16 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, May 19, 1922. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; absent, none. The Minutes of the last regular meeting Thursday, May 11th, were read and upon motion of Councilman Copeland were adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; пауев, пone. The following certificate was read and ordered filed, by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none: "Austin, Texas, May 18,1922, Hons. W. D. Yett, Mayor, H, L. Haynes, W. L. Eyres, Geo, P. Searight, and J. D. Copeland, Councilmen. Austin, Texas. Gentlemen: I beg to present herewith my certificate as required by Article 9 of the Charter of the City of Austin: STATE OF TEXAS COUNTY OF TRAVIS | CITY OF AUSTIN, 1 0 I, Joe Hornsby, City Clerk of the City of Austin, do hereby certify that I have carefully examined the petition as presented to your Honorable Body by Messrs. John A. Gracy, Geo. S. Nalle, G. M. Shipe and Walter Bremond on May 4, 1922, asking that you enact into law as an ordinance of the City Council of Austin, Texas, the following ordinance, to-wit: "AN ORDINANCE FIXING AND LEVYING MUNICIPAL TAXES FOR THE CITY OF AUSTIN, TEXAS, FOR THE YEAR A. D. 1921, REPEALING A PRIOR ORDINANCE ON SAME SUBJECT AND FIXING PENALTY FOR NON-PAYMENT OF TAXES." I beg to state that I have carefully checked the said petition and I find that it contains two thousand, three hundred and twenty-four (2324) names of persons who have procured either exemption certificates or pol1 tax receipts as appears on the certified poll lists of J. R. Williams, Tax Collector of Travis County, Texas, for the year 1921, and that same contains one thousand and forty-nine (1049) defective signatures. I further find that said petition contains numerous duplications of names, illegible names and, in numerous instances, what appears to be more than one name in the same handwriting, notwithstanding affidavits were made as to the genuineness of each signature on said petition. Respectfully submitted, (Sgd) Joe Hornsby, City Clerk." Councilman Haynes introduced the following resolution: Whereas, J. C. Caps and Theo. P. Meyer, per sworn affidavit of Theo. P. Meyer hereto attached, certify that the rendition of the Austin Ice Cream Company and the Alamo Industries of Austin for taxes of 1921 includes the same property as explained in said affidavit, and that the rendition for the Alamo Industries was in error and constitutes a double assessment. Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That in order to correct the error, the Assessor and Collector is hereby instructed to cancel the assessment of the Alamo Industries on his rolls for 1921 taxes and to take credit for amount of said tax. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. Councilman Haynes introduced the following resolution: Whereas, W. A. Achilles makes affidavit (attached herewith) that in making rendition for W. A. Achilles & Company for merchandise for taxes of 1921, the merchandise carried by the A. B. Company (Owned by W. A. Achilles & Company) was included in said rendition, and that subsequently, he unthoughtedly rendered the Assessor and Collector the merchandise of the A. B. Company, making a double assessment of said stock for $1000.00, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby instructed to cancel the last named assessment on his rolls for 1921, and to take credit for the amount. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. Councilman Eyres introduced the following resolution: That the sum of One Hundred Eighty-five Dollars ($185.00) be and the same is hereby appropriated out of the Cemetery Purchase and Improvement Fund for the purchase from C. T. Rather of Lot 8, Section "A", Oakwood Annex to the city cemetery, and the City Clerk is hereby instructed to issue a warrant for said amount, payable to the said C. T. Rather and to deliver said warrant upon the delivery to the City Clerk of a deed to the city by said Rather to said property. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. Upon the recommendation of C. L. Woodward, Councilman Copeland nominated J. H. Platt for appointment as hoseman in Engine Company #1 to succeed Jessie Reece resigned. Nomination was confirmed by the following vote: Ayes, Mayor Yett, Councilmen Eyres, Haynes and Searight, 4; nayes, none, Councilman Copeland present but not voting. The Council then adjourned.
