M REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, February 5.. 1925. The Council was called to order by the Mayor. Roll call showed the following members present: Wayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; absent, none. Councilman Haynes moved that the reading of the Minutes of the last meeting be suspended. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none, Communication of J. Bouldin Rector in regard to parallel parking of automobiles on Eighth Street was read and ordered filed, tipom the recommendation of the Safety Committee on the application of A. D. Lightsey for permission to install a gasoline storage tank at the rear of 104 West 7th Street, Councilman Avery moved that same be granted, Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Hayhев, Nolen and Searight, 5; nayes, none. The application of the H&TC Railway Company for permission to erect a 25 H.P. boiler in Block 30, City of Austin, adjoining the alley 120 feet north of East 3rd Street was read and Councilman Avery moved that same be approved. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The petition of the White Shoe House and others, complaining of the coal chute on the sidewalk of the F., M. Scarbrough Building as being a nuisance was read and Councilman Avery moved that a committee from the City Council be appointed to confer with the owner of said building. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Upon the recommendation of the Safety Committee upon the application of Jas. A. Nelson for permission to install two gasoline pumps and tanks and to erect a drive-in gasoline filling station at 2200 East Avenue, Councilman Avery moved that same be granted as recommended. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5: nayes, none. Upon the recommendation of the Safety Committee on the application of 0. 0. Terrell for permission to install a sheet metal sign at 14th and Lavaca Streets, Councilman Avery moved that same be refused for the reasons set out in the report of said Committee. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Avery introduced the following resolution: WHEREAS, on April 1, 1917, the City of Austin entered into a certain contract with J. B. Pope whereby said Pope agreed to pay the cost for certain water and electric line extensions to the property of said Pope, situated on Holly and Haskell Streets in City of Austin, and in consideration of which the City agreed to refund to said Pope the said costs from receipts for service on said line extensions until the full amount of such costs had been repaid to said Pope; and 381 382 WHEREAS, in performance of said contract, said Pope has paid for water line extensions the sum of $279.68 and for electric line extensions the sum of $325.29, making the aggregate sum of $604.97 so paid by said Pope; and WHEREAS, the City has not as yet refunded any part of said sum so expended, and it is deemed expedient that the account between said parties be closed; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of $604.97 be and the same is hereby appropriated out of the Earnings Fund of the Water, Light and Power Department of the City of Austin for the purpose of refunding to the said J. B. Pope the amount paid by him for water and electric line extensions, as aforesaid; and the City Clerk and the Mayor be and they are hereby authorized and instructed to, respectively, issue and execute upon proper voucher from the Water, Light and Power Department, a warrant payable to said J. B. Pope for $604.97 in full satisfaction of the obligations of the City under said contract. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Haynes introduced the following resolution: WHEREAS, 48 x 125 feet of the N. W. part of Lot 3, of Lee's Addition, in Outlot 78, Division "D" City of Austin, was assessed for City taxes for the year 1922 in the name of Dr. W. D. Lightfoot, and at a valuation of $1855.00, which was a proper valuation; and WHEREAS, the same property was assessed in the name of the same owner for the year 1923 at the valuation of $3785.00, and the taxes, as computed upon the basis of said valuation, amounted to $88.95, which amount has heretofore been paid by said owner; and WHEREAS, it appears that the valuation of $3785.00, placed by the Board of Equalization upon said property for said year of 1923 was an error, and that said property should have been valued for said year at $1855.00, the same value as for the year 1922; and WHEREAS, the proper amount of taxes due by said owner for the year 1923 on said property, computed upon the basis of the valuation of $1855.00 and at the rate levied for said year, would have been $43.59; and WHEREAS, it appears from the above facts that said owner has paid to the City, through said error, in excess of the taxes properly due for said year 1923, the sum of $45.36, which is the difference between the amount actually paid by him upon said erroneous assessment, to-wit, $88.95, and the amount that should have been actually charged as taxes against him upon a proper assessment of said property for said year, to-wit: $43.59, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of $45.36 be and the same is hereby appropriated out of the General Fund of the City of Austin for the purpose of refunding such amount to Dr. W. D. Lightfoot for the excess amount so paid by him and the Clerk and the Mayor are authorized and instructed, respectively, to issue and execute the warrant of the City, payable out of said fund to the order of said Lightfoot for said purpose. The above resolution was adopted by the following vote: Ayes, Mayor i Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayen, none. The reports for January of Fred Sterzing, Assessor and Collector, W. D. Walker, Dairy Inspector, Miss Anna R. Fuchs, Municipal Nurse, A.S. Anderson, Public Weigher, were read and ordered filed. The communication of A. J. Eilers complaining of oil being unloaded in the rear of MoKean Eilers store as being a fire hazard was read and Councilman Haynes moved that same be referred to C. L. Woodward, Fire Chief, for his report back to the Council. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The communication of 0. L. Woodward, Chief of the Fire Department, in regard to the hospital bill of J. E. Woody for operation, etc., was read and Councilman Haynes moved that same be referred to the City Attorney and Police Commissioner for their report back to the City Council. The claim of the Superior Incinerator Company of Texas for $13,166.00 was submitted to Council and Councilman Haynes moved that same be approved. Cunningham to install a filling station at 5th and Red River Streets was read and Councilman Avery moved that same be granted as recommended by the Safety Committee. Mayor Yett introduced the following resolution: WHEREAS, the city taxes on Lot No. 6, Block No. 4, in Outlot No.6, Division "O", owned by Mrs. Jennie R. Granberry, are delinquent for the years 1898, 1905 to 1914, both inclusive, and 1917 to 1923, both inclusive said taxes amounting in the aggregate to the sum of $117.62, exclusive of penalties and interest; and WHEREAS, it appears that the owner, acting under the advice of her attorney, had abandoned her claim of ownership on said property on account of adverse possession, but that recently she has recovered same by court proceedings; and it appears further that during most of said years said property was assessed at an excessive valuation and in the name of "Unknown 383
