360 Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The Council then adjourned. REGULAR MEETING OF THE CITY COUNCIL: Jore goneby Bity Best Austin, Texas, December 04, 1924. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; absent, none, The Minutes of the last meeting were read and Councilman Searight moved that same be adopted. Motion prevailed by the following vote: Ayes, Mayor Yett, Couno11man Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Searight intorduced the following resolution: WHEREAS, the amount of city taxes assessed against Original Lot No. 2 in Outlet No. 31, and Original Lot No. 9 in Outlet No. 38/39, both of Division "", City of Austin, in the name of J. T. Hurt, for the year 1921 18 #374.75; and WHEREAS, J. T. Hurt, owner of the above named property, protested before the Board of Equalization, sitting for said year, as to the assessed value of said property, and afterwards appealed to the City Council from the action of said Board in denying him relief, which appeal was properly referred for action, but said matter has been misplaced and no action has been taken thereon by the City Council up to this time; and WHEREAS, said taxes are sill unpaid and interest and penalties are accrued thereon; but it has been made to appear to the City Council that both said J. T. Hurt, before his death, he having died in 1923, and kirs. Estelle Hurt, his surviving wife, have been ready and willing to pay such taxes as the City Council should determine in this case, and have been awaiting such action thereon since the accrual of said taxes; and WHEREAS, under the above facts, it is deemed proper and equitable that no penalties and interest be charged against said Lars, Estelle Hurt and said property; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Assessor and Collector of Taxes be and he is hereby instructed to accept in payment of said taxes for said year the sum of $374.75, and to issue his receipt for said year upon the payment of said sum, and that he take proper credit on his books for the penalties and interest thereon accrued, The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Nolen and Searight, 4; nayes, Councilman Haymes. ! The application of the Payne Motor Company for the erection of an electric sign at 105-07-09 West 5th Street, together with the Safety Committee's report upon same, was read and Councilman Searight moved that same be granted. Fletcher for permission to erect an electric sign at 115 West 6th Street, together with the Safety Committee's report upon same, was read and Councilman Searight moved that same be granted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The monthly reports of Fred Sterzing, Assessor and Collector, W. D. Walker, Pairy Inspector, J. H. Maxwell, Sealer Weights and Measures, Mrs. R. C. Walker, Pure Food Inspector, A. S. Anderson, Public Weigher, and the Public Health Nursing Association, were read and ordered filed. Councilman Haynes moved that Fred Sterzing, the veteran Assessor and Collector, be congratulated by the City Council, having had the honor of serving the city in a faithful and efficient manner for the past fifty years, with the wish that he may enjoy good health and continue his valuable services for many years to come, Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The Austin Trades Council asked permission to use a portion of East Avenue from December 22, 1924, to January 3, 1924, both inclusive, for the purpose of showing the Poole & Schneck Shows. Permission was granted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none, 361 362 Councilman Haynes introduced the following resolution: WHEREAS, the amount of city taxes assessed against Lot No. 3 in Block No. 108 City of Austin for the year 1916 is $192.08; and WHEREAS, on December 7th, 1917, in Cause No. 35608 the City of Austin filed suit for said taxes, together with interest and penalties against li.P.N.Uammel, the owner of said property; but it has been made to appear that said H.P.N. Gammel had an agreement with the City to pay said taxes on or before January 1, 1918, in consideration of the City withholding suit until said time, and the City overlooked said agreement in the filing of a large number of similiar suits at said time; and WHEREAS, said H. P. N. Gammel tendered to the city payment of said taxeв, together with penalty and accrued interest on December 26th, 1917, and demanded tax receipt therefor, but refused to pay costs of court in consideration of the above mentioned agreement; and WHEREAS, it was understood at the time of said tender and ever since that the matter would be brought before the City Council for the purpose of remitting said court coste, but same has not been done; and WHEREAS, said H. P. N. Gammel now renews his tender to the City of the sum of $210.33, same being the amount of taxes for said year, to-wit, $192.08, together with $9.60 as penalty, and $8.65 as interest from April 1st, 1917, to December 26th, 1917, aggregating said sum first above stated; and the City Council deems it proper to accept said settlement in view of the above facts; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector of taxes be and he is hereby instructed to accept in payment of said taxes for said year, together with penalty and interest, the sum of $210.33, and to issue his receipt for said year upon the payment of said sum, and that he take proper credit on his books for the balance of interest thereon accrued, The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Haynes introduced the following resolution: WHEREAS, it appears that the Unit System expert, through error, included two houses on 48x124 feet of Outlot 78, Division "D" of Lee's Addition, owned by Dr. W. D. Lightfoot, for 1922, at a valuation of $2680.00, while, in fact, only one house of four rooms, valued at $1000.00, is situated on said property and the assessment for two houses is clearly an error, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he is hereby instructed to correct said assessment, reducing the valuation to $1000.00 for the one house and take credit for $1680.00, error in the assessment for two houses.
