    The city settled a claim with the Wallace family, granting them a lot in Oakwood Cemetery Annex as compensation for the disinterment of their child.

Gentlemen: Body. "Austin, Texas, November 23, 1925. The Board of Equalization makes the following report to your Honorable We have adhered to the Unit System's figures as a rule, lowering values in a few instances, raising the same in others, especially on the ground. We have examined the new improvements very carefully and, after making measuremente, etc., placed what we considered proper values on same, taking such pains to prevent anything that can be called favoritism or discrimination. In doing this, we looked into the record of permits taken out. We found a large number of residences erected in the year 1924 for which no permite were on record. Carefully considered proper valuations on same. If the owner of the lot could be found, notice was sent; otherwise they were assessed as OWNER UNKNOWN. In this connection, will state the total assessed valuation amounts to about $85,000.00. This amount is, of course, in addition to that found by permits. This might be better expressed as "pick ups". " Councilman Searight introduced the following resolution: WHEREAS, in the adjustment of the claim of Wiley Wallace and wife; Thelma Lee Wallace, for damages in the matter of disinterment of the body of their child, Dorothy Nell Wallace, it was agreed that the said Wiley Wallace and wife were entitled to select and have conveyed to them a lot in Oakwood Cemetery Annex; and WHEREAS, said Wiley Wallace and wife, Thelma Lee Wallace, have selected Cemetery Lot No. 369, Section "E", Oakwood Cemetery Annex. Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Mayor be and he is hereby authorized to execute a deed to said Wiley Wallace and wife to Lot No. 369, Section "E", Oakwood Cemetery Annex. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, and Searight, 4; nayes, none, Councilman Nolen absent. The Council then recessed. SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, December 1st, 1925. The Council was called to order by the Mayor Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen and Searight, 5; absent, none. Councilman Searight introduced the following resolution: : WHEREAS, a present public necessity exists that the City of Austin should acquire land for the purpose of establishing thereon a cemetery to be used exclusively for colored persons; and, WHEREAS, D. V. Pickle has offered to sell to the City for such purpose the certain tract of land described as the West one-half of Outlot 25, in Division -"B" of the Outlots of the Government Tract adjoining the City of Austin, in Travis County, Texas, and being Fifteen acres, more or less, according to the map or plan of said City and Outlote on file in the General Land Office of the State of Texas, for the consideration of Five Thousand Five Hundred ($5500.00) Dollars in cash; and WHEREAS, the City Council has inspected said tract of land and considers same suitable for said purpose, and considers as fair and reasonable the price asked therefor, and considers further that it is desirable to purchase said tract of land at once; and WHEREAS, the City Attorney has examined the title to said tract of land and has found good and merchantable title thereto to be vested in said D. V. Pickle; and WHEREAS, there are not sufficient funds of the City available at the present time to pay all cash for said tract of land except in the Cemetery Purchase Fund, and the City Charter inhibite the incurrence of any debt beyond the calendar year in order to cover any deferred paymente thereon; and WHEREAS, on account of the premises, it is deemed expedient that the amount of money necessary to purchase said tract of land be withdrawn from said fund temporarily, and that same be appropriated and budgeted in the City's Annual Budget for 1926 to the credit of said fund to reimburse same to the extent of the money hereby withdrawn therefrom; THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. That the sum of Five Thousand Five Hundred ($5500.00) Dollars be and the same is hereby appropriated out of the Cemetery Purchase Fund of the City of Austin, and that a warrant therefor, payable to said D. V. Pickle, be issued and executed, respectively, by the City Clerk and the Mayor, and that said warrant be delivered to said D. V. Pickle, upon the delivery by said D. V. Pickle to the City Clerk of his general warranty deed conveying to said City of Austin said tract of land, and a complete abstract of title showing good and merchantable title in and to said tract of land to be vested at the time of said trans- action in said D. V. Pickle, free from all liens and incumbrances whatsoever; and that the City Attorney be directed to see that all details of said transaction are properly carried out in order to vest title to said tract of land in the City of Austin.
