The ordinance was read the first time On motion of Councilman Haynes the rule was suspended and said ordinance was passed to its second reading, by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The ordinance was read the second time and Councilman Haynes moved that the rule be suspended and the ordinance be placed on its third reading and final passage. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The ordinance was read the third time and passed finally by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The Council then adjourned. REGULAR MEETING OF THE CITY COUNCIL: Blerk Austin, Texas, January 24,1924. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Haynes, Nolen and Searight, 4; absent, Councilman Avery. The Minutes of the last meeting were read and adopted by the following vote: Ayes, Mayor Yett, Councilmen Haynes, Nolen and Searight, 4; nayes, none, Councilman Avery absent. The petition of L. M. Lee to erect an electric sign at 319 East 6th Street was read and granted as recommended by the Safety Committee, by the following vote: Ayes, Mayor Yett, Councilmen Haynes, Nolen and Searight, 4; nayes, none, Councilman Avery absent. The petition of W. W. English to erect an electric sign at 6th and Guadalupe Streets was read and upon motion of Councilman Haynes was granted as recommended by the Safety Committee, by the following vote: Ayes, Mayor Yett, Councilmen Haynes, Nolen and Bearight, 4; nayes, none, Councilman Avery absent. The petition of W. W. English to erect an electric sign in front of the Driskill Hotel Cafe on East 6th Street, upon the recommendation of the Safety Committee was granted by the following vote: Ayes, Mayor Yett, Councilmen Haynes, Nolen and Searight, 4; nayes, none, Councilman Avery absent. The application of Kelley Smith to install two gasoline tanks in the rear of his place of business on West 6th Street was read and Councilman Searight moved that same be granted as recommended by the Safety Committee. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Haynes, Nolen and Searight, 4; nayes, none, Councilman Avery absent. The communication of Jeff N. Gilbert regarding his claim for damages in 227 228 the amount of $12.00, account of injury to his automobile, was read and Councilman Haynes moved that upon the advice of the City Attorney the claim be allowed. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Haynes, and Searight, 3; nayes, Councilman Nolen, absent, Councilman. Avery. Councilman Haynes introduced the following resolution: WHEREAS, the valuation of $300.00 on the improvements on Lot 3, Outlot 61, Division "B", as fixed by the Board of Equalization, has been found excessive, both buildings being very old and dilapidated, the protest of the owner, Maggie McCollum, having been made in person, she being old and unable to read or write, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the valuation of the improvements of Lot 3 be reduced to $200.00 and the improvements on Lot 1 be reduced to $150.00, and the Assessor and Collector is hereby instructed to make the change on his rolls of 1923, leaving the total valuation on the property owned by said Maggie MoCollum for 1923, $845.00 instead of $1045.00. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Haynes, Nolen and Searight, 4; nayes, none, Councilman Avery absent. The petition of John Butler and others, a committee from the Chamber of Commerce, asking that gates be installed at the railroad crossings at Third and Congress Avenue was read and Councilman Haynes moved that same be referred to the Street Commissioner. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Haynes, Nolen and Searight, 4; nayes, none, Councilman Avery absent. Councilman Haynes introduced the following resolution: WHEREAS, in Cause No. 5719 pending in the County Court of Travis County, Texas, there is a suit styled City of Austin against the Talking Machine Company of Texas for $351.00 alleged to be due the said City of Austin for taxes for the year 1919; and, WHEREAS, there is a bona fide dispute as to the extent of liability of said defendant to the City; and WHEREAS, said defendant has proposed to pay the City the sum of Two Hundred and Fifty Dollars ($250.00) and all costs of suit in settlement of the controversy; and WHEREAS, in the opinion of the Council the amount assessed against said defendant is probably excessive and the amount offered to be paid by said defendant is, in view of the circumstances, in the opinion of the Council, fair and reasonable, Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Attorney be and he is hereby authorized to accept Two Hundred and Fifty Dollars ($250.00) offered by said defendant in full satisfaction of said claim, it being understood, of course, that all costs of court are to be paid by said defendant, and said City Attorney, upon receipt of said Two Hundred and Fifty Dollars ($250.00) is authorized to agree to a dismissal of said case at the cost of defendant. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Haynes, Nolen and Searight, 4; nayes, none, Councilman Avery absent. Councilman Nolen introduced the following resolution: WHEREAS, in each of the following named and numbered cuses the defendant was fined in the sum of Two Dollars ($2.00) and costs, amounting in the aggregate to the sum of Eleven Dollars and Eighty Cents ($11.80); and WHEREAS, each of said defendants has paid the fine imposed, but the costs in each case has not yet been collected because the City Council for reasons to it deemed sufficient had determined to remit said costs, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the costs imposed against the defendant in each of the following cases be and the same is hereby remitted, No. 18259 J.
