Richard Yett, Attorney for John Darter, appeared before the Council and asked that the report of the Committee appointed to determine damages be read. After hearing the report read Councilman Haynes moved that the recommendation of the Committee as to the amount of settlement with J. A. Darter, to-wit, $875.00, be approved, subject to the acceptance of same by Darter, and that the City Attorney be authorized and instructed to agree on behalf of the City to a judgment in court in said amount, said judgment to bear interest at 6% from and after the date hereinafter stated, said judgment to be for all damages, past and future, to said Darter on account of the matters set out in said report, and execution on said judgment be not issued until after March 15, 1926. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. The claime of J. F. Johnson for $581.00 and $2000.00, respectively, for repairs on account of fire to Water and Light Department's store room, ware presented and Councilman Avery moved that the claims be allowed and warrants be issued out of the Earnings Fund of the Water, Light and Power Department in payment of same. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight,5; nayes, none, The communication of 0. 0. Thorenson, asking that certain street improvements be made was read and referred to the Street Department. Councilman Avery moved that the City Attorney be instructed to draw resolution transferring $300.00 from the amount budgeted in the General Fund for codifying ordinances to the account of salary of Police Department in said Fund. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. The monthly reports of C. N. Avery, Superintendent Water, Light and Power Department, and J. N. Littlepage, City Marshal, were read and ordered filed. The Council then adjourned. REGULAR MEETING OF THE CITY COUNCIL: Austin, Tехав, October 1st, 1925. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; absent, none. The Minutes of the last meeting were read and Councilman Avery moved the same be adopted. A committee from the Young Men's Business League, composed of Carl Mueller, Early Wilson and J. O. Corwin, appeared before the Council and asked that a movement be started towards re-surfacing Congress Avenue. George W. Mendell, Sydney Smith and P. J. Neff of the I&GN Railway Company appeared before the Council and Mr. Neff proposed that the City !! 475 476 appropriate $2500.00 towards the completion of the roadway under the I&GN Railway track on West 6th Street and the Railway Company would bear the other expenses necessary to complete the span. Councilman Searight moved that the proposition of Mr. Neff, as Attorney for the I&GN Railway Company, be accepted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; nayes, none. Mayor Yett moved that the Council reconsider the motion made by Councilman Searight accepting the proposition of Mr. Neff and that the same be spread upon the minutes. The Mayor laid before the Council the following ordinance: AN ORDINANCE AUTHORIZING THE HOUSTON & TEXAS CENTRAL RAILROAD COMPANY TO EXTEND ITS OIL SPUR TRACK, LOCATED IN THE EXTREME EAST PORTION OF THE CITY OF AUSTIN AND NEAR ITS OIL STORAGE TANK ON, OVER AND ACROSS PERDENALES STREET TO THE PROPERTY OF THE MAGNOLIA PETROLEUM COMPANY, LYING EAST OF SAID STREET, SAID TRACK TO BE LOCATED TWENTY (20) FEET NORTH OF ITS MAIN LINE. The ordinance was read the first time and Councilman Haynes moved that the rule be suspended and the ordinance be placed on its second reading. The communication of Mrs. R. C. Walker, Pure Food Inspector, with reference to the sanitary condition of property owned by W. A. Boswell, was read and referred to the City Attorney. The petition of Mrs. M. E. Perrenot and other residents, asking that certain street improvements be made was read and referred to the Street Department, The monthly reports of Mrs. E. Schulz, Superintendent City Hospital, A. S. Anderson, Public Weigher, Fred Sterzing, Assessor and Collector of Tахев, was read and ordered filed. The communication of J. W. Maxwell, in re: collection of delinquent taxes, was read and ordered filed. The Mayor introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of Three Hundred Dollars ($300.00) be and the same 18 hereby transferred from the fund for codifying the city ordinances, as appropriated in the Budget of 1925 under Department "A", to the Police Department, for the purpose of paying the salary of an extra policeman to be assigned to the University neighborhood. Williams and other property owners on East 12th Street, protesting against the payment of their proportionate share for tarviating said street, was read and laid on the table. Harry Graves appeared before the Council and asked the Council to appoint a committee to investigate conditions at the slaughter houses east of the City. Councilman Searight introduced the following ordinance: AN ORDINANCE LEVYING ASSESSMENT FOR THE PAYMENT OF PART OF THE COST OF IMPROVING WEST THIRTY-SECOND STREET, FROM ITS INTERSECTION WITH GUADALUPE STREET TO ITS INTERSECTION WITH SPEEDWAY, AND TO FIX A CHARGE AND LIEN AGAINST THE OWNERS OF PROPERTY AND THEIR PROPERTY ABUTTING SAID PORTION OF SAID STREET, AND PROVIDING FOR THE COLLECTION AND ENFORCEMENT THEREOF. The ordinance was read the first time and Councilman Haynes moved that the rule be suspended and the ordinance be placed on its second reading.
