88 SPECIAL MEETING OF THE CITY COUNCIL: AUSTIN, TEXAS, January 22, 1923. The Council was called to order by the Mayor, Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; absent, none. Councilman Haynes moved that Councilman Eyres be authorized to contract with McClave-Brooks Company for one mechanical stoker for the sum of $5,170.00. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. The Council then recessed, SPECIAL MEETING OF THE CITY COUNCIL: AUSTIN, TEXAS, JANUARY 23, 1923. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, and Haynes, 4; absent, Councilman Searight. Councilman Eyres introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Mayor be and is hereby authorized and instructed to execute, in behalf of the City of Austin, a contract with McClave-Brooks Company in substantially the following form and terms, to-wit: "THE STATE OF TEXAS COUNTY OF TRAVIS. KNOW ALL MEN BY THESE PRESENTS: That this Agreement this day entered into by and between the City of Austin, a municipal corporation, acting by and through its mayor, W. D. Yett, hereinafter called City, and McClave-Brooks Company, hereinafter called Company witnesseth: to 1. That for the consideration and upon the terms hereinafter mentioned, the City agrees to purchase and the Company agrees to sell, and to deliver within thirty days after the full execution of this contract, f. o. b. cars Scranton, Pennsylvania, one McClave Mechanical Stoker and equipment be installed in connection with the City's Sterling Class "O", No. 30, 752 H. P. Water Tube Boiler, in accordance with the certain specifications hereto attached, and to furnish final drawings thereof, to be approved by the City, and also to furnish the services of an Erecting Engineer to supervise the installation of said Stoker and equipment at the plant of the City, in Austin, Texas, and also to furnish the services of a Combustion Engineer to instruct the firemen of the City as to the best methods of burning coal and lignite. 2. The City agrees to pay for said Stoker and equipment and said services, the sum of Five Thousand One Hundred and Seventy ($5,170,00) Dollars as follows: One-third of said amount upon the acceptance by the City of said Stoker and equipment at the end of the trial period hereinafter provided; one-third of said amount four months thereafter; and the balance, when it is shown that the operation of said stoker and equipment has saved ! !
