The application of Chas. Koch to erect an electric sign at 405 West 6th Street was read and referred to the Safety Committee by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes and Searicht, 4; nayes, none, Councilman Nolen absent. Councilman Haynes moved that the resolution dated March 19th, 1925, approving the Mayor's budget for the year 1925 be adopted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes and Searight, 4; nayes, none, Councilman Nolen absent. The Council then adjourned. Jae Homely REGULAR MEETING OF THE CITY COUNCIL: Austin, Tехав, April 3, 1925. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; absent, none. Mayor Yett moved that the reading of the Minutes be suspended and a committee be heard. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The petition of G. H. Griffin and other residents of the Seventh Ward, protesting against certain residents was read and no action upon same was taken. , F. C. Von Rosenberg, Attorney for the Ed H. Taylor Estate, appeared before the Council and asked that certain person property taxes on the Ed H. Taylor Estate be remitted. Councilman Haynes moved that the matter be referred to the City Attorney, for his report back to the Council. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Jas. H. Hart, Attorney for owners of gasoline curb pumps and tanks appeared before the Council and asked that the enforcement of the ordinance be withheld for the present. No action upon same was taken. The report of the Safety Committee upon the application of C. L. Solomon to erect a gasoline tank in the rear of %117 West 7th Street was read and Counoilman Avery moved that same be granted, as recommended by the Safety Committee. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Heynes, Nolen and Searight, 5; nayes, none. Will J. Dill appeared before the Council and asked that the City re-inforce the wall on Shoul Creek adjoining his property. The same was referred to the Street Commissioner. Councilmen Nolen moved that the fine assesned against H. G. Woodruff for speeding, in the amount of $12.80, be remitted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; neyes, none. Councilman Haynes introduced the following resolution: WHEREAS, it appears from the statement of the Board of Equalization herewith attached that the protest of the Pierce Petroleum Corporation against the valuation placed on property assessed to said Company for taxes of 1924 was made to said Board within the required time and that the assessment should now be corrected in accord: 410 414 ance with sworn affidavit of Arthur G. Falk, Agent of said Company, herewith attached, same having been delayed on account of time taken up in adjusting the matter from headquarters of the Company in St. Louis, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assessor and Collector be and he te hereby instructed to correct the assessment in accordance with the affidavit and suggestion of the Board of Equalization and take credit for amount of reduction. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The monthly reports of Mrs. R. C. Walker, Pure Food Inspector, and the Public Health Nursing Association were read and ordered filed. Mayor Yett moved that the hospital bill of John Woody be cancelled and that the claim of Dr. Robt. W. Shipp, in the amount of $200.00, and the drug bill of Griffith Drug Company be paid out of the Miscellaneous Fund in the Fire Department. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Councilman Avery introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Mayor shall execute, on behalf of the City of Austin, the Memoranda of Agreement between A. J. Zilker and THE CITY OF AUSTIN, by the terms of which said Zilker will relinquish and release to the City, for its exclusive use and benefit, the strip of land 30 feet wide heretofore reserved by him in his deed, dated January 15, 1918, conveying to the City certain premises out of the Wm. Barton Labor in Travis County, Texas, known as "Barton Springs", said Deed being recorded in Book 302, at pages 360-363, of the Deed Records of Travis County, Texas, and in consideration of which the City will construct both water and electric lines from the Barton Springs property to the premises of said Zilker, known as the Dohme and Walsh places, and furnish the buildings now situated on said places, and for the purposes specified in said agreement, with electric light and water service, saià Agreement of said Zilker to continue so long as the City shall comply with its agreement, and the City may discontinue such service at anytime by giving said Zilker six months notice in writing of its intention so to do, and in event such service be discontinued the right of easement of said Zilker over said strip of land shall be restored to him. BE IT FURTHER RESOLVED, that upon the execution, in duplicate originals, of Baid memoranda of contract by coth of the parties hereto, the City Clerk shall retain one of said originals for the City, and shall couse same to be recorded in the office of the County Clerk of Travis County, Texas, und after the recording of same shall preserve said instrument in the files of the City. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The Council then recessed.
