Austin, Texas, May 29, 1919. The Council was called to order by Mayor Yett. Roll call showed all members present: Mayor Yett, Councilmen Alford, Graham, Haynes and Ward. The Minutes of the last regular meeting, May 22nd, were read and unanimously adopted. Councilman Graham moved the suspension of the regular order of business that the Ladies Committees might be heard. Motion prevailed by a vote of 5 yeas; no nays. Mrs. Dave Tobin spoke in the interest of the Child Welfare League, asking that the City pay Fifty Dollars ($50.00), or one-half the salary of Miss Cruz, the Child Welfare Nurse. Councilman Graham moved that the sum of Three Hundred and Fifty Dollars ($350.00) be appropriated for that purpose, to be paid at the rate of Fifty Dollars ($50.00) per month. Motion carried by a vote of 5 yeas; no nays. The petition of the Magnolia Petroleum Company was read and upon motion of Councilman Ward the petition was referred to the City Attorney for his opinion and report back to the Council. The motion carried by a vote of 5 yeas; no nays. Councilman Haynes moved that the unpaid balance of Five Dollars ($5.00) be remitted in each of the following numbered and styled cases: No. 13334 - -City of Austin Vs. A.B.Tomlinson; No. 13335 - - " " " " R. B. Thorp; No. 13336 - - " " " " Cal Taylor; No. 13337 - - " " " " A. J. Zilker,Jr.; No. 13338 - - " " " " J. R. Jenkins; No. 13339 - - " " " " W. G. Phillips; No. 13340 - - " " " " J. B. Millsap. Motion carried by a vote of 5 yeas; no nays. The bond of J. R. Williams was approved and ordered filed. The petition of property owners on East Sixth Street to have an alley in the rear of their properties paved was read and referred to Councilman Graham. The petition of property owners on Baylor and West Ninth Streets was read and referred to Councilman Graham for further information. The petition of Billy Ebner, asking permission to erect electric signs at certain places on Congress Avenue was read. Councilman Graham moved that the petition be granted. The motion carried by the --- Page break --- following vote: Mayor Yett, Councilmen Alford, Graham, Haynes and Ward, 5 yeas; no nays. Councilman Alford moved that one-half the fine assessed against S. L. Courtney for speeding be refunded and the City Clerk be instructed to draw warrant for one-half the amount of fine assessed. Motion carried by a vote of 5 yeas; no nays. Councilman Alford nominated Mrs. R. C. Walker for the position of Pure Food Inspector, term of service to begin June 1st, 1919. The nomination was confirmed by the following vote: Mayor Yett, Councilmen Graham, Haynes and Ward; Councilman Alford present but not voting. Councilman Alford laid the following ordinance before the Council: "An Ordinance prohibiting loitering in the parks and public grounds of the City of Austin, and prescribing a penalty for the violation thereof." The ordinance was read the first time, after which Councilman Graham moved a suspension of the Rules requiring ordinances to be read on three separate days. Motion carried by the following vote: Mayor Yett, Councilmen Alford, Graham, Haynes and Ward, 5 yeas; no nays. Thereupon the ordinance was put upon its second reading and the following vote showed upon roll call: Mayor Yett, Councilmen Alford, Graham, Haynes and Ward, 5 yeas; no nays. The ordinance was then put upon its third reading and the following vote showed upon roll call: Mayor Yett, Councilmen Alford, Graham, Haynes and Ward, 5 yeas; no nays. Councilman Haynes then moved the final passage of the ordinance. The motion prevailed by the following vote: Mayor Yett, Councilmen Alford, Graham, Haynes and Ward, 5 yeas; no nays. The City Clerk was then instructed to have the ordinance published. Motion carried by a vote of 5 yeas; no nays. The Council then recessed until 3 P. M. AFTERNOON SESSION Councilman Ward moved that the petition of the Magnolia Petroleum Company to erect a gasoline filling station at the corner of Congress Avenue and 19th Street be granted. Motion carried by the following vote: Yeas 5, nays none. The Council then adjourned. SPECIAL MEETING OF THE CITY COUNCIL. Austin, Texas, June 3, 1919. The Council was called to order by Mayor Pro tem Haynes. Roll call showed the following members present: Mayor Pro tem Haynes, Councilmen Alford and Graham; absent, Mayor Yett and Councilman Ward. A motion was made by Councilman Graham and seconded by Councilman Alford that the following resolution be adopted: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. That permission is hereby given to Gulf Refining Company to establish and maintain a gasoline filling-station on the east side of Congress Avenue, between First and Second Streets, on the premises described as forty-six feet (46') out of Lot Four (4) and forty-six feet (46') out of Lot Five (5), Block Six (6) in the City of Austin, Texas, said premises being 92' x 107', at which station said Company shall be authorized to sell to the trade gasoline, lubricating oils, greases and other products and accessories relating to said business; and said Gulf Refining Company is authorized under this permit to construct drive-ways so as to permit ingress to and egress from said premises for automobiles, trucks and other vehicles desiring to enter or leave such station, the locations of which drive-ways and the character of construction thereof shall be under the direction and supervision of the City Engineer. 2. That permission is also hereby given to said Company to install and maintain on said premises certain gasoline storage tanks, the number, capacity and specifications of which shall hereafter be determined and approved by the Superintendent of police and public safety, and said tanks and the installation thereof shall conform in all respects to all state laws and city ordinances pertinent to such matters. 3. That the grants above stated are made subject to the present and future rules, regulations and ordinances of the City of Austin, applying to or regulating auto-filling stations; and said grants are held to be made and accepted subject to all necessary, reasonable and proper present and future regulations and ordinances of said City in the enforcement of proper police, fire and traffic regulations. 4. That in accepting the above grants, said Gulf Refining Company shall agree to pay all expenses for the reconstruction of the sidewalks --- Page break --- and street in front of said premises, and all expenses incident thereto, as same shall be determined by the City Engineer, and to conform to all changes of grade and alterations in said sidewalks and street abutting upon said property, as same may hereafter be determined by the City Council and to pay all necessary expenses thereof. The Minutes of May 29th were read and adopted by the following vote: Mayor Yett, Councilmen Alford, Graham, Haynes and Ward, 5 yeas; no nays. The petition of W. L. Eyres, et al., was laid before the Council, and upon motion of Councilman Haynes was referred to Councilman Ward for his consideration and report back to the Council. Motion carried by a vote of 5 yeas; no nays. The monthly reports of the Assessor and Collector, Chief of Police, Sanitary Inspector and Sealer of Weights and Measures were read and ordered filed. The Mayor introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: That the sum of Three Hundred and Fifty Dollars ($350.00) be and the same is hereby appropriated out of the General Contingent Fund of the City of Austin, Texas, and made payable for one-half salary of the Child Welfare Nurse, said appropriation to be paid at the rate of Fifty Dollars ($50.00) per month. Resolution was adopted by a vote of 5 yeas; no nays. Upon recommendation of the Fire Chief, the petition of W. H. Richardson for permit to make certain repairs was granted by a vote of 5 yeas; no nays. The following opinion of J. Bouldin Rector, City Attorney, was laid before the City Council: Austin, Texas, June 5, 1919. Hon. J. W. Graham, Supt. Streets & Public Improvements, City. Dear Sir: I have given the drainage matter in the vicinity of 23rd and Meches Streets my careful attention, with reference to the City's duty in the premises. I beg to advise you that, generally, it is the City's duty to properly drain its streets, and in so doing not to injure the property of others.
