New City Charter Vote; Property Tax Relief

REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, February 1,1923. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; absent, Councilman Eyres. The Minutes of the last meeting were read and adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Eyres absent. Upon the recommendation of C. L. Woodward, Chief of the Fire Department, Councilman Copeland nominated A. K. Abrahamson as a fireman. Nomination was confirmed by the following vote: Ayes, Mayor Yett, Councilmen Haynes, and Searight, 3; nayes, none, Councilman Copeland present but not voting, Councilman Eyres absent. Upon the recommendation of Sam D. Griffin, Chief of Police, Councilman Copeland nominated J. D. Piper as patrolman. Nomination was confirmed by the following vote: Ayes, Mayor Yett, Councilmen Haynes and Searight, 3; nayes, none, Councilman Copeland present but not voting, Councilman Eyres absent. Councilman Haynes introduced the following resolution: WHEREAS, the Unit System experts placed a valuation of $2,315.00 on the East One-half of Lot 3, all of Lot 2 and the North 80x150 feet of Lot 7, and 10x150 feet off of the northwest corner of Lot 8, all in Block 5, Outlot 5, Division "Z", and a valuation of $800.00 on the improvements on said lots, or a total valuation of $3,115.00 on said property assessed to Robert Thompson for the taxes of 1922; and WHEREAS, in transferring said valuations to the inventory sheets from which the Assessor and Collector compiles his tax rolls, the employees of said experts erroneously entered the valuation on the lots as $3760.00 and the improvements as $1250.00, or a total of $5,010.00 instead of $3,115.00, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby authorized to correct said error on his rolls and permit Mr. Thompson to pay on the valuation as fixed by the Unit System experts and take credit for the difference of $1895.00. Councilman Haynes introduced the following resolution: WHEREAS, the Unit Tax experts valued the improvements on the east onehalf of Lot 5, Outlot 49, in Division "D", assessed by W. 8. Gatewood at $4,875.00, or $3,250.00 for taxation; and WHEREAS, Mr. Gatewood has filed the affidavit of the contractor who built said improvements in October, 1920, showing actual cost to be 1,480.00; and WHEREAS, there are other improvements on said lot owned by lessees with privilege of removal, making a total value for taxation, $1,730.00, Now, therefore, in view of the affidavits filed by said W. S. Gatewood showing flagrant error in valuing his improvements, 9.1 92 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be authorized to correct said error and permit W. S. Gatewood to pay on a valuation of $1,730.00 on said improvements and take credit for the taxes on the amount in error, or $1,520.00. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Eyres absent. Councilman Haynes introduced the following resolution: WHEREAS, the Unit tax experts in valuing the improvements on 50x120 feet of the northeast part of Outlot 49, Division "E" at $3,500.00 which would fix a value of $2,335.00 for assessment; and WHEREAS, the value transferred to the inventory from which the Tax Collector compiles his rolle is $3,335.00, Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be instructed to correct said error and permit W. M. Woodall, the owner of said property, to pay on the correct valuation of his property and take credit for the difference. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Eyres absent, Councilman Haynes moved that the Mayor be authorized to execute a quitclaim deed to Mrs. E. M. Barrett of all rights the City of Austin may have acquired in the streets and alleys in Isherwood Heights Addition, same being outside the city limits, a dedication of said streets and alleys having been made over twenty-five years ago but never having been accepted by the city, the said Mrs. I. M. Barrett now being the owner of said Isherwood Heights property. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Eyres absent. The Council recessed until 3 P. M. AFTERNOON SESSION: The annual report for 1922, also monthly report for January, 1923, of A. S. Anderson, Public Weigher, were read and ordered filed. The monthly reports for January of C. L. Woodward, Chief of the Fire Department, Lrs. R. C. Walker, Pure Food Inspector, M. R. Miller, Mechanic for the Fire Department, the Public Health Nursing Association were read and ordered filed. The Mayor laid before the Council the following ordinance: AN ORDINANCE ORDERING AN ELECTION TO BE HELD ON THE SIXTH DAY OF MARCH, A. D. 1923, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY OF AUSTIN, FOR ADOPTION OR REJECTION OF THE PROPOSED CHARTER FRAMED BY THE CHARTER COLMISSION HERETOFORE ELECTED. The ordinance was read the first time and Councilman Haynes moved that the rule be suspended and the ordinance placed on its second reading. Lotion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Eyres absent. The ordinance was read the second time and Councilman Haynes moved a further suspension of the rule and the ordinance placed on its third reading and final passage, Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes none, Councilman Eyres absent. , ! City Belenk REGULAR MEETING OF THE CITY COUNCIL: 93 Austin, Texas, February 8,1923. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; absent, Councilman Eyres. The Minutes of the last meeting were read and upon motion of Councilman Copeland were adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Eyres absent. The monthly reports of Sam D. Griffin, City Marshal, Robert Rockwood, Fire Marshal, and Fred Sterzing, Assessor and Collector, were read and ordered filed. The petition of N. S. Thompson and others, asking that the City have an electric light installed on West 38th Street, was read, and Councilman Copeland moved that the petition be referred to Councilman Eyres. Motion pre- vailed by the following vote: Ayes, Mayor Yett, Councilmen Copeland, liaynes and Searight, 4; nayes, none, Councilman Eyres absent. Upon the recommendation of the Chairman of the Board of Equalization, Councilman Haynes introduced the following resolution: BE IT RESOLVED BY THE CITY OUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby instructed to correct above assessment on his rolls for 1922, in accordance with above statement, and to take credit for amount of reduction. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Eyres absent. The Council then adjourned.
