149 SPECIAL MEETING OF THE CITY COUNCIL; Austin, Texas, Feb. 7, 1919. The Council met with all members present. The City Attorney, J. Bouldin Rector, was also present. The Mayor laid before the Council the following resolution: Whereas, F. M. DuBose, I. P. Lochridge, Ben Morrall and W. R. Smith have heretofore brought suit against the City of Austin alleging damages to the certain property of said parties on account of the sewage output of the City of Austin, which suit is numbered and entitled 34650 F. M. DuBose et al vs. City of Austin, on the docket of the District Court of Travis County, Texas; and Whereas, I. P. Lochridge has heretofore brought suit against said City, alleging damages to his certain property on account of the reasons above stated, which suit is numbered and entitled 35741 I. P. Lochridge vs. City of Austin, on the docket of said court; and Whereas, Ben Morrall has heretofore brought suit against said City, alleging damages to his certain property on account of the reasons above stated, which suit is numbered and entitled 35742 Ben Morrall vs. City of Austin, on the docket of said court; and Whereas, F. M. DuBose has heretofore brought suit against said City, alleging damages to his certain property on account of the reasons above stated, which suit is numbered and entitled 35743 F. M. DuBose vs. City of Austin, on the docket of said court; and Whereas, it has been agreed by and between the attorney for said parties plaintiff and the City Attorney, that each of said suits be settled and dismissed from the docket of said court, and that such action shall be taken upon the payment to W. B. Garrett, Attorney of Record in each of said causes, by the City of Austin, of the lump sum of $200.00 in cash, and the further payment by said City of all costs incurred in all of said suits above mentioned; and Whereas, it appears that the aggregate costs of court in the above mentioned suits amount to $87.40; now therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That said settlement of said suits is hereby approved, and the sum of $287.40 is hereby appropriated out of the Sewer Fund for the purposes above stated; and that the City Clerk is instructed to issue a war- rant for $200.00, payable to W. B. Garrett, Attorney of Record, and a warrant for $87.40, payable to S. A. Philquist, District Clerk, and that said warrants be each delivered to the respective payee thereof upon delivery to the City Clerk of the proper acquittance, as prepared by the City Attorney.
The resolution was adopted by a vote of 5 yeas, no nays. APPROVED, Feb. 7, 1919: A. P. Wooldridge, Mayor.

credited $523.00 to the General Fund of the City when said credit should have been made to the General Street Fund of this City. Prim. of fund 1. Now, therefore, correct error of BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: accounting That said $523.00, erroneously credited to the account of the General Fund, be and the same is hereby transferred to the credit of the General Street Fund and the depositary of the city is instructed to make said debit and credit in accordance with this resolution. L. Dillingham at the corner of Eighth and Rio Grande Streets in this city and where his premises adjoin the premises adjoin the premises of Mrs. Lucy C. Hammond, on whose premises the tree stands the limb of which encroaches over the sidewalk of the said B. L. Dillingham. The resolution was lost by the following vote: Yeas, Mayor Wooldridge, 1; nays, Councilmen Anthony, Haynes, and Powell, 3; Councilman Bartholomew being outside the Council room when the vote was taken.
RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: That the sum of Three Thousand Dollars ($3,000.00) be and $3000.00 for U. S. the same is hereby appropriated out of the Cemetery Purchase Fund Treasury Certificates of the City of Austin, Texas, and made payable to the Citizens Bank Purchase & Trust Company of Austin, Texas, for the purchase through this bank for account of the City of Austin, of $3,000.00 worth of United States Treasury 4% Certificates of Indebtedness.
