Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; absent, none. The report of the Board of Equalization was presented and read, and Councilman Haynes moved that the report be received and filed, and that the thanks of the City Council be extended to the members of said Board for their earnest and unselfish work. I have the honor to report that the Board of Equalization adjourned their sessions on December 14, 1921, and has filed with me their returns of the changes made in the values of property for the year 1921, and I find the following as an approximate value of the total valuations of Real Estate and Personal Property for said year 1921, being a grand total of $33.989,529.00. The 1920 tax rolls show an aggregate total value of $26,777,693.00showing an increase for the year 1921 of $7,211,836.00 over 1920. The tax rolls of 1921 will be rushed to completion as fast as can be done. The above is only an approximate total value at this time and which may show some difference one way or the other when rolls are actually and carefully added and completed. Councilman Searight introduced the following resolution: RESOLUTION AUTHORIZING THE RELOCATION OF EMERSON STREET IN OUTLOT 44, DIVISION "B", CITY OF AUSTIN, TEXAS. Whereas, on or about the 28th day of October, 1914, the City Engineer did survey certain lots, namely, Lote Nos. 1, 2 and 3, Block No. 10, Gammel and Taylor's Subdivision, Outlot No. 44, Division "B", for one Wm. Ulit, according to records on file in the office of the City Engineer; and Whereas, in making the survey the engineer placed an iron stake at the intersection of the north line of Hawthorn and the west line of Comal Streets, said stake not defining any definite corner but being placed only for the convenience of the engineer doing the surveying, and said stake, together with the proper corners of Lots Nos. 1, 2 and 3, as above described, were left where driven; and WHEREAS, said Wm. Ulit, not knowing the difference between stake placed at the intersection of the north line of Hawthorn and Comal Streets and the stake placed for the southeast corner of Lot No. 3 of property as heretofore described, and thinking that the stake placed at the intersection of the streets was placed there to define the southeast corner of Lot No. 3 did then construct and move a house on land that he thought was his lot or property; and WHEREAS, under said misapprehension the said Wm. Ulit did move and construct the house across and upon what should be the north end of Emerson Street; also said Wm. Ulit did plan and open a street of the correct width across a part of and abutting his property at what he thought was the location as staked by the engineer; and WHEREAS, said Wm. Ulit owns all abutting property on said street in i ! question and has laid out a street of the same width and which will in every way serve the public in the same way as the correct location of Emerson Street would have served, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Mayor be authorized to receive, in behalf of the City, a deed from said Wm.. Ulit covering the area set aside as the new location of Emerson Street and further that the Council authorize the Mayor to execute a deed to Wm. Ulit of that portion of the original part of Emerson street as is now occupied by the Ulit property. The field notes and instruments of transfer to be passed upon and approved by the City Engineer and the City Attorney, and BE IT FURTHER RESOLVED: That when all transfers have been properly executed that the City Engineer file in the office of the County Clerk a plat showing the new location of Emerson Street, together with the abutting property. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Bearight, 5; nayes, none. The monthly reports of W. A. Alff, City Sexton, Jas. H. Maxwell Sealer of Weights and Measures, and C. L. Woodward, Chief of the Fire Department, were read and ordered filed. The Mayor introduced the following resolution: WHEREAS, it is desirable that the City of Austin arrange for better fire alarm facilities; and : WHEREAS, the Southwestern Bell Telephone Company has proposed for such purposes to install and maintain a private telephone line connecting the various fire stations as same now exist, for the annual rental of $470.00, payable in equal monthly installments in advance, and for additional circuits and telephone equipment at the rate of $7.50 per quarter mile or fraction thereof per circuit per annum, for $10.00 per annum for each set of telephone instruments and equipment; and WHEREAS, said Company has tendered to the City duplicate drafts of a contract to carry into effect such proposal, which proposed contract is satisfactory in all particulars to the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: . That the Mayor be and he is hereby authorized and instructed to execute such contract in duplicate on behalf of the city and to deliver a copy thereof to said company, retaining the other copy for the files of the city. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmer. Copeland, Eyres, Haynes and Searight, 5; nayes, none. Councilman Eyres moved that all bids for lignite received 583 584 : December 8, 1921, be rejected and that new bids for one-half the city's deeds up to May 19, 1922, be called for. Biebel, Meat and Dairy Inspector, for the month of November was read and ordered filed. Upon the recommendation of Sam D. Griffin, Chief of Police, Councilman Copeland nominated T. P. Young as special policeman with duties as a merchant police. Nomination was confirmed by the following vote: Ayes, Mayor Yett, Councilmen Eyres, Haynes and Searight, 43; nayes, none, Councilman Copeland not voting. Councilman Haynes introduced the following resolution: Whereas, on December 23, 1921, City Warrant #3695 was issued to D. B. Gracy, City Treasurer of the City of Austin, for $10,250.00, for the payment of three certain Sewer Certificates, Nos. 25, 26 and 27, each in the principal amount of $3,333.33-1/3, together with accrued interest thereon to January 1st, 1921, the amount of said Warrant to be paid out of the Earnings Fund of the Water and Light Department of the City of Austin; and Whereas, for reasons deemed good and sufficient by the City Council, it has been determined for the present to pay said amount for said account out of the Interest and Sinking Fund of the City; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the warrant above mentioned and described be recalled from the hands
