The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none, The communication of Garrett, Brownlee & Goldsmith, Attorneys, relative to property owned by R. H. Kirby was read and Councilman Haynes moved that the Mayor be instructed to notify said attorneys that the protest was presented too late for consideration, Motion prevailed by the following võte: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The monthly reports of C. N. Avery, Superintendent of the Water, Light and Power Department, Mrs, R. C. Walker, Pure Food Inspector, Jas, H. Maxwell, Sealer of Weights and Measures, and A. S. Anderson, Public Weigher, were read and ordered filed. Councilman Avery moved that the proposition of the International Filter Company that Alternate No. 2 (Wagner bottom) be embraced in their contract for equipment of the Water Filtration Plant be accepted, subject to the approval of Jno, B. Hawley, Consulting Engineer, Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The Council then recessed. SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, May 2nd, 1924. 0 The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; absent, none. Councilman Searight introduced the following resolution: RESOLUTION ESTABLISHING THE WIDTH OF 34TH OR STATE STREET FROM THE WEST LINE OF KING STREET TO THE EAST LINE OF ASYLUM AVENUE. WHEREAS, there exists a confusion as to the width of 34th or State Street from the west line of King Street to the east line of Asylum Avenue; and WHEREAS, it is contemplated to make certain improvements on this street, namely, the building of curbs, walks, and laying off of lots, and the necessity exists for the establishment of the street and curb lines, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the width of 34th or State Street between the west line of King Street and the east line of Asylum Avenue be and the same is hereby established as 55 feet in width and that the north line of said street shall be 45 feet north of the present and established south curb line of 34th Street between King Street and Asylum Avenue; also that the roadway between curbs be and the same is hereby established as 35 feet. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. 293 294 The Council then recessed, SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, May 3rd 1924. The Council was called to order by the Mayor. Roll call showed the fol1owing members present: Mayor Yett, Councilmen Haynes, Nolen and Searight,4; absent, Councilman Avery. The resignation of Capt. J. H. Rogers as City Marshal of the City of Austin was read and Councilman Nolen moved that the resignation be accepted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Haynes and Searight, 3; nayes, none, Councilman Nolen not voting Councilman Avery absent. Councilman Nolen nominated J. N. Littlepage as City Marshal. Nomination was confirmed by the following vote: Ayes, Mayor Yett, Councilmen Haynes and Searight, 3, nayes, none, Councilman Nolen present but not voting; Councilman Avery absent. Councilman Nolen nominated Sam D. Griffin as Sergeant of Police of the City of Austin. Nomination was confirmed by the following vote: Ayes, Mayor Yett, Councilmen Haynes and Searight, 3; nayes, none, Councilman Nolen present but not voting, Councilman Avery absent. Councilman Avery entered the council Chamber. The resignation of J. N. Littlepage as Sergeant of Police was read and Councilman Nolen moved that same be accepted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The oath of office was administered to J. N. Littlepage as City liarshal of the City of Austin by J. B. Rector, City Attorney. The bond of J. Il. Littlepage as City Marshal was presented and approved by the Mayor and City Attorney. Upon the recommendation of J. W. Littlepage, City Marshal, Councilman Holen nominated A. 11. James, Colored, as a regular policeman of the City of Austin. Homination was confirmed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes and Searight, 4; nayes, none, Councilman Holen present but not voting. Councilman Avery offered proposed agreement covering bridge span on track extension recently constructed by the I&GIN Railway Company to serve the Water, Light and Power Plant of Austin, which was referred to the City Attorney for his approval by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Holen and Searight, 5; nayes, none.
