259 with the West line of said lot for a distance of 555 feet to the South line of said lot, and being also the north line of a public road, and thence North 47° 15' West with the South line of said lot and along the north line of said public road for a distance of 131 feet to the place of beginning, said survey containing 1-45/100 acres of land, more or less, BE IT FURTHER RESOLVED: That the sum of $60.00 be and the same is hereby appropriated out of the General Contingent Fund of the City of Austin, for the purpose above stated, and the City Clerk is instructed to issue the warrant of the City for said amount, payable to said L. The minutes of the last meeting were read, and, upon motion of Councilman Ward, were adopted by a vote of 5 ayes, no nays. Jas. The report of J. W. Graham, Councilman and Superintendent of Streets Report of and Public Improvements, was read and ordered filed. J. W. Graham. The Mayor laid before the Council the petition of S. H. Roberdeau, et al., asking that the tower light at the corner of West Ninth Street Petition of and Guadalupe Street be removed, and the protest of W. L. Gilfillan, et al., S. H. Roberdeau, against the removal of same. Tower Light Councilman Haynes introduced the following resolution: Declined. In view of the large number of petitioners protesting against the removal of the tower light at the corner of West Ninth and Guadalupe Street and the fact that the Council considers said tower in a very necessary position in its lighting system, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the petition for the removal of said tower is respectfully declined. On motion of Councilman Alford, duly seconded by Councilman Ward, the resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Alford, Graham, Haynes and Ward. Nays, none. the Dam, it has been suggested that West Sixth Street at a point just east of the International & Great Northern Railroad Bridge should be materially widened in order to make safe the traffic at that point. Myself and associates are the owners of the premises on the south side of West Sixth Street and just east of the International & Great Northern Railroad Bridge, such premises being known as R. Niles Graham's Subdivision No. 2 of a part of the Geo. W. Spear League. "Should the City Council desire to so widen said street at said point, I am willing to convey to the City for street purposes such portion of Lot No. 1 of said Subdivision as may be necessary to conform to the plan which may be adopted, provided that, in consideration of such conveyance, the City will cut a sidewalk along the north side of said Subdivision No. 2, at the proper height above the street level to a point on the east where further excavation is not necessary; all soil so excavated for said street widening and sidewalk purposes to be placed in the street running between R. Niles Graham's Subdivisions Nos. 1 and 2, so as to level said street, in so far as same can be done with the material derived from such excavation. Respectfully submitted, (Sgd) R. Niles Graham". Councilman Graham introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the proposition of R. Niles Graham, this day submitted in writing to the City Council, to convey to the City, for the purpose of widening the abutting street, such portion of Lot No. 1 of the R. Niles Graham Subdivision No. 2 of a part of the Geo. W. Spear League in the City of Austin, Texas, in consideration that the City will cut a sidewalk along the north side of said Subdivision at the proper height above the street level to a point on the east where further excavation is not necessary and that all soil so excavated for said street widening and sidewalk purposes be placed in the street running between R. Niles Graham's Subdivisions Nos. 1 and 2 so as to level said street, be and the same is hereby accepted, and the Superintendent of Streets and Public Improvements is instructed to so notify said R. Niles Graham and to request that he deliver to the City a deed conveying that portion of said Lot No. 1 that may be determined to be necessary for such street widening by the City Engineer. Upon motion of Councilman Haynes, seconded by Councilman Alford, the above resolution was adopted by the following vote: Mayor Yett, Councilmen Alford, Graham, Haynes and Ward. The Council then recessed until 2:30 P. M. AFTERNOON SESSION: Councilman Haynes introduced the following ordinance: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Article 270, Chapter 111 of the Revised Ordinances of the City of Austin be and the same is hereby amended so as to hereafter read as follows, to-wit: Article 270. of this City, to burn any shavings or other combustible matter, or to light or cause to be lighted or made, any fire in any street, alley, square, thoroughfare, public or private place, outside of any building; or to build, light, or make any fire, deposit any ashes or hot embers, or to do anything on any premises liable to cause fire in the surrounding buildings, or cause or authorize the same to be done; or to carry, or cause to be carried in any public place any fire, burning coals or brand unless the Fines Ordinance Amendment same be shut up in a covered vessel; or to carry or cause to be carried in any place containing hay, straw, shavings, or other combustible material any lighted candle or brand, unless the same be securely enclosed against all accidents; provided, however, that such refuse, including weeds, grass or brush may be burned only on a permit from and under the supervision of the Chief of the Fire Department or the Fire Marshal. The ordinance was read the first time, and upon motion of Councilman Alford that the rule be suspended and the ordinance be placed on its second reading; said motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Alford, Graham, Haynes and Ward; nays, none. The ordinance was then read the second time and Councilman Alford moved a further suspension of the rule and asked that same be placed on its third reading and final passage.
