84 entire contract was the lowest and best bid and also lower by 5 per cent upon the work called for in said Unit "D" of the specifications for said contract. Now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: That said contract to build the sanitary sewage disposal works of this city be and the same is awarded and let in its entirety upon the price of cost plus 10 per cent, except as to Unit "D" where the commission is to be 5 per cent, to said firm of Potts, Moore and Prentice, who, however, are to expressly stipulate in their contract with this city that their commission is only to be charged upon work actually done and material furnished to the city and that the city has the right to change, except in the most substantial parts, the details of said construction and to make substitutions, if reasonable need therefor appear, of one class of material for another, and if such substitutions are made the commissions of the said firm of Potts, Moore and Prentice are to be charged only upon the substituted work done and material supplied, and it is further stipulated that in the event the city lends or donates material, equipment or apparatus of its own suitable for use in said sewage disposal works, no commission upon said work, material, equipment or apparatus so loaned or supplied is to be charged against the city by said firm of Potts, Moore and Prentice, and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That full understanding of the parties of this contract will be finally expressed in a contract prepared for the city by the City Attorney and accepted and approved by said firm of Potts, Moore and Prentice, which contract, however, is to be along the lines of the plans and specifications offered to bidders for the construction of said sewage disposal works.
The resolution was adopted by a vote of 5 yeas, no nays. APPROVED, Oct. 31, 1918: A. P. Wooldridge, Mayor. The Council then adjourned.
