Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; absent, none. The following bids for supplying the City of Austin with lignite for one year, beginning October 1st, 1922 were opened and read: Bastrop Lignite Coal Company; Noyes D. Smith; Belto Coal Company; Calvin Conl Company; The McAlester Fuel Company; Empire Fuel Products Corporation; Big Lump & Texas Coal Company. The above bids were referred to Councilman Eyres. The application of W. A. The application of Charlton & Crockett to install an underground tank at the corner of Fifth and Brazos Streets was read and upon motion of Councilman Searight was referred to the Safety Committee by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Fyres, Haynes and Searight, 5; nayes, none. Councilman Fyres introduced the following resolution: WHEREAS, the City of Austin is in need of engineering assistance to determine reliable information as to the future water supply of the City and its cost of construction, operation and maintenance; and WHEREAS, such information being of a technical nature, it is considered advisable that engineers of recognized stunding and reputation be employed το make a careful survey, investigation, report and plans for the needed improvements; and WHEREAS, Burns & McDonnell Engineering Company, Consulting Engineers, of Kansas City, Missouri, have submitted to the City Council a proposition to perform the certain engineering services upon the certain terms hereinafter specified in this resolution; therefore BE IT RESOLVED BY THE CITY COMINCIL OF THE CITY OF AUSTIN: That the Mayor of the City of Austin be and he is hereby authorized and instructed to enter into a certain contract with said Burns & McDonnell Engineering Company, for the purposes above stated, said contract to be substantially in the following terms and particulars, to-wit: THE STATE OF TEXAS # COUNTY OF TRAVIS This Memoranda of Contract, entered into this the 10th day of October, 1922, by and between t..e City of Austin, a municipal corporation, acting by and tarough its Mayor, W. D. Yett, and Burns & McDonnell Engineering Company, Consulting Engineer's, a firm of Kansas City, Missouri, acting by and through R. E. MeDonneil, a member of said firm, hereinafter called Engineers, witnesseth: ITEC I PRELIMINARY PLANS, ESTILATES AND REPORT 1. The said Engineers free to furnis. instruments and equipment and make all necessary surveys, levels, soundings, measurements, and make a coreful study of the geological and water-bearing formation, and collect such datu as may be necessary for the planning and designing of an adequate and suitable water supply for the present and future needs of the City of Austin, 57 58 Техив. (a) This will cover a careful examination of the existing plant, its supply lines, distribution system, pumping equipment, reservoirs and power available with a view of making a careful report as to the utilizing of the present equipment, or such parts of same as may be suitable for a more adequate supply of water and pumping plant. (b) A careful report will be made covering the Sand Beach question, Barton Springs, and other sources of supply, determining the present condition, capacity of wells and of springs, and quantity and character of water with sanitary and chemical analyses, with a view of determining the future adequacy of a water supply taken from the Sand Beach, Springs, or other sources, (c) A careful report will also be made of the question of filtration, determining its cost of construction, operation and management, with analyses of raw and filtered water from the Colorado River, with a view of determining the complete results of filtration, if the River supply is recommended. 2. The preliminary plans, estimates and report with recommendations will be presented to the City Council, and if desired the same will also be publicly presented at mass meetings of the citizens of Austin, no that the information can be clearly presented through stereopticon slides, graphical dia- grams and charts and other information, so that the voters may be able to vote intelligently on this question. The report will be accompanied by reliable estimate of cost as a basis for future bond election. The report, plans and estimates will be subject to approval of the City Council, and the calling of a bond election and selection of a source of supply will be at the full discretion of the City Council. ITEM II. FINAL PLANS AND SPECIFICATIONS 3. When the City Council has determined to make the improvements recommended, and after bonds are voted, or funds otherwise provided, for these improvements, the said Engineers agree to make all the necessary detail plans, working drawings, bills of material and detail specifications for the work, as approved and authorized by a vote of the citizens. This will cover detail drawings of such source of supply as may be adopted, such no well supply from the Sand Beach, Barton Springs, River Supply with filtration, or other source. The plans and specifications when completed will be submitted to the State Board of Health for approval and all payments for the plans and specifications will be contingent upon the approval of the naid plans and specifications by the State Board of Health and the City Council. i Included in this item will be final test and inspection, with efficiency tests of all machinery and equipment furnismed, to determine if the guarantees are met and the plans and specifications complied with. ITEM III - SUPERVISION OF CONSTRUCT CO01 4. After material arrives and work is ready for construction, the said Engineers will furnish a competent and experienced supervising engineer, wizo shall inspect material, stake out the work, and see that the plans and apecifications are complied with, make monthly estimates for the guidance of the City Council in allowing payments on the work, and perform all ordinary duties of a supervising and inspecting engineer. i . It is agreed to commence the engineoring work enumerated under the above Item I immediately after the execution of this contract, and to push the same to completion without interruption, and to complete aume within forty (40) days from date of the execution of this contract. 6. IN CONSIDERATION of the performance of all of the above engineering services, the City of Austin shall pay to Burns & McDonnell Engineering Company, Consulting Engineers, an amount equal to five percent (5%) of the total cost of the entire improvements; payments to be made as follows: Seven Hundred and Fifty Dollars ($750.00) shall be paid at the time of completion and presentation of the preliminary report, plans and estimate; an amount equal to two and one-half percent (24%) of the estimated cost of the improvements shall be paid at the time of completion of the final plans and specifications and their approval by the State Board of Health and City Council. The balance of the engineering fee shall be pro-rated in as many months as may be required for the completion of the construction work. It is agreed, however, that if the City Council does not approve the reports, plans and estimates provided for in Items I and II hereof, or does not order the bond election, or if the bonds are not voted at an authorized election, or funds otherwise provided for the said improvements, then there shall be no compensation due said Burns & McDonnell Engineering Company for said engineering services, other than the Seven Hundred and Fifty Dollars ($750.00) paid at the time of the completion of the preliminary plans, estimates and report.
