. It is agreed to commence the engineoring work enumerated under the above Item I immediately after the execution of this contract, and to push the same to completion without interruption, and to complete aume within forty (40) days from date of the execution of this contract. 6. IN CONSIDERATION of the performance of all of the above engineering services, the City of Austin shall pay to Burns & McDonnell Engineering Company, Consulting Engineers, an amount equal to five percent (5%) of the total cost of the entire improvements; payments to be made as follows: Seven Hundred and Fifty Dollars ($750.00) shall be paid at the time of completion and presentation of the preliminary report, plans and estimate; an amount equal to two and one-half percent (24%) of the estimated cost of the improvements shall be paid at the time of completion of the final plans and specifications and their approval by the State Board of Health and City Council. The balance of the engineering fee shall be pro-rated in as many months as may be required for the completion of the construction work. It is agreed, however, that if the City Council does not approve the reports, plans and estimates provided for in Items I and II hereof, or does not order the bond election, or if the bonds are not voted at an authorized election, or funds otherwise provided for the said improvements, then there shall be no compensation due said Burns & McDonnell Engineering Company for said engineering services, other than the Seven Hundred and Fifty Dollars ($750.00) paid at the time of the completion of the preliminary plans, estimates and report. Roll call showed the following members present: Mayor Yett, Councilmen Eyres, Haynes and Searight, 4; absent, Councilman Copeland, The Minutes of the last meeting were read and upon motion of Councilman Haynes were adopted by the following vote: Ayes, Mayor Yett, Councilmen Tyres Haynes and Searight, 4; nayes, none, Councilman Copeland absent. The application of W. A. Fiegel to erect a building upon Brazos Street between 6th and 7th Streets was read and Councilman Haynes moved that application be granted, provided same were erected under the supervision of the City Engineer, City Fire Marshal and City Electrician. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Eyres, Haynes and Searight, 4; nayes, none, Councilman Copeland absent. The application of Charlton & Crockett to install a gasoline storage tank inside the building at the corner of East 5th and Brazos Streets was read, and upon motion of the Safety Committee, the same was refused by the 59 60 following vote: Ayes, Mayor Yett, Councilmen Fyres, Haynes and Searight, 4; nаyев, none, Councilman Copeland absent. The application of J. S. Wright to erect a sign at 203 West 7th Street between the sidewalk and curb was read and Councilman Haynes moved that same be rejected and the said J. S. Wright ordered to remove same. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Eyres, Haynes and Searight, 4; nayes, none, Councilman Copeland absent. Councilman Haynes noved that the Police Department be instructed to have removed a sign on South side of West 14th Street between Colorado and Lava ca Streets. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Eyres, Haynes and Searight, 4; nayes, none, Councilman Copeland absent. The Council then adjourned. City Cerk REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, October 19, 1922, The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; absent, none. The Minutes of the last meeting were read and upon motion of Councilman Haynes were adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Fyres, Haynes and Searight, 5; nayes, none. The monthly reports of W. L. Eyres, Superintendent Parks and Public Property, Sam D. Griffin, City Marshal, W. A. Alff, City Sexton, M. R. Miller, Mechanic for Fire Department, Miss Nellie M. Hall, Secretary United Charities, and C. L. Woodward, Chief of the Fire Department, were read and ordered filed. The application of Dr. J. S. Wright to erect a sign over the sidewalk at #203 West Seventh Street was read and upon motion of Councilman Searight, was referred to the Safety Committee by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none.
