  • Traffic Signal Showdown:

    The City Council formally rejected the placement and prominent advertising on new "beacon-lights" (traffic signals) along Congress Avenue, declaring them in violation of city contracts and an obstruction to traffic. 214 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, December 06, 1923. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett and Councilman Haynes, 2; absent, Councilmen Avery, llolen and Searight, 3; Councilman Haynes moved that the Council stand adjourned until 3:00 o'clock P.M. AFTERNOON SESSION: The Council was called to order by the Mayor, Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; absent, none. Councilman Haynes introduced the following resolution: WHEREAS, on November 27th, 1923, Warrant #21305 was issued against the General Fund for $805.25 in favor of J. O. Andrewartha Company, which was approved and should have been drawn against the Hospital Bond Fund, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Clerk be and he is hereby instructed to draw a warrant for amount of above account against the Hospital Bond Fund in favor of the General Fund and to deliver same to the Assessor and Collector, in order to correct these accounts. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The following communication of J. Bouldin Rector, City Attorney, was read and ordered filed: "Austin, Texas, December 6,1923. The City Council, Austin, Teхав. Gentlemen: Please allow me to call your attention to certain matters in connection with the placing of beacon-lights at the intersections of various streets with Congress Avenue that is now in progress. The contract made with the city by the concern that furnished these beacon-lights provides specifically that both the locations and the character of advertisement to be placed on the standards must first be approved by the City Council. It is my recollection that the City Council, as a body, has never designated or approved the location of these beacon-lights and it certainly has not even had the opportunity furnished it to pass upon the advertisements placed thereon, I recall that it was with considerable hesitation the former City Council agreed that any advertising at all should be placed upon these standards, and it was only after the assurance from the representative of the concern that such advertisements would not be obtrusive but would be placed on small plates under the traffic directions that the City Council considered this feature at all in a contract; and to govern the matter and to see that such assurance was carried out, a provision was inserted in the contract that all advertisements would be subject to the approval of the City Council. Without the designation of the City Council, acting as such, these beacon-lights are now being erected on Congress Avenue, where they are least needed and present obstructions rather than aids to traffic, and the most prominent part of the inscription on each is the advertisement, It will be recalled that the past policy of the City has been to refuse to permit the placing of trash-cans and other objects on the streets and sidewalks that bear advertising matter, upon the good policy and law that the streets should not be allowed to be used for private advertising. Therefore, I would respectfully ask that you carefully consider the above suggestions before allowing this matter to go further. Very truly yours, (Sgd)J.Bouldin Rector, City Attorney." Mayor Yett introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That neither the locations of, nor the advertising matter placed upon the various traffic signals now on Congress Avenue is in accordance with the terme of the contract of the City with the American Gas Accumulator Company, in the particulars that neither of said locations nor advertising matter has received the approval of the City Council; and BE IT FURTHER RESOLVED: That said locations and said advertising matter placed on said traffic signals be not approved, and the Mayor is instructed to communicate at once with the representative of the said Company to said effect. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The petition of the International & Great Northern Railway Company to erect an electric sign over the sidewalk at the depot at West 3rd Street and Congress Avenue was read and Councilman Searight moved that same be referred to the Safety Committee. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. A. S. Thweatt was appointed Presiding Judge of the Fourth Ward, E.D.Junkin, Assisting Judge, and E. J. Barkley, Assisting Judge, by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The monthly reports of W. D. Walker, Dairy Inspector, and A. S. Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen and Bearight, 5; absent, none, The Minutes of the last meetings were read and upon motion of Councilman Haynes were adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none, The report of the Safety Committee on the petition of the I&GN Railway Company to erect a sign at the depot at Congress Avenue and West 3rd Street was read and Councilman Searight moved that said petition be granted as recommended by the Safety Committee.
