Fuchs, Municipal Nurse, A.S. Anderson, Public Weigher, were read and ordered filed. The annual report of Robert Rockwood, Fire Marshal, for year 1924 was read and ordered filed, The Council then adjourned. REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, February 12,1925. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; absent, none. The Minutes of the last meetings were read and upon motion of Councilman Avery were adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The communication of A. J. Eilers complaining of oil being unloaded in the rear of MoKean Eilers store as being a fire hazard was read and Councilman Haynes moved that same be referred to C. L. Woodward, Fire Chief, for his report back to the Council. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The communication of 0. L. Woodward, Chief of the Fire Department, in regard to the hospital bill of J. E. Woody for operation, etc., was read and Councilman Haynes moved that same be referred to the City Attorney and Police Commissioner for their report back to the City Council. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The claim of the Superior Incinerator Company of Texas for $13,166.00 was submitted to Council and Councilman Haynes moved that same be approved. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none The report of the Safety Committee upon the application of G. W. Cunningham to install a filling station at 5th and Red River Streets was read and Councilman Avery moved that same be granted as recommended by the Safety Committee. Motion prevailed by the following vote: Ayes, Mayor Yett, Counoilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Mayor Yett introduced the following resolution: WHEREAS, the city taxes on Lot No. 6, Block No. 4, in Outlot No.6, Division "O", owned by Mrs. Jennie R. Granberry, are delinquent for the years 1898, 1905 to 1914, both inclusive, and 1917 to 1923, both inclusive said taxes amounting in the aggregate to the sum of $117.62, exclusive of penalties and interest; and WHEREAS, it appears that the owner, acting under the advice of her attorney, had abandoned her claim of ownership on said property on account of adverse possession, but that recently she has recovered same by court proceedings; and it appears further that during most of said years said property was assessed at an excessive valuation and in the name of "Unknown 383 384 Owner"; and WHEREAS, for the above reasons it is deemed equitable and just that the City should not require interest and penalties on said delinquent taxes; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Assessor and Collector of Taxes be and he is hereby authorized and instructed to receive in full payment of the taxes for said years the actual taxes on each year, amounting in the aggregate to the sum of $117.62, and that he issue his receipts to said owner for said years, respectively. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Avery introduced the following resolution: WHEREAS, on January 12, 1910, the City of Austin entered into a certain contract with J. R. Bailey, E. B. Hancock and J. H. Raymond, Jr., whereby the said last named parties agreed to pay the cost of certain water pipe and construction on East 32nd Street from Duval Street to Oakwood Drive, and then up Oakwood Drive to a point in the City of Austin, in consideration for which the City agreed to refund to said parties said costs from receipts for service on said line; and said parties have heretofore paid for all of said pipe and construction, and have received certain refunds thereof; and WHEREAS, on May 2, 1910, said City entered into a certain contract with J. R. Bailey and J. H. Raymond, Jr., whereby said last named parties agreed to pay the costs for certain electric line construction to Beausite Addition, in consideration for which the City agreed to refund to mid parties said cost from receipts for service on said line; and said parties have heretofore paid said cost and have received certain refunds thereof; and WHEREAS, said J. H. Raymond, Jr., is now dead, and has left surviving him his wife, Mrs. Alice Raymond, as his sole devisee and heir; and WHEREAS, it appears that there is still outstanding to the credit of the estate of J. H. Raymond, Jr., deceased, on account of the terms of both of the above mentioned contracts in the aggregate, the sum of $374.18, and it is deemed expedient that the account between the City and said Estate be now closed; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of $374.18 be and the same is hereby appropriated out of the Earnings Fund of the Water, Light and Power Department of the City of Austin for the purpose of refunding to the said Mrs. Alice Raymond, as sole devisee and heir of J. H. Raymond, Jr., deceased, the amount at this time outstanding under both of said contracts; and the City Clerk and the Mayor be and they are hereby authorized and instructed to respectively issue and execute, upon proper doucher from theWater, Light and Power Department, a warrant payable to said Mrs. Alice Raymond, devisee of J. H. Raymond, Jr., deceased, for $374.1.8 in full satisfaction of the obligations of the City under both said contracts, to said Mrs. Alice Raymond, and the estate of said J. H.
