REGULAR MEETING OF THE CITY COUNCIL: : Austin, Texas, November 5,1925. The Council was called to order by Mayor Pro tem Haynes. Roll call showed the following members present: Mayor Pro tem Haynes, Councilmen Avery, Nolen and Searight, 4; absent, Mayor Yett. The Minutes of the last meeting were read and Councilman Avery moved that same be adopted. Motion prevailed by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Avery, Nolen and Searight, 4; nayes, noen, Mayor Yett absent. Mayor Pro tem Haynes introduced the following resolution: WHEREAS, the records of the Assessor and Collector show a double payment of taxes for 1924 on Lot 4 (8 acres) of Block "B", Original Subdivision of J. E. Bouldin Estate, assessed by Miss Mary Dawson, the taxes having been paid by Mrs. Belle Daniel and through error said payment was not deducted from tax receipt issued to Miss Dawson when paying taxes on her entire assessment for 1924, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Clerk be and he is hereby instructed to issue a warrant in favor of said Mary Dawson against the General Fund for $18.49, amount due her by reason of the double payment and as per bill of the Assessor and Collector in her favor herewith attached. The above resolution was adopted by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Avery, Nolen, and Searight, 4; nayes, none, Mayor Yett absent. The petition of J. W. Stramler to erect a gasoline filling station at 3000 Duval Street, together with the Safety Committee's report upon same, was read and Councilman Avery moved that same be granted as recommended. Motion prevailed by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Avery, Nolen and Searight, 4; nayes, none, Mayor Yett absent. The petition of Mrs. D. C. McCaleb, Chairman of Legion Auxiliary, asking permission to sell poppies on Armistice Day was read and laid on the table. AFTERNOON SESSION The Council met with the following members present: Mayor Yett, Councilmen Avery, Haynes, and Holen, 4; absent, Councilman Searight. The monthly reports of Fred Sterzing, Assessor and Collector, und Jus. H. Maxwell, Sealer Weights and Measures, were read and ordered filed. Councilman Nolen then left the Council Chamber. Mayor Yett luid before the Council the following ordinance: AN ORDINANCE REPEALING IN PART SUBSECTION (4) OF SECTION NINE OF THE ORDINANCE ENTITLED: "AN ORDINANCE REGULATING TRAFFIC ON THE STREETS OF THE CITY OF AUSTIN, CUMULATIVE OF CERTAIN ORDINANCES HEFETOFORE ORDAINED, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND FRESCRIBING PENALTIES. The ordinance was read the first time Councilman Haynes moved that the rule be suspended as the ordinence Le placed on its second reading. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, 2; nayes, none, Councilmen Nolen and Semricht absent. The ordinance as read the second time and Councilman Haynes moved a further suspension of the rule and the ordinance be placed on ise third reading 487 488 and final равваgе. Motion prevailed by the following vote: Ayen, Meyor Yett, The ordinance was read the third time and Councilman Haynes moved that same be finally passed. Councilman Avery moved that the City Clerk be instructed to advertise for bids for 4-inch pavement on present concrete base on 4th Street, from west line of Colorado Street to east line of Brazos Street, bids to be received until ten o'clock A. M., November 12th, 1925. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, and Haynes, 3; nayes, none, Councilmen Nolen and Searight absent. The bids of Jno. L. Martin, Donnelly & White, and D. G. Hewlett to furnish pipe for the laying of a sewer line from the Feeble Minded Colony south to West 5th Street, were read and Councilman Haynes moved that Councilman Avery be authorized to enter into a contract with all three bidders, each to supply one-third of the amount required. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, and Haynes, 3; nayes, none, Councilmen Nolen and Searight absent. The Council then adjourned. The following bids for paving Fourth Street from Colorado to Brazos Streets were opened and read: J. P. McDonald G. Q. Menefee Miller Surfacing Co. Johnson Brothers. W. E. Dozier. Counoilman Avery moved that all bids be referred to the City Engineer for comparison and tabulation and report back to the Council at 3:00 P. M., Friday, November 13th, 1925. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, and Searight, 4; nayes, none, Councilman Holen absent. The application of Ramon Fragosa to erect an electric sign at 120 Congress Avenue was read and Councilman Avery moved that same be referred to the Safety Committee. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, and Searight, 4; nayes, none, Councilman Nolen absent. The Council then recessed.
