62 The ordinance was read the second time and Councilman Copeland moved a further suspension of the rule and the placing of the ordinance on its third reading and final passage. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. The ordinance was read the third time and Councilman Copeland moved that same do now finally pass: Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. The Council then adjourned. REGULAR MEETING OF THE CITY COUNCIL: 1 Austin, Texas, October 26, 1922, The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, Haynes and sea- right, 5; absent, none. The Minutes of the last meeting were read and upon motion of Councilman Haynes: were adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. The petition of Jesse J. Smith, et al, asking that Guadalupe Street between 27th and 29th Streets be widened was read and Councilman Haynes moved that said petition be referred to the Street Commissioner and City Attorney for their report back to the Council. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. A. P. Watson and others, representing a committee from the San Sam, appeared before the Council and asked that certain streets be cleared for the purpose of holding the San Sam parades on Monday and Tuesday afternoons, October 30th and 31st. Councilman Haynes moved that the Police Department be instructed to have said streets cleared as requested, and that the invitation to join in the parade be accepted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. Councilman Searight was then excused from the Council meeting. Councilman Eyres introduced the following resolution: WHEREAS, Southern Surety Company heretofore issued its policy of insurance No. K-43402, to the City of Austin for the term of one year, beginning January 6, 1916, and ending January 6, 1917, to the extent of $5,000.00, for the purpose of indemnifying said City against loss by reason of its legal liability for damages on account of bodily injuries inflicted on any person not employed by it in the operation of its electric light and power plant; and WHEREAS, during said term, one S. W. Johnson, not an employee of the City, was injured in the operation of the City's said plant and recovered against the i ! ' oity judgment for damages on account of said injuries to the extent of $10,000.00, which judgment has heretofore been affirmed by the Supreme Court of Texas; and WHEREAS, said Southern Surety Company has denied its liability to indemnify the City for said damages under the terms of said policy, but has proposed a settlement of such claim by the payment of $3,000.00 to the City; and WHEREAS, after due consideration of the matter, and upon advice of the City Attorney, it is deemed advisable to accept the proposition of said Company for settlement; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Mayor be and is hereby authorized to accept the check of Southern Surety Company for $3,000.00 in full settlement of all claims by the City against said Company on account of damages recovered by said S. W. Johnson, and to execute and deliver to said Company the release of the City evidencing such settlement; and the Mayor be and he is hereby further authorized to properly endorse and deliver to said S. W. Johnson, or his attorneys of record, the said check of said Company, upon the delivery to the Mayor of a release and credit on said judgment to the extent of said amount. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, and Haynes, 4; nayes, none, Councilman Searight absent. Councilman Haynes moved that the communication and accompanying correspondence of C. W. Payne with reference to his taxes be referred to the City Attorney for his report back to the Council, Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres and Haynes, 4; nayes, none, Councilman Searight absent. Councilman Copeland moved that the resignation of Rosa Martha Lengefeld, and Superintendent of Nurses at City Hospital be accepted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes 4, nayes, none, Councilman Searight absent. H Councilman Copeland then nominated Miss Seiger Leighhill as Superintendent of Nurses at City Hospital. Nomination was confirmed by the fol- lowing vote: Ayes, Mayor Yett, Councilmen Eyres and Haynes, 3; nayes, none, Councilman Copeland present but not voting, Councilman Searight absent. Councilman Copeland nominated the following as Special Policemen of the City of Austin during the Carnival and Fair: J. M. Hornsby; Ray Griffin; Leo Mueller; Max Bickler; George Bendetti; Alfred C. Bull; H. C. Smith; and George Lansdowne. Nominations were confirmed by the following vote: Ayes, Mayor Yett, Councilmen Eyres and Haynes, 3; nayes, none, Councilman Copeland present but not voting, Councilman Searight absent. Judge Ireland Graves, Messrs. A. C. Baldwin, B. L. Dillingham, D. T. Iglehart and George Lansdowne appeared before the Council and presented a petition bearing the signatures of approximately thirteen hun- dred citizens of Austin requesting that the Council pass an ordinance requesting the Charter Commission to frame a charter for the City of 63 64 Austin embodying the city manager plan of government. The Council then recessed.. SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, October 28, 1922. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, Haynes; 4, absent, Councilman Searight, Councilman Haynes introduced the following resolution: WHEREAS, it appears from the petition of Mrs. S. E. Russell herewith attached and from the records of the Assessor and Collector of Taxes that one T. J. Clark, as agent, and S. E. Russell, each rendered four certain barber chairs and furniture for taxes of 1921 and that the taxes have been paid on both renditions, creating a double assessment and payment on the same property, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby instructed to cancel the assessment of S. E. Russell, and that the City Clerk be authorized to issue warrant to said Russell against the General Fund for Two Dollars and Sixty-four Cents ($2.64), the amount of taxes paid by him on said rendition for 1921. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres and Haynes, 4; nayes, none, Councilman Searight absent. Upon the recommendation of Sam D. Griffin, Councilman Copeland nominated G. W. Peteet and Charlie Dunk as special policemen. Nominations were confirmed by the following vote: Ayes, Mayor Yett, Councilmen Eyres and Haynes, 3; nayes, none, Councilman Copeland present but not voting, Councilman Searight absent.
