40 condition and should be permanently repaired, it being the opinion of the City Council that such improvements will increase the revenue from said resort; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of One Thousand Dollars ($1,000.00) be and the same is hereby transferred from the Earnings Fund of the Water, Light and Power Department to the Street Department for the purpose of paying for a bituminous surface of the roadway leading to Barton Springs within the city limits. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes; Councilman Eyres. Councilman Searight moved that Councilman Eyres be instructed to ask for bids on a 5000 KW Steam Turbine. Jous formsby City Cerk REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, August 3, 1922. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres and Haynев, 4; absent, Councilman Searight. A committee of citizens living in lower Fast Austin appeared before the Council and protested against the erection of an abattoir in that locality. Action thereon was postponed. Chamber. Councilman Searight and City Attorney Rector then entered the Council Judge C. A. Wilcox addressed the Council relative to damage to property of D. A, Bush in the neighborhood of the Sewage Disposal Plant. The matter was taken under advisement. A large committee of members of all civic clubs then appeared before the Council, asking that some means be devised whereby a loan could be made by the Water and Light Department to the Barton Springs Earnings Fund, out of which needed improvements could be made at the resort. The matter was referred to Councilman Eyres and City Attorney Rector with instructions to prepare an ordinance covering such an arrangement. AFTERNOON SESSION The application of Harry Lott & Son to erect a filling station at 708 Red River Street was referred to the Safety Committee by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. ! Councilman Copeland introduced the following resolution: WHEREAS, the Superintendent of Police & Public Safety, acting under authority of City Council, has heretofore contracted with John L. Martin for certain materials and labor, in connection with the installation of an X-Ray machine and other equipment for the City Hospital, amounting to the sum of $119,60, as shown by the various invoices attached to statement dated July 14, 1922, and said materials and labor have been furnished to the city for such purposes; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of $119.60 be and the same is hereby appropriated out of the City Hospital Bond Fund for the purpose of paying said John L. Martin as aforesaid, and the City Clerk is hereby instructed to draw a warrant for said amount, payable to the order of said John L. Martin, in full payment for said materials and labor as contained in said invoices. Upon motion of Councilman Searight, the above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Tyres, Haynes and Searight, 5; nayes, none. Councilman Copeland introduced the following resolution: WHEREAS, the Superintendent of Police and Public Safety, acting under authority of the City Council, has heretofore contracted with Merchant's Transfer to haul certain equipment to be used in the City Hospital from the various railroad stations to the City Hospital, and in accordance with said agreement said Merchant's Transfer has hauled said equipment for said purpose, and has submitted its bill for such services to the City of Austin, amounting to $112.99; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of $112.99 be and the same is hereby appropriated out of the City Hospital Bond Fund for the purpose of paying said Merchant's Transfer for said service, and the City Clerk is hereby instructed to draw a warrant for said amount, payable to the order of said Merchant's Transfer in full payment for said services, as per its account presented to the City of Austin. Upon motion of Councilman Searight, the above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 15; nayes, none. Councilman Searight moved that Councilman Copeland be instructed to purchase laboratory apparatus for the City Hospital, amounting to approximately $1,500.00. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Bearight, 5; nayes, none. Councilman Haynes introduced the following resolution: WHEREAS, Lot 15, Block 2, Outlot 63, Division "D", Brown's Addition, City of Austin, was heretofore assessed for taxes for the year 1913 in the name of Christian Science Society, which Society had purchased said property in February, 1913, and had used same for the rest of said year exclusively for religious purposes; and WHEREAS, on November 11, 1922, the Second Church of Christ Scientist, which has succeeded to the ownership of said property, paid, under protest, the taxes for said year 1913 on said property, said taxes amounting to $32.08 and the interest thereon to $15.04 and the penalty thereon to $1.60; and WHEREAS, for reasons deemed sufficient to the City Council, it is advisable i to refund to said Church the interest and penalty accruing on said taxes for said year, 41 42 Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That said interest and penalty, amounting in the aggregate to $16.64, be and the same are hereby refunded to the Second Church of Christ Scientist, and the City Clerk is hereby instructed to issue the warrant of the city for said amount, payable to the order of said Church. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. The reports for July of Fred Sterzing, Assessor and Collector, Sam D. Griffin, Chief of Police, Sam D. Griffin, Chief of Police, of Animals Impounded, M. R. Miller, Mechanic for Fire Department, Mrs. R. C. Walker, Pure Food Inspector, and A, S. Anderson, Public Weigher, were read and ordered filed. The report of W. L. Eyres, Superintendent of Parks and Public Property, for the Water, Light and Power Department, for the month of June was read and ordered filed, The Council then recessed, SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, August 9, 1922. The Council was called to order by the Mayor, Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Haynes and Senright, 4; absent, Councilman Eyres. Councilman Haynes moved that the Mayor be authorized to enter into a contract with J. W. Maxwell to collect by suit or otherwise delinquent taxes due on personal property not assessed in connection with real estate and all occupation taxes that have been assessed or may hereafter be assessed and become due the City of Austin for the year 1921 and all prior years, together with all penalties and interest due thereon save and except taxes that may be due on deposits with the State Treasurer of the State of Texas by corporations incorporated under the laws of the State of Texas, Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Fyres absent.
