SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, April 17, 1923.. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; absent, Councilman Eyres. Prof. T. A. Brown appeared before the Council and asked permission to close West Avenue from 11th to 12th Streets from five to seven o'clock P. M., on May 1st, 1923, for the purpose of holding a Mayfest. Permission was granted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes, and Searight, 4; nayes, none, Councilman Eyres absent. A communication from the I&GN Railway Company, asking permission to make certain improvements at their depot on West 3rd Street, was read. Councilman Haynes introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: That in view of the statement of the Chairman of the Board of Equalization herewith attached, an error was made under the Unit System in placing the valuation of $2215.00 on the improvements situated on Lots 9 to 13, Block 3, South Heights, assessed to V. Falwell and should be reduced to $1625.00, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby authorized and instructed to change the valuation on his rolls for 1922 to $1625.00 and take credit for $590.00, amount of reduction. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Bearight, 4; nayes, none, Councilman Eyres absent. Councilman Haynes introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That in view of the statement of the Chairman of the Board of Equalization herewith attached that the valuation of $6,580.00 placed by the Unit System on the improvements situated on Outlot 24, Division "D", assessed to W. S. Brown on personal inspection is found inequitable in comparison with values placed on improvements on adjoining property and that improvements made in 1922 were erroneously included in said valuation, and that the valuation should be reduced to $5,600.00, Therefore, the Assessor and Collector is hereby instructed to change the valuation on his rolls for 1922 to $5,600.00 and to take credit for the reduction of $980.00. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Eyres absent. Councilman Haynes introduced the following resolution: WHEREAS it appears from the statement of the Chairman of the Board of Equalization, also of C. E. Dildy, the owner, herewith attached that the improvements assessed against him under the Unit System at a valuation of $3,735.00 on Lot 2 of South-half of Outlot 4, Division "Z" were not placed on said lot 137 138 i until after January 1, 1922, and is therefore not taxable for said year, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby authorized and instructed. to strike said assessment from his rolls and to take credit for the amount. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Eyres absent. Councilman Haynes introduced the following resolution: WHEREAS, according to statement of the Chairman of the Board of Equalization herewith attached, the records of the Unit System show that a valuation of $805.00 was placed on Lot 25, Outlot 8, Division "D", owned by E. R. York, for taxes of 1922, but a clerical error was made in transferring said valuation to the rolls of the Assessor and Collector and the valuation entered as $1805.00, Therefore, in order to correct said error, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby instructed to change the valuation on his rolls to the correct amount of $805.00 and to take credit for the difference, $1000.00. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Counoilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Eyres absent. Councilman Haynes introduced the following resolution: WHEREAS, it appears from the statement of A. W. Courtney herewith attached, also, the statement of A. W. Townsend, Chairman of the Board of Equalization, that the increase in the valuation of the merchandise stock of said Courtney for taxes of 1922 from $1565.00 as rendered by him to $2400.00, is erroneous and unjust; and WHEREAS, said Courtney claims that said increase was made by the Board of Equalization without notice to him and he could not therefore protest in the time required under the Charter, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby instructed to correct the assessment on his rolls and take credit for $835.00, amount of reduction. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none. Councilman Eyres absent Councilman Haynes introduced the following resolution: WHEREAS, the Unit System experts in valuing the assessment of Lots 1 and 2, Block 3, Gammel & Taylor Subdivision, owned by George Hardeman, reported improvements on said lots valued at $630.00; and WHEREAS, J. M. Patterson, Attorney for said Hardeman, who prepared contract for said improvements, makes affidavit hereto attached that said improvements were placed on said lots during the month of July, 1922, and that said lots were vacant and unimproved on January 1st, 1922, Now, therefore, in view of the error as shown by said affidavit, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby authorized and instructed to correct said error and permit payment on value of lots and take credit for taxes on $630.00. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Haynes and Searight, 4; nayes, none, Councilman Eyres absent. The Council then adjourned. The reading of the Minutes of the last meetings, upon motion of Councilman Haynes, was suspended, by the following vote: Ayes, Mayor Yett, Councilmen Copeland, Eyres, Haynes and Searight, 5; nayes, none. The protest of V. O. Wedd and other residents on West 3rd Street near the intersection of Bowie and Fannin Streets, protesting against the I&GN Railway Company being allowed to encroach upon private property in that vicinity, was read, and after a lengthy discussion of the same by representatives of the I&GN Railway Company and property owners, a settlement of the matter was deferred Councilman Haynes introduced the following resolution: WHEREAS, according to statement of A. W. Townsend, Chairman of the Board of Equalization, an error was made under the Unit System in figuring the depreciation on the improvements situated on Lot 1, Block 5, Outlot 36, Division "5", owned and assessed by W. A. Shannonhouse, thereby placing a value for assessment of $1,490.00, while it should have been $900.00, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby instructed to correct the error on his rolle for 1922 and place the valuation at $900.00, taking oredit for the $490.00 reduction.
