In this connection I wish to state that upon examination of the Ordinances that I have been able to locate with the aid of the city Clerk, I find that it is unlawful to place such a sign over any portion of Congress Avenue or sidewalk adjacent thereto from the Colorado River to the State Capitol, and from a strict application to the Ordinances appertaining thereto, the Council is without power, except by amendment or repeal of the ordinances applicable thereto, to grant a permit or permission in the instance above stated, I find, however, that it has been the practice of the City Council on several occasions to grant permissions of this character by resolution to that effect, such practice having been indulged in by the Wooldridge Administration, and it seems by this that the former members of the Council felt that they had the power to grant such permits when the special occasion warranted it, but in doing so, from my inspection of the ordinances, I am compelled to say that I find no authority to support their action. Very respectfully, (Sgd) H. B. Barnhart; Assistant City Attorney." The communication of J. M. Harrell, asking that East 32nd Street be improved, was read and Councilman Nolen moved that same be referred to Councilman Searight. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Bearight, 5; nayes, none. Councilman Searight moved that C. N. Avery be authorized to purchase a lung motor for use at Barton Springs. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Searight moved that Councilman Avery be authorized to pay the claim of the Automobile Underwriters of America in the amount of $148.98. Goldman for permission to erect an electric sign was read and referred to the Safety Committee by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Bearight, 5; nayes, none. The Council then adjourned. SPECIAL MEETING OF THE CITY COUNCIL: SPECIAL Austin, Texas, June 12, 1924. The Council was called to order by the Mayor Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; absent, none. The Minutes of the last meeting were read and Councilman Avery moved that same be adopted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Haynes introduced the following resolution: WHEREAS, the Board of Equalization in transcribing the valuation of $285.00 placed under the Unit System on Lot 26 and South half of Lot 27, Block 7, Hyde Park Addition No. 2, assessed by Miss Lela May Reece for 1923, by clerical error made the valuation $385.00, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby instructed to correct the 309 310 : error on his rolls for 1923 and take credit for the amount. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The petition of the Hyde Park Baptist Church, asking that they be allowed to rope off East 39th Street from Speedway east to Avenue "F" between the hours of 7:00 and 9:30 P. M. was read and Councilman Searight moved that the petition be granted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The application of the Fit-Rite Optical Shop to erect a wooden sign at 519 Congress Avenue was read and Councilman Haynes moved that same be refused, for the reasons set out in the report of the Safety Committee. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Avery moved that the Mayor be authorized and instructed to execute on behalf of the City of Austin a contract with the International & Great Northern Railway Company covering the vitrified brick drain under the right-of-way of said Railroad property at a point near the Water, Light and Power Plant. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The monthly reports of J. N. Littlepage, City Marshal, Mrs. E.
