480 ! REGULAR MEETING OF THE CITY COUNCILI Austin, Texas, July 21, 1921. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; absent, none. The Minutes of the last meeting were read and upon motion of Councilman Haynes, were adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. The petition of F. M. Peavy and other residents of South Austin, complaining of the meetings of certain people of the Apostolic faith as a nuisance was read and referred to Councilman Copeland for investigation and correction by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. The communication of Will L. Vining, asking that certain plot of ground of irregular shape in cemetery Annex be deeded to him, was read and upon motion of Councilman Eyres was declined by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5: nayes, none. Councilman Haynes moved that the City Attorney be instructed to take up the matter of the occupancy by the Lone Star Ice Campany of the River Walk property with the Attorney General and the Board of Control. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen copeland, Eyres, Haynes and Searight, 5; nayes, none. The following communication from Rollen J. Windrow, State Highway Engineer, was read and ordered recorded: "Austin, Texas, July 13,1921. i TO COUNTY AND CITY OFFICIALS: Gentlemen: At the last meeting of the State Highway Commission it was decided that the counties and cities leasing trucks from this department would not be required to pay additional yearly rental which became due July lat. However, it should be understood by all concerned that this is the only part of the lease agreement which you have signed that is to be changed and that the counties or cities are responsible to this department for the trucks which you have leased from us and that until unserviceable lease agreements have been given you by this department covering trucks, that you will be held responsible for the care and upkeep of said trucks If the trucks or other equipment becomes unserviceable thru fair wear and tear, it is requested that you immediately send to us affidavit by mechanic in duplicate, listing the reasons why equipment should be declared unserviceable, giving parts broken, missing . and parts required to place equipment in serviceable condition. When the affidavit statement is received by this department, we will at once investigate and if equipment is found to be unserviceable we will forward to you within sixty days a new agreement known as "Unserviceable Lease Agreement". This agreement transfers the title of all unserviceable equipment to the county or city and will allow you to sell or dispose of equipment for the best st interest of the county or city. When any additional trucks are received from this department, the county or city will be required to pay one year's rental in advance upon each truck, but after the first charge no additional charges for rental will be made. Upon the recommendation of Robert Rockwood, City Fire Marshal, the application of the Patton Auto Livery & Transfer Company to build a one story iron-clad garage in the rear of #407-09-11 Congress Avenue, Councilman Copeland moved that same be granted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. Upon the recommendation of. Sam D. Griffin, Chief of Police, Councilman Copeland nominated Abe Anderson as special policeman at East Avenue and Sixth Street, and C. W. Barker as special policeman to assist in the enforcement of the traffic laws. Nominations were confirmed by the following vote: Ayes, Mayor Yett, Councilmen Eyres, Haynes and Searight, 4; nayes, none, Councilman Copeland not voting. The application of Isaiah Owens to operate as a service car, Buick #181272 was granted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Seright, 5; nayes, none. Counoilman Searight introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of $40.75 be and the same is hereby ordered transferred from the General Street Fund to the Sewer Earnings Fund to reimburse the Earnings Fund this amount erroneously drawn. The above resolution was adopted by the following vote: Ayes, May or Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5;; nayes, none. The following ordinance was read the second time and laid over until the next regular meeting: "An Ordinance regulating the placing, storage, or repair of automobiles and other things on the streets, alleys, and sidewalks of the City of Austin; prohibiting the use of such streets alleys, and sidewalks for garage shop and storage purposes; and prescribing penalties for the violation of such ordinance," filed. The monthly report of W. A. Alff, City Sexton, was read and ordered The Council then recessed, 1 SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, July 26, 1921. The Council was called to order by the Mayor. Koll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; absent, none. A. C. Upleger of the firm of Upleger & Falk appeared before the Council and presented a report of their audit of the city's books. After a discussion of the same at some length, Councilman Haynes moved that the report be accepted and that Upleger & Falk be paid the sum of One Thousand Dollars ($1,000.00) as per contract, and One Hundred Dollars ($100.00) as an additional expense for an audit of the Water and Light Department's books from January 1st, 1919, to May 1st, 1919, as heretofore agreed to by the Council, such amount to be paid out of the Earnings Fund of the water an d Light Department. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. 481
