The Council then recessed, AFTERNOON SESSION: Councilman Nolen moved that the City Clerk be instructed to furnish the County Clerk with 250 ballots for absentee voters in the Charter Amendment election to be held August 9th, 1924. Motion lost by the following vote: Nayes, Mayor Yett, Councilmen Avery, Haynes and Bearight, 4; ayes, Councilman Nolen, The Council then recessed, SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, July 28.1924. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Holen and Bearight, 5; absent, none. Councilman Avery moved that the bid of Walter Tips Company for four pumps and all necessary electrical equipment be accepted as the best bid, and that the City Attorney, J. Bouldin Rector, be instructed to draw up contract in accordance with the bid of said Walter Tips Company. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The Council then adjourned. The Minutes of the last meeting were read and Councilman Avery moved that same be adopted. Woodward, Fire Chief, with reference to the 321 322 proposed building of Jim Osborne was read and Councilman Haynes moved that the same be referred to the Safety Committee and C. L. Woodward, Fire Chief, and also Jim Osborne, for their report back to the City Council. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Holen and Searight, 5; nayes, none. Councilman Nolen moved that the claim of D. A. The application of Otto A. Tiroff, Jr., for permission to install a gasoline tank at 502 East 6th Street was read and Councilman Haynes moved that same be referred to the Safety Committee. Wroe, asking permission to erect an electric sign on South Congress Avenue was read and Councilman Haynes noved that same be referred to the Safety Committee. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none, Councilman Haynes introduced the following resolution: WHEREAS, the City of Austin has heretofore filed suit against C. H. Finley, Guardian and Executor, for city taxes against the estate of L. M. Crooker, deceased, on Lot No. 7, in Block No. 1, Steinle's Subdivision, in Outlet 77, Division "D" of the City of Austin, for the years 1897 to 1910, both inclusive, and it appears from the records of said court that said cause was ordered dismissed upon it being made known to the Court that said taxes and costs of court had been paid; and WHEREAS, 1t appears from the records of the City Tax Assessor and Collector that said taxes have not been paid, but it is the opinion of the City Attorney that the recital in said judgment, whether based upon mistake or not, raises the question of the conclusiveness of said recitals in said judgment and that the taxes involved in said suit should be adjusted between the parties; and WHEREAS, said taxes for said years, together with interest and penalties, amount to $71.80; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Tax Assessor and Collector be and he is hereby instructed and ordered to issue his receipts for the taxes on said property for the years 1897 to 1910, both inclusive, upon the payment of the sum of $35.90 and upon the further payment of $16.75, same being court costs heretofore paid by the City in cause #16,186 against L. M. Crooker, and also upon the payment of all taxes, interest and penalties now due on said property for the years 1911 to 1923, both inclusive. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, olen and Searight, 5; nayes, none. Councilman Searight introduced the following resolution: WHEREAS, on July 17th, 1924, in cause No. 40768, entitled rs. E. A. Head vs. City of Austin, the death of the original plaintiff being suggested and Richard R. Head as sole survivor being made plaintiff in said cause, an agreed judgment was entered in favor of said plaintiff, Richard R. liead, for $350.00 and all costs of suit; now therefore, TE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of $358.60 be and the same is hereby appropriated out of the General Contingent Fund, for the purpose of satisfying in full anid judgment, and the City Clerk is hereby instructed to issue a warrant for $350.00, payable out of said fund, in favor of Warren. Loore, Attorney for Richard R.Head, and a warrant for $8.60 payable out of said fund in favor of S. A. Pinilquist, District Clerk, and the Mayor is authorized to execute said warrants and the City Clerk is directed to deliver said warrants to the respective payees upon the delivery to him by said parties respectively of a proper acquittance of said judgment and receipted bill of costs, The Council then recessed, AFTERNOON SESSION Councilman Nolen moved that the claim for $94.50 of Loss Evans for impounded dogs be approved and ordered paid by the City Council, Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Avery moved that the City Council be instructed to return the certified checks of all unsuccessful bidders for pumping equipment. Motion prevailed by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Avery and Searight, 3; nayes, none, Councilmen Nolen and Mayor Yett, absent. Bids for printing election supplies were opened and read and Councilman Haynes moved that the bid of Tobins be accepted as the lowest and best bid. Motion prevailed by the following vote: Ayes, mayor Pro tem Haynes, Councilmen Avery and Searight, 3; nayes, none, Mayor Yett and Councilman Holen absent. Councilman Haynes moved that. T. McElroy be appointed as Presiding Judge in the Second Ward at the election to be held August 9th, 1924.
