88 SPECIAL MEETING OF THE CITY COUNCIL: AUSTIN, TEXAS, January 23, 1923. The Council was called to order by the Mayor, Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; absent, none. Councilman Haynes moved that Councilman Eyres be authorized to contract with McClave-Brooks Company for one mechanical stoker for the sum of $5,170.00. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. The Council then recessed, SPECIAL MEETING OF THE CITY COUNCIL: AUSTIN, TEXAS, JANUARY 23, 1923. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, and Haynes, 4; absent, Councilman Searight. Councilman Eyres introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Mayor be and is hereby authorized and instructed to execute, in behalf of the City of Austin, a contract with McClave-Brooks Company in substantially the following form and terms, to-wit: "THE STATE OF TEXAS COUNTY OF TRAVIS. KNOW ALL MEN BY THESE PRESENTS: That this Agreement this day entered into by and between the City of Austin, a municipal corporation, acting by and through its mayor, W. D. Yett, hereinafter called City, and McClave-Brooks Company, hereinafter called Company witnesseth: to 1. That for the consideration and upon the terms hereinafter mentioned, the City agrees to purchase and the Company agrees to sell, and to deliver within thirty days after the full execution of this contract, f. o. b. cars Scranton, Pennsylvania, one McClave Mechanical Stoker and equipment be installed in connection with the City's Sterling Class "O", No. 30, 752 H. P. Water Tube Boiler, in accordance with the certain specifications hereto attached, and to furnish final drawings thereof, to be approved by the City, and also to furnish the services of an Erecting Engineer to supervise the installation of said Stoker and equipment at the plant of the City, in Austin, Texas, and also to furnish the services of a Combustion Engineer to instruct the firemen of the City as to the best methods of burning coal and lignite. 2. The City agrees to pay for said Stoker and equipment and said services, the sum of Five Thousand One Hundred and Seventy ($5,170,00) Dollars as follows: One-third of said amount upon the acceptance by the City of said Stoker and equipment at the end of the trial period hereinafter provided; one-third of said amount four months thereafter; and the balance, when it is shown that the operation of said stoker and equipment has saved ! ! the City in coal and labor the purchase price of same. 3. It is agreed that the operation of said stoker and equipment shall begin not later than September 1, 1923, and that the City shall have four months of actual operation thereof, in which to test said stoker and equipment for saving in fuel and labor by any method it may see fit to employ. If at the expiration of four months of actual operation and test, it has not been shown to the satisfaction and approval of the City, that said stoker and equipment is a good investment from a fuel and labor saving standpoint the Company agrees to remove from the City's plant said stoker and equipment at its own expense, upon notice of such disapproval by the City, and this contract will thereupon become null and void. 4. The Company further agrees to sell and deliver to the City, as per point above stated, within twelve months after the acceptance of the above mentioned stoker and equipment, but at the option and upon the demand of the City, two additional stokers and equipment as above described, at the same price mentioned in this contract; and the Company also agrees that in event the City elects to return the grates now installed under the two Sterling Boilers of the City at its plant, it will take suid grates at 80 per cent of their original invoiced price, provided that same have had at such time no more than ordinary use and wear." The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres und Haynes, 4; nayes, none, Councilman Searight absent. adjourned. The Council then adjourne REGULAR MEETING OF THE CITY COUNCIL: Holerk Austin, Texas, January 25.1923 The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; absent, none. The Minutes of the last meetings were read and upon motion of Councilman Haynes were adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none, The annual report of Jas. II. Maxwell, Sealer of Weights and Measures, was read and ordered filed. A report of the City Auditor giving a summary of warrants issued against the several funds of the city was read and ordered filed. Councilman Haynes introduced the following resolution: WHEREAS, in checking up valuations as furnished by the Stoner, Gallagher , and Groos experts it was discovered that part of the improvements on property assessed by George S. Heflybower were doubly assessed, that is to say, Mr. Heflybower rendered for taxes Lots 6, 7 and 8, Outlot 33, Division "D" with improvements and the experts consolidated said improvements and 89
