368 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, December 27, 1924. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery and Haynes, 3; absent, Councilmen Nolen and Searight, 2. The Minutes of the last meeting were read and Councilman Haynes moved that same be adopted, Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery and Haynes, 3; nayes, none, Councilmen Nolen and Searight absent. The application of 0. 0. Terrell to erect an electric sign in the 200 block on West 6th Street, together with the Safety Committee's report upon same, was read and Councilman Avery moved that same be granted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery and Haynes, 3; nayes, none, Councilmen Nolen and Searight absent. The application of Billy Ebner to erect electric signs at Sutor Hotel, 503 Brazos Street and 115 West 6th Street, together with the Safety Committee's report upon same, was read and Councilman Avery moved that same be granted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery and Haynes, 3: nayes, none, Councilmen Nolen and Searight absent. The application of D. D. Burratti to install a gasoline pump at 1007 East 6th Street, together with the Committee's report upon same, was read and Councilman Avery moved that same be granted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery and Haynes, 3; nayes, none, Councilmen Nolen and Searight absent. The application of J. M. Gallaher to erect a filling station at the corner of East 5th and Comal Streets, together with the Committee's report upon same was read and Councilman Avery moved that same be refused for the reasons set out in said Committee's report. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery and Haynes, 3; nayes, none, Councilmen Nolen and Searight absent. The Mayor introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of One Thousand, Two Hundred Dollars ($1,200.00) be and the same is hereby transferred from the account for substitute firemen of the Fire Department in the Budget of the City of Austin for year 1924 to the miscellaneous account of the Police Department of said Budget. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Mayor Yett moved that the bid of Oscal Ulit to furnish meat to the City Hospital for the six months beginning January 1st, 1925, be accepted as the lowest and best bid. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Haynes moved that in view of present conditions, opinions rendered, and at the request of City Attorney, J. Bouldin Rector, that he be excused from participating in the mandamus proceedings now pending and the Mayor be authorized, with the consent of a majority vote of the City Council, to employ special attorneys to represent the City Council in the mandamus proceedings in the District Court. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Haynes and Searight, 3; nayes, Councilmen Avery and Nolen, 2. Mayor Yett announced that he would employ Cofer & Cofer, Attorneys, as special attorneys to represent the Council in said mandamus proceedings. Councilman Searight moved the approval of the selection. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Haynes and Searight, 3; nayeв, Councilmen Avery and Nolen.
