362 The application of Damacio Renteria to operate a service car was granted by the following vote: Ayes, Mayor Yett, Councilmen `Alford, Graham, Haynes and Ward, 5; nayes, none. The Council then adjourned. Jas. L. Hart City Clerk REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, August 5, 1920. The Council was called to order by the Mayor Pro tem. Roll call showed the following members present: Mayor Pro tem H. L. Haynes, Councilmen Alford, Graham and Ward; 4, absent, Mayor Yett. The Minutes of the last meeting were read and upon motion of G. L. Graham Graham Councilman Graham were adopted by the following vote: Ayes, Mayor Pro tem H. L. Haynes, Councilmen Alford, Graham and Ward, 4; nayes, none, Mayor Yett absent. The claim of R. J. Wallace for one horse was read and upon motion of Councilman Ward same was referred to the City Attorney and City Engineer, by the following vote: Ayes, Mayor Pro tem H. L. Haynes, Councilmen Alford, Graham and Ward, 4; nayes, none; absent, Mayor Yett. The expense account of C. L. Woodward, Chief of the Fire Department, was read and Councilman Ward moved that the same be allowed. Motion carried by the following vote: Ayes, Mayor Pro tem H. L. Haynes, Councilmen Alford, Graham and Ward; 4, nayes, none, Mayor Yett absent. C. L. Woodward Chief F. D. Councilman Alford moved that the Street Department be instructed to remove the limbs extending from the oak tree growing on the property of Mrs. Robert J. Hammond on West 8th Street. Motion carried by the following vote: Mayor Pro tem Haynes, Councilmen Alford, Graham and Ward, 4; nayes, none, absent, Mayor Yett. The following monthly reports were read and ordered filed: Fred Sterzing, Assessor and Collector; A. S. Anderson, Public Weigher; James H. Maxwell, Sealer of Weights and Measures; Mrs. R. C. Walker, Pure Food Inspector; Dr. C. H. Brownlee, City Health Officer; J. D. Platt, Chief of Police, and J. D. Copeland, Chief of Police Pro tem; Mr. A. A. Biebel, Meat and Dairy Inspector. Mayor Pro tem Haynes introduced the following ordinance: "AN ORDINANCE AMENDING SECTION I OF AN ORDINANCE ENTITLED 'AN ORDINANCE REGULATING AND FIXING FARES WHICH MAY BE CHARGED BY PERSONS, FIRMS AND CORPORATIONS OPERATING STREET RAILWAYS FOR THE CARRYING OF PASSENGERS IN THE CITY OF AUSTIN, AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH', PASSED AND APPROVED MAY 20, 1920." H. L. Haynes J. D. Ward The ordinance was read the first time and Councilman Ward moved --- Page break --- 363 that the rule be suspended and the ordinance be placed on its second reading. Motion carried by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Alford, Graham and Ward, 4; nayes, none, Mayor Yett absent. The ordinance was read the second time and Councilman Ward moved a further suspension of the rule and the placing of the ordinance on its third reading and final passage. Motion carried by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Alford, Graham, and Ward, 4; nayes, none, Mayor Yett absent. The ordinance was then placed on its third reading and final passage, by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Alford, Graham and Ward, 4; nayes, none, Mayor Yett absent. The Council then recessed. SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, August 9, 1920. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Alford, Graham, Haynes and Ward, 5; absent, none. The applications of L. C. Cahill and Gus D. Riffe to operate service cars were granted by the following vote: Ayes, Mayor Yett, Council- men Alford, Graham, Haynes and Ward, 5; nayes, none. Councilman Alford introduced the following resolution: Whereas, City Marshal, J. D. Platt, and Sergeant-of-Police, George Clary, were heretofore suspended by the City Council from duty for the period of thirty days from July 10th, 1920, after a hearing of the testimony in connection with the alleged mistreatment of Douglass Childress while a prisoner in the city jail; and Whereas, there were grave differences between the testimony of the said Platt and the said Clary offered in said hearing, as to certain material facts under inquiry; and Whereas, said period of suspension is about to expire, and said officers are about to present themselves for reinstatement in their respective positions in the Police Department; and Whereas, it is the judgment of the Superintendent of Police and Public Safety that on account of the sharp contradiction in the testimony of said two officers, it will be impossible for them to hereafter co-operate in the performance of their official duties or to serve together on the police force without seriously impairing the efficiency of the entire police department, Therefore, BE IT RESOLVED BY THE CITY COUNCIL: That said J. D. Platt is hereby dismissed from the office of City Marshal and said George Clary is hereby dismissed from the position of Sergeant-of-Police, and it is so ordered.
