the sidewalk and curb and gutter mentioned in said judgment and agrees that said sidewalk and curb and gutter may remain where they now are, but that the defendant agrees and promises, and hereby agrees and promises, to extend said sidewalk in a southerly direction in a straight line from where it now ends to the north margin of the alley running east and west on the south end of said Lot No. 1 of Johnson's River Addition to said city of Austin, The defendant, W. E. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The reports of Fred Sterzing, Assessor and Collector, and R. E. Nitschke, City Sexton, for the months of March were read and ordered filed. The Council then recessed, SPECIAL MHETING OF THE CITY COUNCIL: Austin, Texas. April 18, 1924 The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; absent, none. Councilman Searight introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Sealer of Weights and Measures be and he is hereby authorized and instructed to effectually destroy all false weights and measures which he has taken into possession by virtue of his office. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Haynes introduced the following resolution: WHEREAS, there has just come to the notice of the City Council certain irregularities in the management of the affairs of the City Hospital, so as to necessitate an immediate audit of the books and accounts of the same; Therefore, 289 290 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That T. B. Trotter and Company be engaged at once to make a complete audit of the affaire of the City Hospital from May 1st, 1923, to the present date, upon the same terms and per diem basis as said Company has heretofore contracted with the City of Austin to make an audit of the Water, Light and Power Department. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Haynes introduced the following resolution: TRANSFERRING FROM THE SUPERINTENDENT OF POLICE AND PUBLIC SAFETY TO THE MAYOR, THE SUPERVISION OF THE CITY HOSPITAL, AND OTHER MATTERS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That there is hereby transferred from the Department of Police and Public Safety to the Department of Public Affairs, the matters and affairs of the City Hospital, and matters generally incident to the public health of the City; and the Mayor shall hereafter have under his immediate charge and supervision all of the matters hereby transferred to his Department, same being the City Hospital and the employees thereof, and all buildings, property and apparatus belonging to or used therein; and the Mayor shall have the power to employ and discharge all employees connected therewith, subject, however, to the action of the City Council whenever ordered; and the Mayor shall be held directly responsible for the administration of the affairs of said matters above enumerated, and shall make or cause to be made to the City Council such reports as may be ordered; and it shall hereafter be the duty of the Mayor to see to the enforcement of all laws and ordinances pertaining to the public health of the City.
