Zilker, or his agent, for property located on the corner of East Ist Street and San Antonio Street, motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none, The monthly reports of J. N. Littlepage, City Marshal, for the month of October, J. H. Maxwell, Sealer of Weights and Measures, for the months of September and October, and the financial statement of the Sewer Department for the month of October, 1924, were read and ordered filed. Koll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; absent, none. The Minutes of the last meeting were read and Councilman Haynes moved that same be adopted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The application of G. A. Burris to install a gasoline pump at 4008 Alice Avenue, together with the Committee's report upon same, was read and Councilman Searight moved that same be adopted, Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery Haynes, Nolen and Searight, 5; nayes, none, The application of C. W. Davis to install a gasoline station at the corner of West Avenue and 32nd Street was read and Councilman Avery moved that same be referred to the Safety Committee. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Haynes moved that J. B. Rector, City Attorney, be authorized to make settlement in Cause 35608, Uity of Austin vs. H. P. N. Uammel and others, and report back to the Council. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Holen and Searight, 5; nayes, none. The petition of Cecil Wieland, asking for a remission of fine assessed against him, was read and Councilman Nolen moved that the fine be remitted. Nitschke, City Sexton, were read and ordered filed. Councilman ilaynes introduced the following resolution: WHEREAS, the unrendered roll of 1921 shows an error in assessment of "90 x 75" feet of Outlot 3, Division "Z", unplatted part of Terrace Park, in that the assessment should have been "80 x 75" feet, the correct amount; and WHEREAS, David Wire, the owner of said property, having paid the taxes on said erroneous assessment, is entitled to a refund of $4.86, excess. paid by reason of said erroneous assessment, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Clerk be and he is hereby instructed to issue warrant against the General Fund of the City in favor of said David Wire for $4.86, the amount paid in excess, The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Searight moved that the City Attorney be authorized to draw an ordinance removing all gasoline curb pumps, and also prohibiting the sale of gasoline and ofl from wagons on the streets of Austin, Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none, The Council then recessed. SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, November 22.1924. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery and Haynes, 3; absent, Councilmen Nolen and Searight, 2. Councilman Haynes introduced the following resolution; WHEREAS, it has pleased an all-wise Providence to remove from our midst and the service of the City, Henry Ziller, who for forty-eight years has been connected with the Tax Department; and WHEREAS, in the death of Mr. Ziller, the City has lost one of its most faithful and efficient employees, Therefore, memory.
