257 BE IT FURTHER RESOLVED: That upon the approval of said agreement by the court and the payment by the City of Austin of the sum last hereinabove stated, and the payment of all costs incurred in behalf of said suit, the City Attorney is hereby instructed to obtain proper evidences of the full settlement of said judgment, and to dismiss and terminate the appeal from said judgement which is now pending. The above resolution was adopted by a vote of 4 ayes, no nays; Councilman Ward absent. Petition of The petition of W. R. Long, et al, was read and upon motion of W.R. Long Councilman Haynes action upon same was deferred until the next regular Et.al. meeting of the City Council. Motion prevailed by a vote of 4 ayes, no nays; Councilman Ward being absent. Councilman Alford nominated Arthur Woody as a policeman. REGULAR MEETING OF THE CITY COUNCIL. Austin, Texas, September 11, 1919. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Alford, Graham, Haynes and Ward. The Minutes of the last regular meeting were read, and upon motion of Councilman Haynes, were adopted by the following vote: Ayes, Mayor Yett, Councilmen Alford, Graham, Haynes and Ward; 5 - nays none. B. + H. Smilte The petition of Mrs. Mary Blinks, et al., complaining of the Pierce Pierce Oil Oil Corporation properties near the I&GN Railroad Bridge, was laid before Corporation the Council, and upon motion of Councilman Haynes that the Fire Chief [illegible] and Fire Marshal be instructed to examine conditions on the premises referred to above and report back to Council at its next regular meeting; said motion carried by a vote of 5 ayes, no nays. The regular order of business was suspended and Judge King was E.H. Smith heard in the matter of planting pecan trees. appointed Councilman Alford, upon the recommendation of C. L. Woodward, Chief [illegible] of the Fire Department, nominated Edward H. Smith to be Ladderman for Hook & Ladder Truck Company No.1 and Henry L. Oertli, Jr., to be Hoseman for Hose Company No. 4. Above nominations were confirmed by a vote of 4 ayes; Mayor Yett, Councilmen Graham, Haynes and Ward; nays none - Councilman Alford present, but not voting. Resignations of The resignations of Lewis Mayfield and Miguel Oyervides as Lewis Mayfield Patrolmen of the City Police Force were accepted by the following vote: Miguel Oyervides Ayes, Mayor Yett, Councilmen Alford, Graham, Haynes and Ward; nays none. S.E. Loney Councilman Alford nominated Shirley E. Loney for appointment as a appointed Patrolmam in the Police Department of the City of Austin. Councilman Haynes introduced the following resolution: WHEREAS, it is made imperative, by request of the State Health authorities, for the City to condemn and prohibit surface closets and cess-pools in certain districts in West Austin which drain on the sand beaches containing the filtering trenches of the water supply of the water supply of the City; and WHEREAS, there are many properties in said district not now on the sewer mains of the City and cannot therefore be connected at this time, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That where the owners of such properties shall install an approved chemical toilet and operate the same, they will not be prosecuted, and the City hereby agrees with such parties that whenever connections of such properties can be made to the sanitary sewers of the City, that the owners thereof will be allowed credit on sewer charges for the cost of such approved chemical toilet which they may now install. The above resolution was adopted by a vote of 5 ayes; no nays. Councilman Haynes moved that Mayor W. D. Yett, Councilman J. W. Graham, City Attorney, J. Bouldin Rector, and City Engineer, C. E. Leonard, be appointed on a committee to confer with Governor W. P. Hobby and the Superintendent of State Buildings and Grounds, with the view of arranging rates for sewerage for all State Institutions. Motion carried by a vote of 5 ayes; no nays. The monthly reports of Miss Dorsey Spiller, City Public Health Nurse, Jas. H. Maxwell, Inspector of Weights and Measures, J. A. Warren, Cashier and Bookkeeper of Sewer Earnings Fund and Street Department, Dr. A. A. Biebel, Meat and Dairy Inspector, C. L. Woodward, Chief of Fire Department, and Jno. E. Woody, City Fire Marshal, were read and ordered filed. The Council then recessed until 2:30 P. M. AFTERNOON SESSION Councilman Haynes introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Mayor be and he is hereby authorized and directed, in behalf of the City of Austin, to enter into an agreement of lease with L. M. Layton, agent of Fanny A. Dupuy, for a term of two years, at an annual rental of $60.00, of the certain tract of land hereinafter described, for the purposes of using said tract of land as a place to deposit the garbage, trash and refuse of the City, said tract of land being out of the Southwest corner of Lot No. 3F of the Swisher Addition to the City of Austin, according to the plat of said city, beginning at the Southwest corner of said Lot 3F, thence North 20° 15' East with the West line of said lot 495 feet to an iron stake for the Northwest corner of this survey, thence at a right angle and with a bearing of South 69°45' East for a distance of 120 feet to an iron stake for the Northwest corner of this survey, thence South 20°15' West and parallel Surface Closets Rates for Sewer Pending Committee Appointed to confer with Gov. W. P. Hobby et al. Officers' Monthly Reports. Lease with L. M. Layton --- Page break --- 259 with the West line of said lot for a distance of 555 feet to the South line of said lot, and being also the North line of a public road, and thence North 47° 15' West with the South line of said lot and along the north line of said public road for a distance of 131 feet to the place of beginning, said survey containing 1-45/100 acres of land, more or less, BE IT FURTHER RESOLVED: That the sum of $60.00 be and the same is hereby appropriated out of the General Contingent Fund of the City of Austin, for the purpose above stated, and the City Clerk is instructed to issue the warrant of the City for said amount, payable to said L. REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, September 18, 1919. The Council was called to order by the Mayor. The Minutes of the last meeting were read, and , upon motion of Councilman Ward, were adopted by a vote of 5 ayes, no nays. The application of James Ryones to operate a service car was granted by the following vote: Mayor Yett, Councilmen Alford, Graham, Haynes and Ward, 5 ayes; no nays. Jas. Ryones.. Granted. Permit to Operate Service Car. Report of J.W. Graham. Petition of S.B. Roberdeau, Tower Light Declined. The report of J. W. Graham, Councilman and Superintendent of Streets and Public Improvements, was read and ordered filed. The Mayor laid before the Council the petition of S. B. Roberdeau, et al., asking that the tower light at the corner of West Ninth Street and Guadalupe Street be removed , and the protest of W. L. Gilfillan, et al., against the removal of same. Councilman Haynes introduced the following resolution: In view of the large number of petitioners protesting against the removal of the tower light at the corner of West Ninth and Guadalupe Street and the fact that the Council considers said tower in a very necessary position in its lighting system, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the petition for the removal of said tower is respectfully declined. On motion of Councilman Alford, duly seconded by Councilman Ward, the resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Alford, Graham, Haynes and Ward. Nays, none.
