called for in said contract be and the same are now hereby waived and released. 2. That the one-sixth part of the total cost of said water mains and the laying of said water mains into Travis Heights, amounting to $893.65, be and the same is hereby ordered to be refunded to the said Citizens Loan and Investment Company. 3. That the sum of $893.65 be and the same is hereby appropriated out of the surplus funds of the Water and Light Department of the City of Austin, Texas, as a refund to the said Citizens Loan and Investment Company of the City of Austin, Texas, of the amount deposited by said Citizens Loan and Investment Company as a guarantee under its contract with the City of Austin, Texas, dated July 19th, 1913. The resolution was adopted by the following vote: Yeas, Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes, and Powell, 5; nays none. APPROVED, June 18, 1918: A. P. Wooldridge, Mayor.
